Specifically, the Proposed lot configuration does not meet the minimum road frontagelaccess, lot width and density requirements for all lots per the Town of Qneensbury Zoning Code, These deficiencies in your design necessitate the need for the referenced Area Variances. Additionally, it appears as though there may be development planned within 50 feet of areas of slope of 15% or more. This item alone requires Site plan Review at the time of the development for each lot. This additional, future, review may be avoided if such details are addressed during the subdivision review .process. Please note, however,. that doing so will create specific building areas, grading and conditions that will need to be maintained when the lots are developed. Chapter 277 of New York State Town Law requires a Toning Board to seek a recommendation from the Planning Board for any variance associated with .the desig,o%reation of a subdivision before the Zoning Board can act on the variance request. The parent parcel encompasses 14.67 acres and has a single family residence on its southern portion. It is proposed to retain this residence on Lot 1 and to create three new building lots over the northerly portion of the parcel. The proposed subdivision requires several variances, which are summarized on Sheet S2. Specifically the project is seeking relief from density (due to steep slopes), lot width, road frontage and lot area for Lot 1. A concurrent submission is being made to the Planning Board and we are hopeful to receive their positive recommendation and negative SEQRA declaration at one of the June 2011 meetings so that the application can be reviewed by the ZBA. Neither an undesirable change in the character of the neighborhood nor detriments to nearby properties will be created by the granting of the requested Area Variances. The three proposed new residences wilt be located well away from Glen Lake Road in a forested setting and will be substantially screened from the road and nearby properties. The three proposed new building lots meet both the required property line setbacks and lot size for the RR-3A zone, making them consistent with other properties in the neighborhood. 2. The benefit sought by the applicant cannot be met by the applicant without pursuing the area variances. The parcel is unable to be subdivided even into three lots without receiving area variances, as there is not enough road frontage to meet the 400 feet requirement for each lot. As there are three excellent building areas over the northerly portion of the parcel, it is the applicant's desire to create these three new building lots, which will share a common driveway. 3. The Area Variance requests could be viewed as substantial with respect to the number of requests and the percentages of relief requested. However, the proposed new building lots create a largely invisible, rural subdivision which utilizes a shared private driveway. 4. The proposed Area Variances will not have an adverse impact upon the physical or environmental conditions in the neighborhood. The three proposed building lots will retain the vast majority of the mature forest and the structures will be largely invisible from the road and neighboring properties. Stormwater management practices are provided, and Erosion and Sediment Control practices are provided in accordance with NYSDEC requirements. 5. The difficulty is self-created in that it is the applicant's desire to undertake the project. In order to create a subdivision layout which is consistent with the neighborhood and achieves the desires of the applicant, the requested Area Variances are necessary.
