The meeting was called to order by Supervisor Webster at 7:30 p.m.

June 16, 1.966 whereby the Board expresses its complete support
to our company in its application to the Public Service Commission
for a franchise to operate through the Town of Queensbury enroute
from Glens Falls to Albany.

Re: Route 9 Water District
Your Town Board recently established the Route 9 Water
District under the procedures provided by Article 12-A. of the Town
Law involving a map , plan and report.
The plan and report prepa.r_ed by .Joseph A. Kestner, the
engineer, estimated the maximum cost of the establishment of Route
9 Water District and the construction of the improvements therein
in accordance with the Plan to be $362500.00. The State Comp-
troller and Water Resources Commission have approved the estab-
lishment of the Route 9 Water District and the construction of the
improvements on the basis of the estimated maximum cost specified
in the report.

Your Town Board has received sealed bids for the construction
of the proposed improvements, plus some additional work not comtemplated
• by- the.plan and report, and the lowest bid is in excess of the estimated
maximum cost specified in the report and you have asked my opinion as
to your procedure under these circumstances.

Section 209-h of the Town Law provides that the maximum
amount proposed to be. expepded for an improvement in a district may
be--`increased by an order of the town board provided the town board has
held a-public hearing on the increase and provided the Comptroller
shall have made prior to the public hearing an order approving the
increase of the maximum amount.- The order of the town board increasing
the maximim shall be, subject to permission referendum.
As I understand it, the specifications which went io bidders
included work not included in the original plan and report. This
apparently came about because it was learned that the Department of
Public Works proposesto widen Route 9 through this district and the
Town Board, on the recommendation of the engineer, have provided for
mains under Route 9 and for hydrants on both sides of Route 9. I may
not be completely accurate in my statement of the additional work
but' in any event your bids in excess of the authorized maximum amount
include work not in the original plan.
Subdivision 2 of Section 209-h provides that if the notice of
public hearing for the establishment of the district proposes only the
performance or supplying of certain service and states the maximum
amount to be expended annually for ,such services, the maximum amount
to be expended annually may be increased by order of the ^town board
after public hearing but the approval of -the Comptroller to increase
the amount to be expended annually shall not be required.
It seems clear tome that qubdivision 2 of Section 209-h has
no application to your problem and it is my opinion that your Town
Board will have to make a new application to the Comptroller for
approval of the increased amount and if he approves, you then must
hold a public hearing and adopt an order subject to .permissive
referendum.
It is my opinion that your Town Board will also have to make
a newapplication to Water Resources Commission for approval of the
additional work and additional expense.

Discussion ensued on pending Mobile Home applications to locate
Mobile Homes in the Town of Queensbu3ry. `
Mrs. Florence Mellvaine of the Post Star visited the meeting at this
time.
Councilman Robertson spoke on the disposition of the pending
application of Mrs. Norma Washburn, to locate a Mobile Home on Maine
Avenue, West Glens Falls, New York. Mr. Robertson voiced opposition
to the granting of the permit due to the size of the lot where the
mobile home would be located.
Discussion took place on the extension of the main feeding to the
Broadacres Drainage System at Griffin Place. General agreement was
retched that the improvement should be done. The cost of the improve-
ment will be budgeted in the 1967 budget and at that time the general
Town Fund will be reimbursed for the sum of money involved. The
original cost will be paid from the General Town Futdd.

RESOLUTION TO AUTHORIZE LEASE AGREEMENTS
RESOLUTION NO. 163, Introduced by Mr. Beaty, seconded by Mr. Turner.
RESOLVED, that the lease agreements recommended by the Recreation
Commission for summer playgrounds between Mohican Grange and the
Town of Queensbury; Frank Serge and the Town of Queensbury; and
West Glens Falls Volunteer Fire Company, Inc. , and the Town of,
Queensbury are hereby approved and that the Supervisor is hereby
authorized to execute said agreements on behalf of the Town.

RESOLUTION TO AUTHORIZE APPROPRIATION
RESOLUTION N0, 164, Introduced by Mr. Robertson, seconded by

WHEREAS this Board has authorized the appointment of a Committee
known as "Queensbury Committee for Community Beautification" and .
WHEREAS, it seems adviseable to- provide for a small appropriation
to cover expenses of said committee, therefore be it
'RESOLVED, that the sum of $300.00 be and the same is hereby
transferred from contingent funds to an appropriation for expenses
of the "Queensbury Committee for Community Beautification".
