Granger, Jr. , for a permit to locate a mobile home at 24 Luzerne Road. Proof of publication was presented and read aloud by the clerk. Supervisor Solomon requested a voice of opinion from any persons present either in favor of or in opposition to the granting of the permit in question. There was none. The public hearing was closed at 8:08 p.m. RESOLUTION TO AUTHORIZE PERMIT FOR MOBILE HOME RESOLUTION N0, 175, introduced by Mr. Robertson, seconded by Mr. Austin. WHEREAS, Elliot D. Granger, Jr. of 24 Luzerne Road, Town of Queensbury, has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled; ORDINANCE FOR THE REGULATION OF MOBILE HOMES and MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property situated 24 Luzerne Road, Town of Queensbury, and WHEREAS, this town board has .conducted a public hearing in connection with said application and has heard all persons desiting to be heard in favor of or against said application, and WHEREAS, it° is he;rebyAdgte;mined that the facts presented in said application and at said public hearing are sufficient to authorize the issuance of the permit requested by said application, for the following reasons: There were no persons in appearance in opposition to the granting of the permit. The applicant will make use of the permit when he returns from service in Vietnam, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, permission is hereby given to Elliot D. Granger, Jr. , of 24 Luzerne Road, Town of Queensbury to locate a mobile home outside of a licensed mobile home court, at property situated at 24 Luzerne Road, Town of Queensbury, Glens Falls, New York, and that the Town Clerk is hereby authorized and directed to issue such permit in accordance with the terms and conditions of said ordinance. Duly adopted by the following vote: Ayes - Mr. Demboski, Mr. Austin, Mr. Robillard, Mr. Robertson and Mr. Robertson. Noes - None The clerk presented the application of Mrs. Ada Russell for a permit to locate a mobile home on Burch Road. The decision on the application was tabled at this time. Davidson Town Justice Town of Queensbury Councilman Austin reported on the progress of the development of an ordinance which would regulate "STOP" signs within the Town of Queensbury. RESOLUTION NO. 176, introduced by Mr. Robertson, seconded by Mr. Solomon. WHEREAS, the Queensbury Water Superintendent has recommended the purchase of Cast Iron Pipe Fittings under bids, to supply the needs of the Water Department in the re-construction of Route 94 being done at present by the State of New York Department of Transportation, and has filed detailed specifications of the material requested with the Clerk of this Board, now therefore be it RESOLVED, that the Town Clerk be and he hereby is authorized and directed to cause to be published once in the Tlens Falls Times and The Post Star, on or before Aug . 30th, 1969, a notice to read in substantially the following form: NOTICE TO BIDDERS Notice is hereby given that the Town Board of the Town of Queensbury will receive sealed proposals up to 5:00 P.M. on Sept. 11th, 1969 at the Town Clerks office at the Town Office Building, Bay Road, Town of Queensbury, R.F.D. #1 Bay Road, Glens Falls, New York, to supply the Queensbury Water Department with Cast Iron Pipe Fittings. as follows: ' 7 -Item Number required L Plugs - 6 inch 8 2,plugs " ," 8 inch 6 3. Bids must be submitted in sealed opaque envelopes plainly marked "Cast Iron Fittings Bid" and there shall be included the certificate of non -collusion as required b Section 102d of the General Municipal y P Law. The Town Board will meet at 8:00 P.M. on September 11th, 1969, at which time the bids will be opened and read aloud. The Town Board reserves the right to reject any or all bids. Noes - None Superintendent of Highways, Carl Garb announced that the Town of Queensbury Sanitary Land Fill would operate on Sunday hours on September 2nd, 1969. The hours for dumping will be from 12:00 noon until 5:00 p.m. Mrs. Eloise Weed was granted the floor. Mrs. Weed requested the re-surfacing -of the old Assembly Point Road, where she resides. A further request was advanced by Mrs. Weed that snow be removed from that road during the winter months. RESOLUTION NO. 177, introduced by Mr. Robillard, seconded by Mr. Robertson, WHEREAS, THE Town Board has heretofore established the South Queensbury Lighting District Extension No. 1 in the Town of Queensbury which is contiguous to the existing South Queensbury Lighting District, and WHEREAS, it Lb P*WlHga $JF Section 206 of the Town Law that consolidation of special districts may be made by resolution, subject to permissive referendum, adopted by the Town Board after public hearing, and WHEREAS, it appears to be mutually advantageous to the property owners in both the South Queensbury Lighting District Extension No. 1 and the South Queensbury Lighting District that the same be consolidated, be it RESOLVED, that the Town Board meet and hold a public hearing on a proposal to consolidate the South Queensbury Lighting District Extension No. i and the South Queensbury Lighting District and that such public hearing be held at the Town Office Building Bay Road in said town on the 11th day of September, 1969, at 8:00 o cicok, P. M. (DST) at which time and place all persons interested in the matter of such proposed consolidation will be heard concerning the same, and be it further RESOLVED, that the Town Clerk be and he hereby is directed to give due notice of such public hearing in the manner provided by law. Seconded by Mr. Austin WHEREAS, the Town Board of the Town of Queensbury deems it in the public interest to enact the following ordinance to regulate littering in said Town and to hold a public hearing thereon as required by law, BE IT RESOLVED that a public kearing on the following --� proposed Ordinance be held on September 11th, 1969 at 8 :15 o'clock P.M. D. S.T. at the Town Office Building, Bay and Haviland Roads, Town of Queensbury, Warren County, New York and that due notice thereof be published in the official newspaper of the Town of Queensbury as required by law. ORDINANCE REGULATING LITTERING IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK Section 1. No persons shall throw, or deposit, or cause to be thrown or deposited any dirt, filth, waste's, tin cans, containers, bottles or any discarded substances of a solid nature in or upon any public place whatsoever within said Town except in such area or areas designated by said Town for such purposes. Section 2. A violation of this ordinance whall constitute an offense punishable by a fine not exceeding $25.00 or by imprisonment in the Warren County Jail for ten (10) days or by both such fine or imprisonment for the first offense, and by a fine not exceeding $50.00 or by imprisonment in the Warren County Jail for thirty (30) days or by -both such fine and imprisonment for a second or subsequent offense. Section 3. Should any section or provision of this ordinance be decided by the Courts to be uncon- stitutional or invalid, such decision shall not affect the validity of the ordinance as a whole or any part thereof orther than the part so decided to be unconsti- tional or invalid. Section 4. This ordinance shall take effect ten (10) days after its publication and posting as required by law. Duly adopted by the following vote the 27yh day of August, 1969. Seconded by Mr. Robertson RESOLVED, That the Supervisor be and he hereby is authorized and directed to make application to the Water Resources Commission of the State of New York for approval of the plans of Queensbury Water District Extension No. 2 for constructing a water distribution system and obtaining water from the Queensbury Water District. RESOLVED, that the Superintendent of Highways, Carl Garb, is hereby authorized to attend the convention of the New York State Association of Town Superintendent of Highways, Inc. to be held September 10-11 129 1969 at the Sagamore Inn in Lake George, New York, and that the actual and necessary expense at such convention be and the same is a proper town charge. Duly adopted by the following vote: Ayes - Mr. Demboski, Mr. Austin, Mr. Robillard, Mr. Robertson and Mr. Solomon. Noes - None RESOLUTION TO DESIGNATE POLLING PLACES IN THE TOWN OF QUEENSBURY RESOLUTION NO. 181, introduced by Mr. Robillard, seconded by Mr. Solomon. WHEREAS, Article 4 Section 66 of the Election Law provides that this Board shall designate the Polling Places where the °Registration of Voters and Election and Primary,shall be held during the year following. Noes - None RESOLUTION TO AUTHORIZE ATTENDANCE AT MEETING RESOLUTION NO. 182, Introduced by Mr. Robertson, seconded by Mr. Austin. RESOLVED, that permission is hereby granted to Thomas K. Flaherty, Water Superintendent, to attend the fall meeting of the Adirondack Water Works Association to be held September 9-10-11, 1969 at the Lake Placid Club, Lake Placid, New York, and that the actual and necessary expenses incurred in such attendance is a proper town charge.
