During the original subdivision discussions during the final stage of Sub 4-2003, it was determined that the section of lot 1 on the west side of the subdivision road would be deed restricted for no further subdivision but the portion of lot 1 on the east side of the road could be considered for further subdivision after installation of the stormwater drainage system and re-evaluation of the soils on the east side of lot 1. The subdivision stormwater infrastructure has been completed since the fall of 2007. The request before you is to subdivide Lot 1 into 4 new residential lots on the east side of the subdivision road and a large deed restricted lot on the west side of the subdivision road. The 4 new residential lots are proposed to be 0.7 acres, 0.7 acres, 0.7 acres and 1.2 acres respectively with the remaining lot to be 25.78 acres. We are requesting a variance for the new residential lots less than 2 acres in an MDR zone. We are also requesting 10 ft of relief from the 25 ft side setbacks (15ft side setbacks proposed) and 5 ft of relief from the 30 ft rear setbacks (25 ft rear setback proposed) for each of the new residential lots. We have reevaluated the soils for each of the proposed lots and have designed the wastewater systems and the basements accordingly. The proposed area of disturbance will require several feet of fill to raise the lots above the existing subdivision road and for the installation of the basements and wastewater systems.
