Flaherty - Superintendent of Queensbury Water District Lowell Hill - Special Policeman Mr. Lowell Hill, Special Policeman advised the Town Board, that the efforts to clean up refuse in locations where complaints have been received, is progressing in a normal manner. The minutes of the meetings of May 26th and June 2, 1966 were approved. Carried unanimously. The clerk presented applications for Mobile Home permits from the following persons: James H. Collier Under section 2B - tabled for study. Miss.Doris Supr_enant under Section ,2C - tabled ,for _study. RESOLUTION NO. 138, Introduced by Mr. Beaty, seconded by Mr. Robertson AN ORDINANCE TO LICENSE THE OPERATION OF JUNK YARDS AND TO REGULATE THE OPERATION OF JUNK YARDS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK. BE IT ORDAINED AND ENACTED by the Town Board of the Town of Queensbury, Warren County, New York, as follows: Section 1. It is hereby determined that the operation of junk yards in the vicinity of dwellings, buildings and wooded areas, including but not limited to the burning of inflammable parts of automobiles, paper and other waste materials constitutes a public nuisance, a constant fire menace and a danger to the public health, safety and welfare of the residents of the Town of Queensbury and that the unrestrained accumulation of junk motor vehicles is a hazard to such health, safety and welfare of the residents of the Town of Queensbury and creates and environment which tends to discourage sound continued development of the economy of the Town" of Queensbury and is against the public interest. Section 2. For the purposes of this ordinance, the term "Junk yard" shall mean any place of storage or deposit, whether in connection with another business or not, where two or more un- registered, old or secondhand motor vehicles, no longer intended or in condition for legal use on the public highways, are held, whether for the purpose of resale of used parts therefrom, for the purpose of reclaiming for use some or all of the materials therein, whether metal, glass, fabric or otherwise, for the purpose of dis- posing of the same or for any other purpose; such term shall in- clude any place of storage or deposit for any such purpose of used parts or waste materials from motor vehicles which,- taken together, equal in bulk two or more such vehicles, and shall also include operations performed and carried on, wholly or in part, outside of a fully enclosed building or structure, for the acquisition, pur- chase, storage, conversion, dismantling, processing or resale of all types of used machinery, applicances, equipment, metals, rags, paper, fabrics, rubber and any of their combinations. "Motor vehiclesa shall mean all vehicles propelled or drawn by power other than muscular power and originally intended for use on public high- ways. "Person" shall include a natural person, corporation, firm, partnership -or association of persons. Section 3. No junk yard shall be established or operated within one hundred feet of the boundary line of any public highway, street, avenue or place in the Town of Queensbury nor within three —" hundred feet of a dwelling, school, church or other building. Section 4. Every junk yard established and operated shall have the entire area of lands used in any manner in connection with such junk yard enclosed within a tight board or sheet metal fence not less than eight feet in height, and such fence shall be painted either green or another color which will fairly blend with the surroundings. 3 No advertising matter of any kind shall be attached to or painted on any fence enclosing a junk yard. Section 5. Vehicles or other waste material within a licensed junk yard shall not be piled or stacked to a height where the same shall be visible over the top of the fence. Section 6. No burning of waste material shall be done in a licensed junk yard unless a permit for such burning shall have been issued by the Conservation Department of the State of New York. Section 7. No person shall operate, establish or maintain a junk yard until he has obtained a license to operate a junk yard business and has obtained a certificate of approval for the loca- tion of such junk yard. No junk yard license shall be issued and granted for a junk yard hereafter established until and unless the Town Planning Board shall have granted and issued a written certi- ficate of"approval of the location of the proposed link yard. An application for a license to establish, maintain and operate a junk yard shall be made in writing to the Town Board and shall specify the name, age, occupation and the residence address of the appli- cant, the location of the proposed junk yard and a description of the land to be included in the junk yard. If the applicant is not the owner of the land upon which it is proposed to establish a junk. yard, a copy of the lease under which the applicant is in possession or is entitled to be in possession of the land shall be presented with the application. The written application shall be filed with the Town Clerk and the amount of the license fee and' the cost of advertising the public hearing paid to the Town Clerk, accompanied by the certificate of approval of location by the Town Planning Board. The Town Board shall hold a public hearing on the appli- cation within thirty days from the date of the filing of the appli- cation. Notice of such public hearing shall be given by publication thereof once in the official. newspaper of the town and the posting thereof on the bulletin board at the Town Clerk' s office, both at least ten days prior to the date of hearing stated in such notice. After such public hearing, the Town Board, may, by majority vote of its membership , adopt a resolution approving the applica- tion and authorizing the Town Clerk to issue a license. If the Town Board shall, after such public hearing, disapprove the appli- cation, the license fee to the Town Clerk with the application shall be refunded. All junk yards heretofore established in the Town of Queensbury and for which a license has heretofore been ,approved by the Town Board under the former town ordinance relat- ing to junk yards shall be deemed to have been approved as to location and no further certificate of approval by the Town Plan- ning Board shall be required as to such junk yards in existence and licensed on the effective date of this ordinance, but all other provisions of this ordinance shall apply to existing junk yards licensed under the former town ordinance. Section 8. The annual license fee for a junk yard in the Town of Queensbury shall -be Twenty-five ($25.00) Dollars and each junk yard license shall be for the period of one year from the - date of its issuance. A junk yard license shall be personal to the license and shall not be assigned or transferred but in case of the death of a licensee, the junk yard may be operated for the balance of the license year by- his executor or administrator. Section 9. The operation of a junk yard in the Town of (?ueensbury without a license therefor issued by the Town Clerk pursuant to resolution adopted by the Town Board of the Town of Queen.sbury shall. constitute a misdemeanor and any person convicted 454 of a violation of this ordinance shall be subject to a fine not exceeding $100.00 or to ,imprisonment in the county jail for a term not exceeding six months or both by fine and imprisonment. Upon failure of any person so convicted and fined to pay the fine, such person shall be imprisoned in the county jail for a term equal to one day for each dollar of the fine imposed unless sooner paid. Each day of operation of an unlicensed junk yard shall. constitute a separate offense. In addition to the .foregoing penalties, the Town Board of the Town of Queen.sbury may bring an action in a court of competent jurisdiction to compel the holder of a junk yard license to comply with the provisions of this a ordinance and may by resolution refuse to renew a junk yard license if the holder thereof shall refuse or fail to comply with the provisions of this ordinance. Section 10. If any courtof competent jurisdiction shall adjudge and determine that some portion or provisions of this ordinance are invalid, such judgment shall not affect the validity of the remaining portion or provisions of this ordinance. Law regulating automobile junk yards in towns �4hich ru,ie no town ordinance to regulate such junk yards, and the Town Board has considered the repeal of the present ordinance and the adoption of a new junk yard ordinance which will, conform to Section 136 of the General Municipal Law but which will contain certain additional provisions and provide penalties for the violation thereof, and WHEREAS, the Town Board has held a public hearing on the proposed new junk yard ordinance and on the proposal to repeal the exist- ing junk yard ordinance, and there was no substantial opposition to either proposal, be it RESOLVED, that upon the adoption of the new ordinance entitled "An Ordinance To License The Operation of Junk Yards And To Regulate The Operation of Junk Yards In The Town of Queensbury, Warren County, New°York" and upon its becoming effective by pub- lishing and posting thereof as required by the Town Law, the said �� ordinance entitled Ordinance Relating to Operation of Junk Yards In The Town of QueenSbury, Warren County, New York" which was adopted by the Town Board of the said Town of Queensbury on or about the 21st day of December, 1957, be and- the same hereby is — repealed and rescinded in its entirety. RESOLUTION TO ACCEPT A DEED FOR TOWN HIGHWAYS RESOLUTION NO. 140, Introduced by Mr. Robertson, seconded by Mr. Beaty. WHEREAS, Edmund C. Twichell of 1130 Somerset Lane, Newport Beach, California, and Goss B. Twichell of 329 Ihrig Avenue, Wooster, Ohio, Proctor C. Twichell of Highwood Avenue, Ridgewood, New Jersey, and Vera C. Twichell of the Town of Queensbury, all by their attorney in fact, Edmund C. Twichell, have executed and offered a deed to convey to the Town of Queensbury all of the streets and roads in the Twic- wood Subdivision as shown on the map of said subdivision dated 5/18/196 by John B. VanDusen, and approved by the Queensbury Planning Board on 7/7/1965, including a quit claim deed to a 50 foot roadway shown as Montray Place on said map, all of said roads being at least 50 feet in width together with circles and/or turn-arounds, and WHEREAS, this subdivision has been approved by the -Town Planning Board, and WHEREAS, Bernard J. Codner, Superintendent of Highways, has advised this board that he recommends the acceptance of these streets into the town highway system, and WHEREAS, Thomas K. Flaherty, Superintendent of Queensbury Water Department, has advised this board that the water mains have been installed completely, with hydrants, acceptable to the water department, and WHEREAS, said map shows Montray Place and Twicwood Lane as separate sections of what will be'one continuous roadway and it is deemed advisable by this board to consider the entire roadway as Twicwood Lane. RESOLVED, that subject to the approval of County Attorney, Albert E. Superintendent of Highways, Bernard J. Codner recommended that every effort be made to arrive at a satisfactory solution to the porblem of long standing. RESOLUTION TO AUTHORIZE PUBLIC HEARING ' RESOLUTION NO. 141, introduced by Mr. Turner, seconded by Mr. Lampson. WHEREAS, Ida Mae Sprague of Box 368, Lake George, New York has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE 'HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property situated Leo Street, West Glens Falls, New York, and WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to justify further consideration by this board, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, the town board shall conduct a public hearing on said application on June 23, 1966, at 7:30 p.m. in the library of Queensbury Junior High School, Aviation Road, and that the Town Clerk is hereby authorized and directed to give proper notice of said public hearing in accordance with the provisions of said ordinance. Noes - None Councilman Robertson suggested serious consideration of developing a town refuse disposal system as a result of complaints of burning. Supervisor Webster suggested the developing of an ordinance to prohibit. furning of garbage in barrels on private property with- in the town. Supervisor Webster discussed the problem as advanced by a resident of the town at the meeting of June 2, 1966. The complaint stated that young people were abusing his property by riding horses in the neighborhood of his 'home. It was the voiced opinion of the Town Board that the matter should constitute a civil action on the part of the complainant. Supervisor Webster discussed the status of the re-aligning of the highway known as Pinecrest Drive. Agreement -was reached with members of the Town Board deciding that the matter should be settled through court action with the assistance of County Attorney Albert ,E. Discussion ensued on the application of Mrs. .Joyce Perry to locate a mobile home on Massachusets Avenue, West Glens Fads, New York.
