It is my opinion that the Notice of Appeal filed by Salvador does, in fact, act to stay or hold off any decision making by either the Planning Board or Zoning Board of Appeals on the West matter until the Salvador Appeal has been decided. As it is a requirement of the Zoning Board of Appeals for all variance applications before the Boazd to be accompanied by a stamped, signed survey map then it would appeaz as though such a map is lacking and is needed in the West matter. Please note that the applicant presented the same map with a previously approved application. Further, the applicant has the option of seeking a survey waiver from the Chairman of the Boazd, however, our records do not indicate any such request having been filed to date.
