1969-10-02 SP RESOLVED, that five (5) street lights be changed from 175 watt white mercury to 400 Watt white mercury street lights and an additional nine (9) 400 Watt white mercury street lights be installed from the Northway to Dixon Road along Aviation Road. Duly adopted by the following vote: Ayes - Mr. Demboski, Mr. Austin, Mr. Robillard, Mr. Robertson and Mr. Solomon. Noes - None Councilman Austin noted that the State of -New York will be road marking the section of Ridge load from Quaker Road past the section of Ridge Meadows: RESOLUTION NO. 204, Introduced by Mr. Demboski, seconded by Mr. Austin. RESOLVED that the Audit of Claims as listed in Abstract #61-9A numbered #1075 through #1077 and totaling $574.31 is hereby approved. District Dr. Luria - Visitor Irving Esner - Visitor The public hearing on the matter of the proposed Extension #1 of the Broadacres Drainage District was declared open at 8:00 p.m. Proof of publication was presented and read aloud by the clerk. Supervisor Solomon invited a voice from any persons present to speak up at this time Mrs. Lawrence Cohen was granted the floor. Mrs. Cohen discussed at length the extension of the Broadacres Drainage District which pwu*ddprovide proper drainage for their homes on Griffin Place. Mr. Cohen stated that due to moisture in their home at present, they have been forced to spend a sizeable amount of money to try and relieve the problem. Mrs. Cohen also requested that the highway known as Griffin Place, be paved as soon as possible. A further request was advanced by Mrs. Cohen, that street lights be installed in the area. Mrs. Cohen also requested more police protection in the area to help alleviate vandalism. The public hearing was closed at 8:17 p.m. The clerk presented the application of Leo Mayette for a permit to locate a mobile home on the north side of Luzern-Road. On motion of Councilman Robillard, seconded by Mr. Demboski the application was tabled at this time. RESOLUTION NO. 205 INTRODUCED BY MR. AUSTIN, WHO MOVED ITS ADOPTION SECONDED BY MR. ROBERTSON At a Regular meeting of the Town Board of the Town of Queensbury, Warren County, New York, held at the Town Office Building on the 2nd day of October, 1969. PRESENT: GERALD B. Solomon, Supervisor LLOYD DEMBOSKI, Councilman JOHN D. AUSTIN, JR. , Councilman HAROLD ROBILLARD, Councilman HAMMOND ROBERTSON, JR. , Councilman In the Matter of the Establishment of EXTENSION NO. 1 TO THE BROADACRES DRAINAGE DISTRICT in the Town of Queensbury, County of Warren and State of New York, pursuant to Article- 12-A of the Town Law. WHEREAS, a map, plan and report relating to the establish- ment of proposed Extension No. 1 to Braodacres Drainage District prepared by John B. VanDusen, a competent engineer duly licensed by the State of New York, in the manner and in such detail as has -been determined by the Town Board of the Town of Queensbury has been filed with the Town Clerk of the Town of Queensbury in accordance with requirements of Article 12-A of the Town Law, and WHEREAS, an order was duly adopted by the Town Board of the Town of Queensbury on September 18, 1969, reciting the filing of such map, plan and report, the boundaries of the X97 proposed extension and a statement that the only construction required shall be the laying of mains on Griffin Place extension and that no expense other than the engineering costs, legal fees and materials will be required, the fact that the map, plan and report describing the same are on file in the office of the Town Clerk for public inspection, and stating all other matters re- quired by law to be stated, and specifying October 2, 1969 at 8:00 o'clock, P. M. (D.S.T. ) as the time and the Queensbury Town Office Building, Bay and Haviland Roads in said town as the place where the Town Board will meet to consider the map, plan and report and to hear all persons interested in the subject thereof concerning same and to take such action thereon as id authorized or required by law, and WHEREAS, such order was duly published and posted as required by law, and WHEREAS, a hearing on said matter was duly held by the Town Board of the Town of Queensbury on this 2nd day of October, 1969, beginning at 8:00 o'clock, P.M. , (D. S.T.) at the Queensbury Town Office Building in said Town and full discussion of the matter having been had and all persons desiring to be heard having been heard, NOW, upon the evidence given on such hearing and upon a motion made by Councilman Austin, who moved its adoption, seconded by Councilman Robertson, it is RESOLVED AND DETERMINED: (a) That the order containing the notice of hearing was publiched and posted as required by law. (b) That all property and property owners within the proposed district are benefited thereby. (c) That all the property and property owners benefited are included within the limits of the proposed district. (d) That it is inethe public interest to establish said Drainage District Extension, and be it further RESOLVED AND DETERMINED that the establishment of Extension No. 1 to the Broadacres Drainage District, as set forth in said map, plan and report, be approved, and that such extension shall be known and designated as Extension N8. 1 to Broadacres Drainage District, and shall be bounded and described as follows: "Beginning at the southwesterly corner of lot 9, Block 11 Broadacres Subdivision, the same being on the westerly boundary line of the present Broadacres Drainage District, running from thence South 86 degrees and 04 minutes West along a portion of the said westerly bounds of the present water district about 222 feet to an angle point in the said line; thence running _ South 30 degrees and 29 minutes East along a portion of the southwesterly bounds of the said drainage district to a point therein distant 150 feet from the southerly bounds of Griffin& Place, measuring at right angles therefrom; AQ8 thence running North 84 degrees and 14 minutes West, parallel to and 150 feet distant southerly from the southerly bounds of Griffin(rPlace, about 585 feet to the easterly bounds of Interstate Route 87; thence running in a northerly direction along the easterly bounds of the said highway about 345 feet to the southwesterly corner of lands of Marion Potter Bates, -and -others; thence running south 84 degrees and 14 minutes East along the southerly bounds thereof, 432.60 feet to the point and place of beginning." 1 i and be it further RESOLVED that the expenses of the establishment of Extension No. 1 to Broadacres Drainage District, including engineering, and legal services and materials, be paid from current funds available for such purpose and that no indebtedness be incurred for such purpose, and be it further RESOLVED that this resolution is subject to permissiv-ee referendum as provided in Section 209-e of the Town Law, and that the Town Clerk be and he hereby is directed to give due public notice of the adoption of this resolution in the manner provided by law. The adoption of the foregoing resolution was duly put to a vote, and upon roll call, the vote was as follows: Gerald B. Solomon, Supervisor AYE Lloyd Demboski, Councilman AYE John D. Austin, Jr. , Councilman AYE Harold Robillard, Councilman AYE Hammond Robertson, Jr. , Councilman AYE Dr. Harold Luria was granted the floor. Dr. Luria discussed the extensive wave of vandalism in the Broadacres section of the Town. Dr. Luria suggested the installation of more street lighting in the area. Dr. Luria suggested that he could circulate a petition, if the Town Board would accept same. Dr. Luria also discussed the lack of police protection in the Broadacres Section. Supervisor Solomon discussed the future plans of the Town Board which will result in increased police protection for the coming year 1970. Mr. William Richardson also discussed vandalism in the area of Glen Acres. Mr. Richardson suggested the possibility of adopting an ordinance which would create a night curfew in the Town of Queensbury. Supervisor Solomon stated that letters have been forwarded to the owners of the Zayer property and also to the developers of an apartment comples on Route - 9 a part of the"Zayer Shopping Center.' The letters were written by Attorney Harold W. Katz and also by Zoning Inforcement Officer, LeRoy Phillips. Mr. Stecher was granted the floor at this time. Mr. Stecher questioned the issuance of the permit for the moat recent construction on the Zayer property which is a restaurant known as "Lums". Mr. Stecher displayed photographs of the accumulation of debris at the Zayer Shopping Complex. Mr. Allan West also complained of the debries which blows on his property from the Zayer Comples. Mr. West suggested a gate in the proposed dividing fence when same is constructed. Mr. Stecher voiced apposition to the gate due to the fact that same would encourage entrance and exit from the Zayer Complex. Mr. Irving Esner was granted the floor.Mr. Esner questioned the extensive burning of leaves in residential areas of the town. i Supervisor Solomon stated that the County Board of Supervisors are considering the adoption of a fire code for the County of Warren at a later date. The meeting will be held at 10:30 A.M. on November 4, 1969 at the Queensbury Town Office Building. The Building and Zoning Report was received and placed on file, also the monthly report of the Police Department was received and placed on file. The monthly Highway report was received and placed on file. The monthly report of the Supervisor was received and placed on file. The total Reciepts for the month of September were $619247.81.
