The property is located within Commercial Intensive (CI) zoning district within the Town of Queensbury. As I understand your project, Mr. Bhatti has already begun construction of the entry canopy for the Econo Lodge motel and that the canopy is currently under a stop work order issued by the Town. A Motel is listed as an allowable use within the CI zone subject to Site Plan Review. I note, based on the Charles T. Nacy survey map dated April 24, 2010 and most recently revised on October 19, 2010, that the canopy, as constructed, does not meet the minimum setback requirements of the CI zone, as such, an Area Variance is necessary. Further, as this canopy is considered to be an expansion of the use, a revision to your existing Site Plan Review approval will be necessary as well.
