I am writing to you in response to my review of the Building Permit application associated with the above-referenced file. I have reviewed your building pen~iit application for the .180 sf deck that has akeady been constructed on your property at 45 Howard Street. My review of the plot plan submitted with your application reveals that the deck, as constructed, does not meet the minimum 25 foot side line setback of the Moderate Density Residential, (MDR) zoning district in which your property is located. As such, an Area Variance will be necessary should you wish to maintain the structure in the current configuration. However, it does appear that you have -two other options; removal of the deck or reconfiguration to bring the deck into compliance. The second option would result in a deck of approximately 3 fl. x 1S fl. which would not likely leave you with the desired result. Attached please find our Area Variance application for your convenience..
