I am writing to you in response to my review of your plans depicting the proposed
construction of a building addition and associated site improvements at the property
referenced above.
Upon review of the plans submitted to this office, I find that both an Area Variance and Site
Plan Review will be necessary in order for you to construct the addition and site
improvements that you desire. Specifically, a variance is needed as the proposed placement
of your addition which does not meet the minimum setback requirements of the Commercial
Intensive (CI) district or the setback requirement of the Travel Corridor Overlay (TCO) for
Route 9. Site Plan Review is necessary for the expansion of the use aad for any proposed site
improvements.

Martha's Dandee Creme is proposing to construct two small .building additions to their existing
building to facilitate their operations. The existing building does not meet the existing front
setback of 75 feet in the HC-I zone and, although the additions do not increase the existing non-
conformity, it is our understanding that an area variance will be required.

Please be advised that our firm represents Lafontaine's Ice Cream and Grill, LLC, the tenant
which operates Martha's Dandee Cream, hereafter referred to as the Applicant. The Applicant is
seeking certain variances which will allow the Applicant to make some small but very much
needed modifications to the structure. The Applicant is seeking to expand the structure so that it
can add an additional service window and expand its prep area. The total additional building
area is only 440 square feet. The Applicant feels that these changes will allow the business to
become more efficient. Due to the fact that the business is seasonal the Applicant is anticipating
being able to make these changes over the winter so that it will be completed when the business
opens in March.
Due to the fact that this is apre-existing nonconforming structure, any changes that are deemed
an expansion require a variance due to its location in the front setbacks. As a result, the requests
for this proposal includes the following (1)expansion of anon-conforming structure (2) front
setback relief and (3) a variance from the travel corridor. Although there are more than one
variance being sought, due to the fact that any request would require a variance, this should not
be deemed a substantial request.
Please place this on your November agenda for the first available meeting. I have enclosed the

AREA VARIANCE APPLICATION
REVIEW PROCESS
1) Required Pre-Submission meeting with staff to determine general completeness to be held no later
than 1 week prior to deadline dav. Call (518) 761-8238 for appointment.
2) Submittal of complete application: 1 original & 74 copies of the application package by monthly
deadline.
3) Determination of application completeness. All necessary information must be provided and appropriate
fee(s) paid for consideration for placement on an agenda for that month.
4) Incomplete applications will not be considered for placement on anv agenda until all missing information
has been supplied.
5) Submittal to the Warren County Planning Board, if applicable.
6) Zoning Board meeting, generally the third and fourth Wednesday of each month. You will be advised in
writing as to which meeting to attend.
7) Following the meeting, you will be provided with a copy of the resolution stating the Board's decision on
your application. If your application was approved, the next likely step is a Building Permit. Final
plans/drawings must be provided for the next phase of review. If your application was denied your
project cannot proceed as submitted.

part by deed made by Carlton Freiberger and Martha Freiberger,

Office on April 9, 1982 in Liber 645 of Deeds at Page 757.
Subject to a Boundary Line Agreement between Carlton
Freiberger and Martha Freiberger with Paul Lukaris dated June 19,
1959 and recorded in the Warren County Clerk's Office on June 24,
2959 in Book 3B7 of Deeds at Page 522.
Further subject to covenants or agreements regarding the
erection of signs or billboards contained in the following deeds
recorded in the Warren County Clerk's Office:

Deed dated May 14, 1996 and recorded May 24,
