The Public Hearing was declared open on the application of Douglas Clyde Goodman for a permit to locate a Mobile Home on VanDusen Road. Proof of Publication was presented by the clerk. The clerk read the notice as published. Supervisor Solomon requested any statements from persons present either in favor of or in opposition to the granting of the permit. There were none. The Public Hearing was closed at 8:00 p.m. The Public Hearing on the application of Ernest R. Alden, Jr. , to locate a mobile home on Luzerne Road at the top of West Mountain was declared open by the Supervisor. Proof of Publication was presented by the clerk. The notice as published was read by the clerk. On the request of Supervisor Solomon for any statements concerning the granting of the permit, Mr. Walter Cormus stated that in his opinion, the property values in the area would be affected by the granting of the permit in question. Mr. Cormus stated that he in- tend to build substantial homes near the proposed location of the Mobile Home. 439 The Public Hearing was closed at 8:12 p.m. The Public Hearing was opendd on the application of Robert Edward Coon for a permit to locate a Mobile Home on Pinello Road. Proof of Publication was presented by the clerk. The. clerk read the notice as published. Supervisor Solomon requested a voice from any persons present either in favor of or in opposition to the granting of the permit. . Mr. Donald Hazelton spoke in favor of the granting of the permit. With no further statements from the group present, the public hearing was declared closed at 8:13 p.m. The Public Hearing on the application of Henry J. Sleight for a change in zoning regulations for land on Aviation Road was declared open at 8:15 p.m. Proof of Publication was presented by the clerk. The clerk read the notice at published. RESOLUTION TO AUTHORIZE PERMIT FOR MOBILE HOME RESOLUTION NO. 100, introduced by Mr. Robillard, seconded by Mr. Solomon. WHEREAS, Douglas Clyde Goodman of .R.F.D. #2 Luzerne Road, Queensbury, has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of .Queensbury entitled: ORDINANCE FOR THE REGULATION OF MOBILE HOMES and MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile dome outside of a duly licensed mobile home court at property situated Lots #2 & #3, left side of VanDusen Road, and _ WHEREAS, this town board has conducted a public hearing in connection with said application and has heard all persons desiring to be heard in favor of or against said application, and WHEREAS, it is hereby determined that the facts presented insaid application and at said public hearing are sufficient to authorize the issuance of the permit requested by Maid application, for the following reasons: There were no persons in appearance in opposition to the granting of the permit. In the opinion of the Town Board, property values in the area will not be adversely effected, if the permit is granted, therefore be it L. Noes - None 440 RESOLUTION TO AUTHORIZE TEMPORARY: PERMIT'FOR'MOBILE HOME RESOLUTION NO. 101 , introduced by Mr. Solomon, seconded by Mr. Robertson. WHEREAS, Ernest R. Alden Sr. , of Lucerne Road, West Glens Falls, N.Y. , has made application in accordance with paragraph 2 (b) Section 4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES and MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, .WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property situated: North west Corner of Luzerne Road and Cormus Road, top of West Mountain, and -- WHEREAS, it is hereby determined that the facts presented in said application are sufficient to authorize the issuance of the permit requested by said application, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, temporary permission is hereby given to Ernest R. Y. , has madeapplication in accordance with paragraph 2 (c) Section 4, of any ordinance of the Town of Queensbury entitled: ORDINANCE FOR -THE REGULATION OF MOBILE HOMES and MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property situated Lots #6k-7-8 Pinello Road, and WHEREAS, this town board has conducted a public hearing in connection with said application and has heard all persons desiring to be heard in favor of or against said application, and WHEREAS, it is hereby determined that the facts presented in said application and at said public hearing are sufficient to authorize the issuance of the permit requested by said application, for the following reasons: There were no persons in appearance in opposition to the granting of the permit. Noes - None 441 RESOLUTION NO. 103 INTRODUCED BY Mr. Solomon, who moved its adoption .SECONDED BY Mrs. Robertson. RESOLUTION APPROVING REZONING OF PROPERTY OF HENRY J. SLEIGHT NORTH OF AVIATION ROAD AND WEST OF UNION FREE SCHOOL DISTRICT NO. 2 WHEREAS, the Town Board after consideration of the area zoned �L-4 as described in EXHIBIT "A" attached hereto and made a part hereof and at the request of residents in the vicinity, decided it was in the public interest to call a hearing pursuant to the provisions of Sec. 11:100 of the Zoning Ordinance of the Town of Queensbury for the rezoning of this area from an "R-"4" District to an "R-5" District, as such districts are shown on the official zoning map of the Town of Queensbury and provided for in the Building Zone Ordinance; and WHEREAS, such hearing was held pursuant to notice duly given at a meeting of the Town Board in the Town Hall, Queensbury, New York, on Thursday, May 23, 1968 at which all perpons desiring to,be heard in favor of said rezoning and also those desiring to be heard in opposition thereto were given an opportunity and were heard, and thereafter the public hearing was closed and decision reserved; NOW, THEREFORE, BE IT RESOLVED BY THE TOWN BOARD that the following property located in the area of the Town of Queensbury and described in EXHIBIT "A" attached hereto and made a part `whereef be and the same hereby is rezoned from an "R-4" to an "R-5" District, and, it is FURTHER RESOLVED, that the necessary changes be made upon the zoning and departmental maps of the Town of Queensbury so as to indicate the location of said properties as being located in "R-5" Zone as defined and regulated pursuant to the proviaions of the Zoning Ordinance -and map of the Town of Queensbury, as amended; and, it is FURTHER RESOLVED, that the Town Clerk be and he is hereby authorized and directed to give the necessary notice of such change in zoning to the departments and agencies having jurisdiction in the matter Duly adopted this 23rd day of May, 1968 by the following vote: Ayes: Mr. Demboski, Mr. Robillard, Mr. Robertson and Mr. Solomon Noes - None Absent: Theodore Turner, Member The minutes of the meeting of May 9, 1968 were approved. -�' Moved by Mr. Demboski, seconded by Mr. Robillard. A petition was presented from residents of the South Queensbury area, requesting additional street lights other than have been planned to date. 442 A petition was received signed by 264 persons in the Broadacres, Dixon Road, and Reservoir Park area requesting greater police protection. ATTENTION OF THE BOARD OF SUPERVISORS OF THE TOWN OF UEENSBURY, N.Y. May 8, 1968 We the undersigned are petitioning The Board of Supervisors for better Police protection in the Broad Acres and Dixon Road area due to events which have happened in the past couple of weeks. Nightly patrols are necessary because of teenagers driving over lawns, "Five front lawns were ripped up during the weekend of May 4 and 5" and extensive littering. If anything is said to these youngsters, they use abusive language, and continue to do exactly as they please; We feel the time has come to make a complaint. Rist of 1 Alma Ave. , Hudson Falls, N. Y. has made application to this board for a permit to: Replace 5 year old Trailor with new 1968 modern Mobile Home at property situated at Corner of Corinth Road add Minnesota Ave. , and owned by Arthur & Helen Rist, and WHEREAS, upon proper investigation it appears that the applicant has complied with all of the requirements of the ordinance regulations relating to mobile homes in the Town of Queensbury, therefore be it RESOLVED, that the application of Arthur E. Rist as Above described is hereby approved and that the Town Clerk is hereby authorized and directed to issue to Arthur E. Rist the proper permit. Y. , has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, TO LOCATE A MOBILE home outside of a duly licensed mobile home court at property situated R.F.D. #3 Burch Road, Queensbury, and WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to justify further consideration by this board, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, the town board shall conduct a public hearing on said application on June 13, 1968, at 8:00 p.m. in the Queensbury Town Office Building, Bay Road, and that the Town Clerk is hereby authorized and directed to give proper notice of said public hearing in accordance with the provisions of said ordinance. Noes - None 444 RESOLUTION NO. 108, Mr. Solomon introduced the following resolution and moved its adoption, seconded by Mr. Robertson. WHEREAS, Harry Codner had been employed for many years by the Highway Department of the Town of Queensbury and had retired when he reached" the age fixed by the State Retirement System, and WHEREAS, Harry Codner had been a faithful employee of the Town of Queensbury during his many active years, be it i RESOLVED, that the members of the Town Board of the Town of Queensbury hereby record their sorrow on the passing of Harry Codner and express to Mrs. Codner their sympathy, and be it further RESOLVED, that the Town Clerk be and he hereby is authorized and directed to transmit a copy of this tesolution to Mrs. Codner. Noes - None Supervisor Solomon discussed the re-location of the facilities of the Queensbury Highway Department Town Storehouse. The meeting was recessed at 9:10 p.m. The meeting was re-called to order at 9:18 p.m. RESOLUTION NO. 109 INTRODUCED BY MR. SOLOMON, WHO MOVED ITS ADOPTION SECONDED BY MR. ROBILLARD RESOLUTION OF THE TOWN OF QUEENSBURY AUTHORIZING THE ACQUISITION OF LAND FOR A TOWN HIGHWAY DEPARTMENT GARAGE AND APPURTENANT USES. WHEREAS, Town Law -Section 64(2) authorizes the Town Board to acquire real property required for any public purpose, and WHEREAS, the Town Board has been advised by the New York State Department of Transportation that the land presently owned by the Town located on Aviation Road and used for a town garage and storehouse for the highway department is to be affected by the relocation of the intersection of Aviation and Quaker Roads and Route 9, and WHEREAS, the Town Board has been aware of the inadequacy of said present facilities and has authorized the town engineer and town surveyor to seek a new location for said highway depart- ment garage and storehouse, and WHEREAS, said town engineer and town surveyor have completed their search and have made recommendation for a new site of adequate size and preferred location, and WHEREAS, said site is presently undeveloped land within the town and most centrally located of all lands considered, and most suitable for town purposes, and 445 WHEREAS, said property must be acquired by purchase or by condemnation under the theory of eminent domain, and WHEREAS, the Town Board deems the acquisition of said real property essential to the ability of the town highway depart- , went to function efficiently and to render the best services to the residents of the Town of Queensbury, and WHEREAS, said property is to be used solely for a public purpose, now therefore, �be it RESOLVED: 1. That the acquisition of the property described in Exhibit "A" which is attached hereto, for highway department and appurtenant town uses, is hereby authorized either by purchase or condemnation. 2. That the Supervisor of ,the Town -of Queensbury be and he hereby is authorized and empowered to retain Harold W. Katz, Esq. , attorney, as counsel in the matter upon such terms as he deems proper and adviseable and he shall authorize such counsel on behalf of such Town to take such action as may be deemed advisable to acquire such lands. 3. That -the sum of Twenty Thousand Dollars ($20,000.00) is deemed the reasonable value of said land and the offer of the Town Supervisor to the owner of said land of said amount is authorized. Noes - None Absent: Theodore Turner The following is a description of 'the property referred to in Resolution No. 109 Description of 10 acres of land belonging to Douglas & Margaret Crockwell adiacent to and westerly of Quaker Road,- ALL that certain peice or parcel of land situate, lying and being in the Town of Queensbury, Warren County, New York. More particularly bounded and described as follows; -BEGINNING at a point in the northerly bounds of a one and three quarters acre parcel of land conveyed by one Hubbell to Crockwell by deed dated October 18, 1956, where the same is intersected by the westerly bounds of Quaker Road, running thence N-822 23'W along the northerly bounds of the said parcel of land about twenty feet to the north- westerly corner thereof; thence running 5-130-21'E along the westerly bounds thereof -198.13 feet to ,& point in the northerly bounds of a parcel of land containing 20.4 acres conveyed by one Maurer to Crockwell by deed dated March 22, 1956; running thence in a southwesterly direction in a straight line a distance of about 750 feet to the northeasterly corner of the City of Glens Falls; running thence in a southeasterly direction in a straight line a distance of about 1040 feet to a point where the westerly bounds of Quaker Road intersects the easterly bounds of a parcel of land containing 32 acres conveyed by one Braman to Crockwell by deed dated December 22, 1954; running from thence in a north- westerly direction along the westerly bounds of Quaker Road about 446 1445 feet to the point and place of beginning, containing 10 acres of land be the same more or less. Bearings and distances given in the above description were taken from a map made for Douglas and Margaret Crockwell by Coulter & McCormick, Land Surveyors dated October 31, 1966. Distances indicated without bearings were scaled from the Coulter & McCormack map and are considered approximate. RESOLUTION OF THE TOWN OF QUEENSBURY :AUTHORIZING THE ACQUISITION OF LAND FOR TOWN LANDFILL PURPOSES, APPROPRIATING $LI0200 TO FINANCE THE COST OF SAID LAND, AND AUTHORIZING THE COST OF SAID LAND, AND AUTHORIZING THE ISSUANCE OF SERIAL BONDS OF THE TOWN OF QUEENSBURY IN THE PRINCIPAL AMOUNT OF $199200 TO FINANCE SAID APPROPRIATION. WHEREAS; Section 64(2) of the Town Law authorizes the Town Board to acquire real property for town functions, and WHEREAS, the Town Board has determined that it would be in the best interests of the residents of the Town of Queensbury to acquire lands located in said town and more particularly described in EXHIBIT "A" attached hereto and made a part hereof, and WHEREAS, the owners of said land have agreed to convey said land to the Town for the sum of NINETEEN THOUSAND TWO HUNDRED DOLLARS ($19,200.00) , and 447 WHEREAS, said Town Board deems said price to be reasonable in the circumstances, now therefOrS, be it RESOLVED: Section 1. The acquisition for refuse dumping purposed of the residents of the Town of Queensbury, of certain lands in said Town of Queensbury, County of Warren and State of New York known and described in EXHIBIT "A" attached hereto and made a part hereof is hereby authorized. The maximum cost of said specific object or purpose is $19,200.00 which is hereby appropriated, the same to be financed by the ins-suance of serial bonds of said Town in the principal amount of $19,200.00 and the levy of a tax upon all the taxable real property in said Town to pay the principal of said bonds and the interest thereon, as the same shall become due. Section 2. Serial -bonds of the Town in the principal amount of $19.,200.00 are hereby authorized to be issued pursuant to the provisions of the Local Finance Law, constituting Chapter 33-a of the Consolicated Laws of the State of New York, as amended. Section 3. The following additional matters are hereby determined and stated: (a) The period of probable usefulness of the specific object or purpose for which the bonds authorized by this resolu- tion are to be issued within the limitations of Sec. 11.00a.31(a) of said Local Finance Law, is thirty (30) years. (b) The proposed maturity of the bonds authorized by this resolution will exceed five (5) years. (c) No part of the costs of the said specific object or purpose authorized by this resolution has been -or shall be specially assessed on property specially benefited thereby. Section 4. Each of the bonds authorized by this res6- lution and any notes issued in anticipation of the sale of such bonds shall contain the recital of validity prescribed by #52.00 of said Local Finance Law and said bonds and any notes issued in anticipation thereof shall be general obligations of the Town of Queensbury, payable as to both principal and interest by general tax upon all the taxable real property within the Town without limitation as to rate or amount. The faith and credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of and interest on said bonds and any notes issued in anticipation of said bonds, and provision shall be made annually in the budgets of the Town by appropriation for (a) the amortization and redemption of the bonds and notes to mature in such year and (b) the payment of interest to be due and payable in such year. Subject to the provisions of this resolu- tion and of said Local Finance Law, and pursuant to the provisions of 30.00 relative to the authorization of the issuance of bond ant cipation notes and of f 50.00 and $s 56.00 to 60.00 of said Law, the powers .and duties of the Town Board relative to pre- scribing the terms, form and contents and as to the sale and issuance of the bonds hereby authorized and of any notes issued in anticipation of said bonds-are hereby delegated to the Town Supervisor as the chief fiscal officer of the Town. 448 Section 6. The validity of the bonds authorized by this resolution, and of any notes issued in anticipation of said bonds, may be contested only if; (a) such obligations are suthorized for any object or purpose for which the Town is not authorized to expend money, or (b) the provisions of law which should be complied with at the date of the publication of such resolution, are not substanially complied with, and an action, suit or proceeding contesting such validity, is commenced within twenty days after the date of such publication, or (c) such obligations are authorized in violation of the provisions of the constitution.
