S 18-761-820 I I am writing to you in response to my review of your proposed fieestanding signage at your 1048 State Route 9 location in Queensbury and to document the recent conversation between your agent; Stefanie Bitter and Keith Obome of my office. Upon review of the updated plans submitted to this office I find .that a Sign Variance will be naGessary for your proposed signage. Specifically, the proposed sign does not meet the minimum front setback requirement or the maximum size requirement of the current sign code; Chapter 140. I understand that your agent is preparing the necessary Sign Variance application. Please note our established submittal deadlines when compiling your application materials. Should you have any questions regarding the above comments, please do not hesitate to contact this office. Sincerely, To of Queensbury Craig Brown Zoning Administrator CB/sh Cc: Stefanie Bitter, Esq. BARTLETT Retired ELISABETH B. MAHONEY JOHN D. WRIGHT JESSICA HUGABONE VINSON BRIAN C. BORIE ROBERT S. STEWART 1932-2001 BERTRAM J. RUBE 1916-1999 As you are aware our firm represents GAM of the Adirondacks LLC with regard to the Sign Variance that was approved on January 16, 2011. Our office was not involved in the inital application and became involved after they were before the Zoning Board of Appeals. After receiving the approval to modify the existing freestanding sign, we were gathering the final documents to file with the Town of Queensbury. At that time it was discovered that the sign's setbacks were incorrectly identified as 8 feet. In actuality the setbacks are 3.8. It is not clear how this mistake was made, we believe it may have had something to do with the fact that a sign has been in this location for sometime, however the road has been widened over the years. As a result of this mistake we are returning to the Board to request a modification of Sign Variance 62-2010 which recoginizes the setback of the existing sign as being 3.8 feet. In addition, because of the change in the Sign Code in December, since this is within 15 feet of the property line we also need relief for the proposed sign of approximately 50 square feet since it exceeds the 45 square foot limit. We have enclosed the survey, sign elevations, sign variance application and fee. If you have any questions, please contact me or Stefanie DiLallo Bitter.
