Harwood Beaty Councilman Theodore Turner Councilman Curtis Lampson Councilman Hammond Robertson, Jr. Councilman The meeting was called to order at 7:30 p. m. Supervisor Webster greeted the following visitors: Juliette Ellingsworth - League of Women Voters Thomas K. Flaherty - Superintendent of Queensbury Water District Bernard J. Codner - Superintendent of Highways Mrs. Bernard Codner & Dianne - Visitors Mr. & Mrs Theodore Clark- - Mobile Home Application LeRoy LaCross - Visitor George W. Clark - Visitor Bernard Zovistoski - Reporter, The Post Star Herbert Corlew - Deputy Highway Superintendent The public hearing was declared open at 7:30 p.m. on the application of Mr. & Mrs. Theodore Clark to locate a mobile home outside of a duly licensed Mobile Home Court. Proof of publication was presented by the clerk. Reading of the Notice was dispensed with at this time. The application of Mr. & Mrs. Theodore Clark was read by the clerk. The following persons appeared in opposition to the granting of the permit. None The following persons spoke in favor of the granting of the permit. None With no further questions or discussion the public hearing was .declared closed at 7:45 p. m. The applicants were assured that favorable action on granting the permit would take place at a later time in this meeting. Councilman Turner moved that the Town Board should recess to an executive session at 7:50 p.m. , seconded by Councilman Robertson. Carried unanimously. The meeting was re-called .to order at 8:05 p.m. The minutes of the meeting of July 15, 1965 were approved. Carried unanimously. The Clerk presented Mobile Home applications of Bessie &"Raymond Morris- William Ernest Mattison and James A. Cruickshank for action by the Town Board. The following visitors were greeted by the Town Board, to discuss requests as presented at a Regular Meeting on July 8, 1965 in the interest of the fact that an employee of the Highway Department of the Town of Queensbury has been discharged. Sherman - Local 1046 Loren Chatterton - Local 1046 Grant Kenyon - Local 1046 Felix Burch - Local 1046 Ralph Hitchcock - Local 1046 Lawrence Warrington - Local 1046 John Saville - Local 1046 Paul Bentley - Local 1046 136 Mr. De Deo the Representative of Local Union 1046 was granted the floor. The request was made by Mr. De Deo and the group of visitors to secure an answer to the request of July 8th, for a decision on the matter. Salary for vacation time pay has been requested for an employee of the Highway Department who has been relieved. of his duties. Supervisor Webster discussed the opinions of the Town Attorney, Albert E. Beswick as to whether or not their is basis for arbitration in the matter. Attorney Beswick has stated that no arbitration is necessary in the matter. A question as to the two weeks vacation salary was settled by a statement from Supervisor Webster, that the recently dischkaged employee will receive his two weeks vacation pay which is due him. __.. Dr. E. M. Moore was granted the floor. The objection of Dr. Moore was to do with the town board allowing fireworks display at either of the shopping centers along Route 9. Bupervisor Webster discussed the handling of the granting of the permits. The fact that the local volunteer fire companies are advised when any fireworks displays, take place was voiced by the Supervisor. RESOLUTION TO AUTHORIZE PUBLIC HEARING RESOLUTION NO. 170,,- introduced by Mr. Turner, seconded by Mr. Robertson. WHEREAS, Bessie & Raymond Morris of Upper Sherman Avenue, Leo Street, Glens Falls, New York, has made application in accordance with paragraph 2 (c) , Section 4, of an ordinance of the Town of .Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, TO locate a mobile home outside of a duly licensed mobile court at property situated Leo Street off Sherman Avenue, Lot next to Maurice Paddock, and WHEREAS, it is hereby determined that -said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to justify further consideration by this board, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, the town board shall conduct a public hearing on said application on August •5, 1965, at 7:30 p.m. in the library of . Queensbury Junior High School, Aviation Road, and that the Town Clerk is "hereby authorized and directed to give proper notice of said public hearing in accordance with the provisions of said ordinance. WHEREAS, Mr. :& Mrs. Theodore Clark of R.F.D. #2 West Mountain Road, has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES and MOBILE HOME COURTS IN ,IHE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property situated on Luzerne Road near Van Dusen Road, and WHEREAS, this town board ,has conducted a public hearing in connection with said application and has, heard all persons desiring to be heard in favor of or against said application, and WHE?XAS, it ,is .hereby depermined that the ..facts presented in said application and at said public hearing are sufficient to authorize the issuance of the permit requested by said application, for the following reasons: Therg were no ,persons .in appearance in opposition to-�tbte .granting .o f. the permit. It is the. opinion of the town board that property values in the area will not be adversly effected, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, permission is hereby given to Mr. & Mrs. Theodore Clark of R.F.D. #2 West Mountain Road,. to locate a mobile home outside of a licensed mobile home court, at property situated at Luzerne Road near VanDusen -Road,, and that the Town Clerk is hereby authorized and directed to - issue such permit in accordance with the terms and conditions of said ordinance. Noes - None RESOLUTION NO. 172, Mr. Robertson introduced the following resolution and moved its adoption, seconded by Mr. Beaty. Whereas, Adirondack Transit -Lines, Inc. 'as successor to Hudson Transportation Corporation, holds a certificate of public convetnience and necessity issued by the Public Service Commission of.the State of New York for bus service within the City of Glens Falls and between Glens Falls and the Villages of Hudson Falls and Fort Edward in Washington County and between Glens Falls, and the Village of South Glens Falls in Saratoga County, and between Glens Falls and; the Village of Lake George, and Whereas, the certificate covering the operation between Glens Falls and Lake George is for a route along Route 9 which includes the portion of Route 9 now locally known as Upper Glen Street between the northerly city line of Glens Falls to Miller Hill, Aviation Road and Quaker Road, which area (Upper Glen Street) was, at the time the said certificate was issued, largely residential and was served adequately by the buses between Glens Falls and Lake George and Warrensburg, and Whereas, during the past few years there has been a complete change of the Upper Glen Street area from residential to commer- cial, including three shopping centers, two branch banks and a large number of retail stores and places of business and one of the businesses which has located in this area is the garage and service termiaal of Adirondack Transit Lines, Inc. , and 13S Whereas, by actual count there are more than 1,000 persons regularly employed daily in the Upper Glen Street area between the northerly city line and Quaker- Road and many thousands of customers visit the area daily from Glens Falls, South Glens Falls, Hudson Falls and Fort Edward, but no regular bus service is available other than the four trips daily between Glens Falls and Lake George which do pick up and discharge passengers in the Upper -Glen Street area along Route 9, °and others must use taxis or car pools, and Whereas, representatives of the Town of Queensbury and the owners and managers of businesses located in the Upper Glen Street area have met with representatives of Adirondack Transit Lines and requested the establishment of `local''bus service between Glens Falls and the Upper Glen Street area' but have been told by the management of Adirondack Transit Lines that local bus service in Glens Falls has been unprofitable and that the company intends to discontinue local bus ser*ice in Glens Falls in the' near future, and Whereas, it is the opinion of the Town Board that most of the existing routes in Glens Falls could be discontinued without ser- ious inconvenience to the residents of Glens Falls but that an extension of the existing bus route from Fort Edward and Hudson Falls to Glens Falls northerly along Route 9 to quaker Road will be of great convenience to the public and will be a profitable operation for the Adirondack Transit Lines since no additional equipment or personnel would be required, be it , RESOLVED that the Town Board of the Town of Queensbury, Warren County, New York, hereby requests the Public Service Com- mission to make an investigation into the matter of whether the public convenience and necessity requires the extension of bus service from Fort Edward, Hudson Falls, South Glens Falls and Glens Falls northerlyr along Route 9 and Upper Glen Street- in the Town of Queensbury to Quaker Road, and to make such order as may be deemed in the public interest on the basis of such investigation. Duly adopted by the following vote: Ayes - Mr. Beaty, Mr. Turner, Mr. Lampson, Mr. Robertson and Mr. Webster. Noes - None RESOLUTION NO. 173, Mr. Turner introduced the following resolution and moved its adoption, seconded by Mr. Beaty. Whereas, the Town Board adopted Resolution No. 133 on June 10, 1965, subject to `permissive referendum, authorizing the purchase by the Town of Queensbury from Glens Falls Insurance Company of a parcel of land on the easterly side of Bay Road and northerly of Haviland Road containing about 12 acres for a price of $10,000.00 as the site for a t6or hall, and notice of the adop- tion of said resolution was duly given by the Town Clerk and no petition has been filed to require a referendum on such proposed purchase and said resolution has now become effective, and Whereas, John B. Van Dusen, Town Surveyor, has prepared a map and description of said parcel and the Glens Falls Insurance Company is prepared to deliver a deed conveying said parcel to the Town of Queensbury, be it 139 RESOLVED that, upon delivery of the deed of the Glens Falls Insurance Company in form approved by the County Attorney, the Supervisor be and he hereby is authorized to draw a check on the general fund payable to Glens Falls Insurance Company in the amount of $10,000.00 in full payment of the purchase price of said real property. Introduced by Councilman Turner, seconded by Councilman Lampson. RESOLVED,, -That the Supervisor be and he hereby..is authorized and directed to make application to the Water Resources Commission of the State of New York for approval of the plans of the Bay Road Water District for constructing a water distribution system and obtaining water from the Queensbury Water District. Nine Water District for constructing a water distribution system and obtaining water from the Queensbury Water District. Upon roll call the foregoing Resolution was adopted by the following vote. Crannell Town Clerk F,A40 Superintendent of Highways, Bernard J. Codner presented a description of a section of land at the end of a recently opened highway in the Broadacres tract. The land involved will create a turn around at the end of the highway to be used by snow plows in the winter months. Superintendent of Queensbury Water District, Thomas K. Flaherty informed the board that a survey will be made by the town engineer, in the West Glens Falls Water District. . ; Councilman Beaty, stated that he has been in receipt of suggestions from residents of the Cottage .Hill area. .that, a ,ragweed control program be undertaken by the ,T,own of Queensbury. A report was also registered by Councilman Beaty, to do, with the dumping of refuse —' on town highways. RESOLUTION NO. 176, introduced by Mr. Beaty, seconded by"Mr,`" Lampson. RESOLVED, that the Audit of Claims as listed in Abstract #65-7A numbered 703 through #706 inclusive and totaling $8,217.48. is hereby approved. The question advanced by Mr. Rathbun had to .do :with •the,address. of the Building Inspector of the Town of Queensbury. Mr. Paul Bishop appeared at the meeting to question the town Board as to .the progress of the' survey- being conducted which would ultimately result in providing water supply for the area of West Mountain Road. . : - . . I J Supervisor .Webster discussed the activity being conducted at present. It was -explained that a total of six test borings have been made to date in hopes of discovering a source of water supply in the section including West Mountain Road. The progress of the engineer on the project was also discussed.
