BAY ROAD SELF STORAGE RIGHT OF WAY BAY ROAD SELF STORAGE, LLC RIGHT OF WAY Presently John Kubricky & Sons, Inc. own the fee title to 50' wide Right of Way and Easement that serves Duke Concrete Products, Inc. That ownership is subject to a permanent non-exclusive right of way and easement granted to Duke Concrete Products, Inc. by deed dated March 31, 1982 which deed was recorded in the Warren County Clerk’s Office April 2, 1982 in Liber 645 at Page 609. The right of way and easement in common with John Kubricky & Sons, Inc., its successors and assigns, is for ingress and egress for all form of motor vehicle and foot traffic over the 50' strip running from Bay Road to Everts Avenue. Said right-of-way is in perpetuity or until said roadway or its substitute shall become a Town highway. John Kubricky & Sons, Inc. have an obligation to maintain same and reserve the right to alter its location and reduce its width to 30'. John Kubricky & Sons, Inc. will be conveying Lot 3 to Bay Road Self Storage, LLC and said conveyance will be subject to the following: 1. The above Right of Way and Easement of Duke Concrete Products, Inc. ( 645/609), 2. Reservation to John Kubricky & Sons, Inc. its successors and assigns, of a Right of Way and Easement with two curb cuts to the 50' right of way and easement located between Lot 3 and Lot 2 for the purpose of providing ingress and egress from and to Lot 2 and Bay Road for all form of motor vehicle and foot traffic. Said right of way shall be in perpetuity or until said roadway or its substitute shall become a Town highway. Bay Road Self Storage, LLC shall have the obligation to maintain said right of way and easement.
