1966-05-05 SP 414 Special Meeting -May 5, 1966 Present: John 0. Webster Supervisor N. Harwood Beaty Councilman Theodore Turner Councilman Curtis Lampson Councilman Hammond Robertson, Jr. Councilman The Supervisor called the meeting to order, at 7:30 p. m. Supervisor Webster announced the public hearing on the --proposed Ordinance to restrict parking or standing on the southerly side of Aviation Road,open at 7:30 p.m. Proof of publication was presented by the clerk, The reading of the notice was dispensed with at this time. \ With no persons in appearance either in favoroor against, the adoption of the Ordinance, the public hearing was declared closed at 7:35 p. m. Supervisor Webster requested any statements from other members �of the 'down Board. There ,were none. The following resolution was adopted at this time, RESOLUTION TO ADOPT ORDINANCE RESOLUTION N0. 1Q5, introduced by Mr. Beaty, seconded by Mr, Turner, WHEREAS, a proposed ordinance restircting the parking or standing of vehicles on the south side of a portion of Aviation Road, Town of Queensbury, was presented to this town board for its consideration and a public hearing was held on such proposed ordinance by the Town Board on the 5th day of May, 1966, at which time no one appeared in favor of such proposed ordinance and no one appeared in opposition, be it RESOLVED that the form and contents of a proposed ordinance entitled Ordinance Relating to Parking on Aviation Road in the Town of Queens- bury", be and the same hereby is approved, and be it further RESOLVED, that it be enacted and ordained by the Town Board of the Town of Queensbury, Warren County, New York, as follows: Ordinance Relating to Parking On Aviation Road in the Town of Queensbury The Town Board of the Town of Queensbury, Warren County, New York, pursuant to Section 1660 of the Vehicle and Traffic Law of the State of New York, does hereby enact and ordain the following ordinance: Section 1. For the purpose of this ordinance, the words "vehicle", "owner","parked", and "standing" shall have the meanings defined in the Vehicle and Traffic Law of the State of New York. Section 2. No vehicle shall be parked or left standing at any time on the southerly side of the highway known and designated as Aviation Road in the Town of Queensbury between the easterly side of the junction of Cottage Hill Road with Aviation Road and the westerly side of the south bound entrance to the Northway from Aviation Road. 445 (Resolution No. 105 - continued) Section 3. A violation of this ordinance shall constitute an offense and shall- be punishable by a fine of not more than $10.00. Section 4. This ordinance shall take effect ten days after its adoption and the posting and publication thereof. Duly adopted by the following vote: Ayes - Mr. Beaty, Mr. Turner, Mr. Lampson, Mr. Robertson and Mr. Webster. Noes - None The minutes of the meeting of April 28, 1966, were approved. Carried unanimously. Mr. Paul Bishop-and-Mr. R.D. Larvow visited the meeting at this time. Supervisor Webster opened the public hearing on the application of Eugene A. Campbell for a permit to locate a Mobile Home, on Ohio Avenue, West Glens Falls, New York, at 7:45 p. m. Proof of publication was presented by the clerk. The reading of the notice was dispensed with at this time. Following a request from the Supervisor, there were no persons in appearance either for or against the granting of the permit. After discussion, the Town Board in its entirety agreed that decision on the matter should be deferred to a later date. .WARREN COUNTY MUNICIPAL CENTER Lake George, N. Y. Webster, Supervisor Re: Claim against Johanna O'Brien Enclosed is check of Safeco Insurance Group to the order of- the Town of Queensbury, New York, and Albert E., Beswidk, Attorney at Law, in the amount of $33.60 to cover your claim against Johanna O'Brien for the damage to your Water Department pick up truck on " December 21, 1965. I have endorsed the check and there is no charge on my part. This check normally would go into your General Fund as a revenue but the Town Board may adopt a resolution appropriating this $33.60 to the Queensbury Water District account from which the cost of repairs was paid. Albert E. Beswick County Attorney Mrs. Florence- Mcllvalnef,- ,representing, .the, Post Star newspaper and Mr. & Mrs Jack Dumas, applicants for a mobile home permit, were greeted a-t� .the- meeting at. .this time. Mr. Harold Rathbun was also present. RESOLUTION TO APPROPRIATE PROCEEDS FROM INSURANCE SETTLEMENT TO , EENSBURY WATER D.T,5TR.ICT RESOLUTION NO. 106, introduced by Mr. Robertson, seconded Mr. Turner. 41.6 (Resolution No. 106 - continued) RESOLVED that the Supervisor is hereby authorized and directed to deposit the proceeds from an insurance settlement, in the amount of $33160, in the Queensbury Water District account. Duly adopted by the following vote: Ayes - Mr. Beaty, Mr. Turner, Mr. Lampson, Mr. Robertson and Mr. Webster Noes - Bone A letter was received and placed on file from Mr. Joseph A. Kestner,Jr. , Engineer for the Bay Road Water District which requested fire insurance tests and inspection of the recently formed district. The public hearing on the application of Laurence H. Smith for a, permit to locate a mobile kome outside of a duly licensed mobile home court, on Upper Sherman Avenue, was opened by the Supervisor at 7:55 p.m. Proof of publication was presented by the clerk. The reading of the notice was dispensed with at this time. The clerk. summarized- the original application by reading same.. The Supervisor requested a Voice from any person in opposition to the granting of the permit. There were none. Supervisor Webster asked for a statement of any person in favor of same. There were none. The public hearing was declared closed at 7:58 p. m. r Supervisors Webster reported that the water rent collection roll for the May, 1966 billing has been received and same will be presented to the Receiver of Taxes and Assessments for collection, RESOLUTION FOR THE COLLECTION OF WATER RENTS FOR THE COLLECTION PERIOD BEGINNING MAY 1. 1966 RESOLUTION NO.. 107, introduced by Mr. Lampson, seconded by Mr. Robertson. WHEREAS, Thomas K. Duly adopted by the following vote: Ayes - Mr. Beaty, Mr. Turner, Mr. Lampson, Mr. Robertson and Mr. Webster Noes - None The clerk presented applications for Joyce Baker and William Stephenson to locate mobilehhome:s outside of a duly licensed mobile home court within the Town of Queensbury. Following lengthy explanation of the procedure, the Town Board conducted a voice of opinion as to whether or not a pay station telephone should be installed in the Town Office Building -under construction at this time. The voice vote was as follows: Ayes - Mr. Beaty, Mr. Lampson, Mr. Robertson and Mr. Webster. Noes - Mr. Turner Mr. Turner Stated that it is his opinion that the Telephone Company should install the pay phone free olf charge. The reports of New Construction for the month o Apri were received and placed on file. There were 21 reports received for the month. RESOLUTION TO AUTHORIZE PUBLIC HEARING RESOLUTION N0. 108, introduced by Mr. Robertson, seconded by Mr. Lampson WHEREAS, William Stephenson of R.F.D. #1, Lake George, New York, has made application in accordance with paragraph O2 (c) Section THE of an ordinance of the Town of Queensbury entitled REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSB URY, WARREN COUNTY, NEW YORK, to locate a mobile 'Dome outside of a duly licensed mobile home court at property situated West Side of Bay Road, North of Scotch Presbyterian Church, and WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to justify further consideration by this board, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, the town board shall conduct a public hearing oii said application on May 19, 1966 at 7:30 p.m. in the library of Queensbury Junior High School, Aviation Road, and that the Town Clerk is hereby authorized and directed to give proper notice of said public hearing in accordance with the provisions of said ordinance. Duly adopted by the following vote: Ayes - Mr. Beaty, Mr. Turner, Mr. Lampson, Mr. Robertson and Mr. Webster Noes - None 418 RESOLUTION TO AUTHORIZE PUBLIC HEARING RESOLUTION NO. 109, introduced by Mr. Robertson, seconded by Mr. Lampson. WHEREAS, Joyce Baker Perry of Massachusetts Avenue, West Glens Falls, New York, has made application in accordance with paragraph 2 (c) Section 4, .of an ordinance of the Town of Queensbury entitled ORDINANCE, FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN' dbWrY,. NEW YORK, to locate a mobile kome outside of a duly licensed mobile home court at property situated Massachusetts Avenue, next to Mrs. Olive Green, and WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to justify further consideration by this board, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, the town board shall conduct a public hearing on said application on May 19, 1966, at 7:45 p.m. in the library of Queensbury Junior High School, Aviation Road, and that the Town Clerk is hereby authorized and directed to give proper notice of said public hearing in accordance with the provisions of said ordinance. Noes None A discussion ensued at this time on the problem of re-districting the Voting Districts within the town. Plans are being layed for -- -a total of 13 Districts when the lay-out work is completed. Supervisor Webster announced the opening of Bids for construction of a storage building at the site of the Queensbury Refuse Disposal Area, 4 Proof of publication was presented by the clerk. The notice was read by Supervisor Webster. Supervisor Webster requested any comments from an person present as to the specifications. The Bids were opened and read aloud by the clerk as follows: Fisk Construction Company $29900.00 R.D. Collins 3,300.00 Supervisor Webster declared the public hearing open on the application of Mr. Jack S. Dumas, to locate a Mobile Home outside of a duly licensed Mobile Home Court. The clerk presented proof of publication. The reading of the Notice was dispensed with. The clerk summarized the original application as received. 419 Supervisor Webster requested a voice from any persons in opposition to the granting of the permit. There were none. The Supervisor invited any statements in favor of the issuance of the permit. There were none. The public hearing was declared closed with no further statements at this time. The town board in its entirety agreed that the application should be studied before the permit is granted. Action will be taken at a later date. On motion the meeting adjourned. The clerk summarized the original appilication by reading same. The Supervisor requested any statements of persons in opposition to the granting of the permit. The following persons voiced opposition; Mr. William Deuel, Mr. Frank Usher and Mr. Paul Baird. Following a request for a voice from persons in favor of the granting of the permit; Mr. Harold Rathbun voiced an opinion that he is in favor of the granting of the permit. Mr. Clifford Witham visited the meeting at this time.
