I am writing to you in response to my review Qf your plans for a storage building that
were submitted to this office yesterday during ,~~ conversation you had with Keith Oborne
of my office.
I have reviewed your plans and find: that both an Area Variance and Site Plan Review are
required for your project. Specifically, your proposed structure does not meet the
minimum side setbacks of the. Heavy Industrial, (HI) zoning district; as such a variance is
necessary. Site Plan Review is required as any such accessory structure associated with a
commercial venture requires such review.
I understand that you and/or your agents are in the process of preparing the necessary

Please be advised that our firm represents Jerry Brown Auto Parts with regard to the enclosed Area Variance
Application. Last Fall, Jerry Brown Auto Parts appeared before the ZBA with regard to a proposed metal
storage building that required side yard setback relief. During the reviewof that matter, the Applicant chose
to withdraw the application so that other alternatives could be evaluated. Since that time, the principals of the
Applicant purchased the adjacent neighboring property, specifically tax map parce1303.19-1-48, which is the
only parcel which would be affected by the project. The purchasing entity was SBLP II, LLC, who is owned
by Larry Brown and Steve Brown.
Due to the change in circumstances, the Applicant is now seeking to construct a 1,440 square foot building
which would be 12 feet in height and located 4.Sfeet from the side setbacks. The concrete pad that the building
will be built upon will sit 2 feet from the property line. Since the Applicant has purchased this adjacent parcel,
it feels that the balancing test that the Board will apply to review this variance should now weigh in favor of
granting the variance. In addition, with the construction of this building, materials that are currently being
stored outdoors can be covered which will help with the Applicant's operations.

AREA VARIANCE APPLICATION
REVIEW PROCESS
1) Required Pre-Submission meeting with staff to determine general completeness to be held no later
than 1 week prior to deadline dav. Call (518) 761-8238 for appointment.
2) Submittal of complete application: 7 original & 74 copies of the application package by monthly
deadline.
3) Determination of application completeness. All necessary information must be provided and appropriate
fee(s) paid for consideration for placement on an agenda for that month.
4) Incomplete applications will not be considered for placement on anv agenda until all missing information
has been supplied.
5) Submittal to the Warren County Planning Board, if applicable.
6) Zoning Board meeting, generaly the third and fourth Wednesday of each month. You will be advised in
writing as to which meeting to attend.
7) Following the meeting, you will be provided with a copy of the resolution stating the Board's decision on
your application. If your application was approved, the next likely step is a Building Permit. Final
plans/drawings must be provided for the next phase of review. If your application was denied your
project cannot proceed as submitted.

Whether an undesirable change will be produced in the character of the neighborhood or a detriment to
nearby property will be created by the granting of this area variance?
No. After having discussions with the ZBA the Application made an offer
and closed on the immediately adjacent property so that there would not be
an impact on the setback of the structure.
2. Whether the benefit sought by the applicant can be achieved by some method, feasible for the applicant to
pursue, other than an area variance?
The placement of the proposed building will assist with the efficiency
of the business. In addition, this building will be replacing an outdoor
storage area that is currently in place.
3. Whether the requested area variance is substantial?
Although this may be deemed a substantial request, the Applicant has
purchased the property effected and eliminated the impacts that may
e cause y is variance.
4. Whether the proposed variance will have an adverse effect or impact on the physical or environmental
conditions in the neighborhood or district?
No adverse impact on either the physical or environmental conditions. This
variance will allow materials that are currently stored outdoors to be
covered. In addition, this building is not visible to the public.

Although it may be deemed a self-created difficulty, because the applicant
has purchased the most effected land any self-created difficulty has been
