Harwood Beaty Councilman Theodore Turner Councilman Curtis Lampson Councilman t Hammond Robertson, Jr. Councilman The meeting was called to order at 7:30 p. m. The following visitors were present: Bernard J. Codner -- Superintendent of Highways Daniel Bennett - Application for Mobile Home The minutes of the meeting of April 21, 1966 were approved., Carried unanimously. The clerk presented applications for permits to locate Mobile Homes outside of a duly licensed Mobile Home Court, The applicants listed are Mr. Daniel Bennett and Mr. Kenneth G. Bennett., Supervisor Webster discussed the recent opinion of Attorney Albert E. Beswick on the question of land owners selling lots in a sub- division on a contract base. RESOLUTION TO AUTHORIZE EXPENDUTIRE FOR AND EXECUTION OF DOCUMENTS FOR ROUTE 9 WATER DISTRICT RESOLUTION NO. 99, Introduced by Mr. Turner, seconded by Mr. Lampson. RESOLVED, that the Supervisor is hereby authorized and directed to pay the sum of $2.50 to the State of New York, as a fee for a highway permit, for work in the proposed Route 9 Water District, said sum to be paid from the General Fund to be repaid if and when the organization of the Route 9 .Water District, is completed and district funds are available, and be it further RESOLVED, that the Supervisor ins hereby authorized and directed to execute a highway work permit application to the State of New York on behalf of the proposed Route 9 Water District. Duly adopted by the following vote: Ayes - Mr. Beaty, Mr. Turner, Mr. Lampson, Mr. Robertson and Mr. Webster. Noes - None RESOLUTION TO AUTHORIZE PUBLIC HEARING s RESOLUTION NO. 100, Introduced by Mr. Robertson, seconded by Mr. Beaty. WHEREAS, Daniel Bennett oif .R,.F.D. 43 New Hamp$hire Avenue, has made application in accordance with paragraph 2 (c) , Section 4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside _ of a duly licensed mobile home court at property situated Block 1 - Lots 15 - 16 - r17 Pinella Road, Hartman Development, and WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance, and 1 (Resolution No. 100 - continued) WHEREAS,ait is hereby determined that the facts presented in said application are sufficient to justify further consideration by this board, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, the town board shall conduct a public hearing on said application on May 12, 1966, at 7:30 p.m. in the library of Queensbury Junior High School, Aviation Road, and that the Town , Clerk is-hereby authorized and directed to give proper notice of said public hearing in accordance with the provisions of said ordinance. WHEREAS, Kenneth G. Bennett of R.F.D. #3 New Hampshire Avenue, has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBU,Y, WARREN COUNTY., NEW YORK, to locate a mobile home outside of a dAly licensed mobile kome court at property situated Block 1 Lots 12 - 13 - 14 Pinella Road., Hartman development, and WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to justify further consideration by- this board, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, the town board shall conduct a public hearing on said application on May 12, 1966, at 7:35 p.m. in the library of Queensbury Junior .High School, Aviation Road, and that the Town Clerk is hereby authorized and directed to give proper notice of said public hearing in accordance with the provisions of said ordinance. Duly adopted by the following .vote: Ayes - Mr. Beaty, Mr, Turner, Mr. Lampson, Mr. Robertson and Mr, Webster Noes None Discussion ensued at this time on the re-location of A1exy Road at Dunhams Bay. The Town Board members agreed in entirety that the re-location as proposed will no take place at this time. A plan was suggested that "NO PARKING" signs be erected on the present roadway to help eliminate the complaints of the land owners. - Mr. Thomas K. Flaherty, Superintendent of Queensbury Water bistrict visited the meeting at this time. z 412 RESOLUTION TO AUTHORIZE PERMIT FOR MOBILE HOME �v RESOLUTION NO. 102, Introduced by -Mr. Beaty, seconded by Mr., Robertson WHEREAS, James P. Webb, Jr. , of 4A New Street, South Glens Fa4s, New York, has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES and MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY., NEW YORK, to locate a . mobile home outside of a duly licensed, mobile home court. at property situated on Block #8, Lots 15 & 16 Pinella Road, Hartman Development, and WHEREAS, this town board has conducted a public hearing in connection with said application and has heard all persons desiring to be heard in favor of or -against. said applica..tionr, and WHEREAS, it is hereby determined that the facts presented in said application and at said public hearing are sufficient to authorize the issuance of the permit requested by said application, for the following reasons:'C There were no appearances of persons in objection to the granting of the permit. In the opinion of the members of the town board the property values in the area will not be adversely effected, RESOLVED, that pursuant to the provisions of the above mentioned ordinance, permission is hereby given to James P. Webb, Jr- , to Iocate a mobile home outside of a licensed mobile home court,, at property situated at Block #&, Lots #15 & #16 -Pinel-lo Road, Hartman Development and that the Town Clerk is hereby authorized and directed to issue such permit in accordance with the terms and conditions of said ordinance. Duly adopted by the following vote: Ayes - Mr. Beaty, Mr. Turner, Mr. Lampson, Mr. Robertson and Mr. Webster. Noes - None Supervisor Webster reported on a request for financial assistance from the Town of Queensbury, .for the Queensbury Post Veterans of Foreign Wars. A request for an opinion from Atty. Albert E. -Beswick will govern the decision of the town board on the matter. An application for a Junk Yard License for Nelson Harrington was presented for further study. The application with the fee of $10.00 was turned over to Supervisor Webster. C The application of Robert Lanfear for a Junk Yard License was -also turned over to Supervisor Webster, with the required fee of $10.00. RESOLUTION TO DISAPPROVE APPLICATION FOR MOBILE HOME RESOLUTION NO. 103, Introduced by Mr. Robertson, seconded by Mr. Beaty WHEREAS, Mr. & Mrs. Francis Rajkow ski of 36 North Pearl Street, Glens Falls, New York, has made application in accordance with _ paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES and MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property situated at 21 Homer Avenue, Glens Falls, New York, and (Resolution No. 103 - continued) WHEREAS, this town board has conducted a public hearing in connection with said application and has heard all persons desiring to be heard in favor of or against said application, and WHEREAS, it is hereby determined that the facts presented in said application and at said public hearing are not sufficient to authorize the issuance of the permit requested by said application, for the following reasons: Property values inn the area will be adversly effected. The location for the proposed mobile home doesnot conform with the land-use plans of the Planning Board under the "701" program, to ultimately develop zoning for the town as a whole. RESOLVED, that pursuant to the provisions of the above mentioned ordinance, the application of Mr. & Mrs. Francis Rajkowski of 36 North Pearl Street, Glens Falls, New York to locate a mobile home outside of a licensed mobile home court at property situated at 21 Romer Avenue is hereby disapproved, and that the Town Clerk is hereby directed to advise Mr. & Mrs. Francis Rajowski of the decision of this board. Duly adopted by the following vote: Ayes - Mr. Beaty, Mr. Turner, Mr. Lampson, Mr. Robertson and Mr. Webster, Noes - None RESOLUTION N0. 104, Introduced by Mr. Beaty, seconded by Mr. Turner. RESOLVED, that the Audit of Claims as listed in Abstract #66-4B numbered -#469 totaling $5,920.00 is hereby approved. Duly adopted by the following vote: Ayes - Mss.
