Staff Notes May 18 2011 SV 25-11_TCT Federal CU Town of Queensbury Zoning Board of Appeals Community Development Department Staff Notes Sign Variance No.: 25-2011 Project Applicant: Judy Frolish, Saratoga Sign Pro’s Inc. for TCT Federal Credit Union Project Location: 9 Hunterbrook Lane Meeting Date: May 18, 2011 Description of Proposed Project: Applicant proposes to remove existing freestanding sign and install a new 27 square foot, 8 ft. 4 in. tall internally lit freestanding sign in approved location. Relief Required: Parcel will require sign variances as follows:  Height relief-Request for 2 feet 4 inches of relief from the 6 foot maximum allowable height for freestanding signs in the Office Zone. Criteria for considering a Sign Variance according to Chapter 140: In making a determination, the board shall consider: 1. Whether an undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties will be created by the granting of this sign variance. Minor impacts to the neighborhood may be anticipated. 2. Whether the benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than a sign variance. The applicant could design a compliant sign in regards to height. 3. Whether the requested sign variance is substantial. The request for 2 feet 4 inches or 38% relief from the 6 foot maximum height requirements for the O-Zone may be considered moderate relative to the ordinance. Note: The determination of whether the requested area variance is substantial is based on an empirical calculation and not subjective reasoning. 4. Whether the proposed variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. Minor impacts on the physical or environmental conditions in the neighborhood are anticipated. 5. Whether the alleged difficulty was self created . The difficulty could be considered self created.
