1968-03-28 403 Mr. Robert Coons questioned the Town Board as to the reason for the delay in approving an application for a Mobile Home Permit as requested by him on January 6, 1968. Supervisor Solomon stated that a legal opinion will be forthcoming on sections of the present Town Zoning Ordinance which will allow the Town Board to either approve or reject the granting of the permit. Mr. Al DuFour questioned the Town Board as to the present status of the installation of additional highway lighting- in South Queensbury. Mr. DuFour was assured that action will be taken as soon as the `— Niagara Mohawk Power Company has completed the lay out of the district. Town Board March 27, 1968 Town of Queensbury Queensbury, New York RE: Citizens' Committee on Low Income Housing and Housing for the Elderly Gentlemen: The above citizens' committee respectfully requests that the Town Board by letter institute a formal investigation into the possibilities of Section 23 Lease Housing for the Town of Queensbury. Said letter of intent, of which there is enclosed a copy, obligates the Town in no way to do any thing further. Section 23 Lease Housing is a program whereby a citizens! committee or entity contacts local landowners and contracts with them for the leasing of their property if they will improve their property to meet nominal living standards . The program is made attractive to landowners due to the fact that the Federal Government will subsidize and guarantee payments of rents. 40.5 The program I believe, is attractive to the Town in that it provides a mechanism in which, even if only a few, some structures will be improved and we will be able to provide subsidized rent for those who need it within the Town. I, or any member of our committee, will be glati to discuss this project with the Town Board to the extent of our limited knowledge. That your Petitioners had filed plans and commenced con- struction of said shopping center prior to enactment of said Zon- ing Ordinance. It is your Petitioners' understanding that the tentative zoning plans and maps provided for a C-3 commercial zone encompassing all of the easterly portion of Petitioners' said pro- perty. That the inclusion of said southerly portion of your Peti- tioners' property in an R-4 district, as aforesaid, would appear to be unrealistic and would cause considerable hardship to your Petitioners' if the same were not re-zoned to a C-3 commercial dis- trict. 4. The westerly portion of your Petitioners' said property as shown on said map consists of a parcel of land approximately 693 feet x 972.5 feet and is presently unimproved; however, your Petitioners have prepared drawings and have been planning to erect upon said parcel of land an attractive high-grade garden apartment development as shown by the annexed site plan entitled "Proposed garden apartments, Weeks Road, Town of Queensbury . . . . Your Petitioners desire to use their said lands for the best possible use in keeping with the development of the area and submit that a graden apartment development on the westerly portion of their property, now unimproved, would act as a buffer and pro- tect the surrounding residential developments from close proximity to commercial uses and would provide a source of apartments for . persons wishing to reside in the Town of Queensbury without pur- chasing single family homes. Your Petitioners believe that the use of said property for a .graden apartment development would be a logical and useful addition to the Town of Queensbury, and due to the proximity of the ggoperty to schools and shopping centers and other services wouldAparticularly attractive to families wishing the convenience which such housing would provide. 6. Your Petitioners would be willing to provide a buffer zone at the southerly boundary where their property borders upon residential areas which would be planted with trees and shrubs in order to shield said residential areas from the commercial part of the property and to protect the values of privately owned homes in the vicinity. 7. Your Petitioners intend to provide their own sewage dis- posal plant and other facilities for said garden apartment devel- opment at their own expense and the same would not be a burden upon the said town unless the town chose to acquire the same. 8. Your Petitioners intend to build and continue to own their said shopping center and garden apartment development and intend to commence the construction of said garden apartment dev- elopment within a reasonable time after the said premises are re- zoned to an R-5 district as requested. WHEREFORE your Petitioners respectfully request that the C-3 zone be extended to include all of the easterly portion of your Petitioners' property to the southerly boundary thereof and that the unimpooved westerly portion of their said property be zoned in its entirety as R-5 garden apartments and that the Zoning Ordinance of the Town of Queensbury, the rules and regulations thereunder and the zoning map be amended, supplemented, changed or extended ac- cordingly. The Supervisor stated that he has been informed by the State of New York Department of Transportation that bids for consturction will not be let until fall of 1968. A further state- ment was made by the Supervisor to do with installation of side- walks along the new highway and also that the State of New York will share in the cost of installing water mains and sewer lines in the proposed construction.
