MALOY, INC. - BUCKBEE ROAD CULVERT REPLACEMENT PROJECT RESOLUTION NO.: ,2018 INTRODUCED BY: WHO MOVED FOR ITS ADOPTION SECONDED BY: WHEREAS, by Resolution No.: 223,2017, the Queensbury Town Board authorized the Buckbee Road Calvert Replacement Project (Project), establishment of Buckbee Road Calvert Replacement Capital Project Fund 4218 and engagement of The Chazen Companies (Chazen) for technical and engineering services concerning the Project, and WHEREAS, by Resolution No.: 376,2017, the Town Board authorized Chazen's Technical Services Change Order 41 for design and construction phase services outside the original scope of the Project and an advertisement for bids for the Project in the official newspaper for the Town of Queensbury, and WHEREAS, by Resolution No.: 203,2018, the Town Board awarded the bid for the Project to the lowest, responsible bidder, James H. Maloy, Inc., (Maloy) for an amount not to exceed $186,000, and WHEREAS, Chazen has advised that as a result of highly variable rock elevations under the culvert area, Maloy was required to perform significantly more work than was originally anticipated resulting in a net increase of$6,124 in the bid award/contract cost, and WHEREAS, the Town Board wishes to authorize a Change Order and the resulting withdrawal and expenditure in the additional estimated amount of$6,124, NOW THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby authorizes The Chazen Companies to process a Change Order for the additional work performed by contractor James H. Maloy, Inc., relating to the Buckbee Road Culvert Replacement Project and the resulting $6,124 net increase in spending outside the original Scope of the Bid Award as delineated in the preambles of this Resolution, bringing the total contract price for the bid award to $192,124, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs that funding for such increase in Capital Project shall be by a transfer of$6,124 from the General Fund Unappropriated Fund Balance to transfer to Buckbee Road Culvert Capital Project Fund 4218, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer to amend the Town Budget, make any adjustments, budget amendments, transfers, prepare any documentation and take all action necessary to increase appropriations and estimated revenues in the following accounts: • Revenue Acct No. —218-0000-55031 (Interfund Revenue) $6,124; • Expense Acct No. —218-8540-2899 (Capital Construction) $6,124; • Expense Acct No. - 001-9950-9030 Transfer to Capital Project $6,124; and 2 BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to execute any needed Change Order in form acceptable to Chazen, the Town Supervisor and/or Town Counsel, as well as any other needed documentation, and BE IT FURTHER, RESOLVED, further authorizes and directs the Town Supervisor, Budget Officer, Purchasing Agent and/or Town Counsel to take any actions necessary to effectuate the terms of this Resolution. Duly adopted this 15'' day of October, 2018, by the following vote: AYES: NOES: ABSENT: 3 RESOLUTION AUTHORIZING AWARD OF BID FOR BUCKBEE ROAD CULVERT REPLACEMENT PROJECT RESOLUTION NO.: 203, 2018 INTRODUCED BY: Mr. Anthony Metivier WHO MOVED ITS ADOPTION SECONDED BY: Mr. George Ferone WHEREAS, by Resolution No.: 223, 2017, the Queensbury Town Board authorized the Buckbee Road Culvert Replacement Project (Project), establishment of Buckbee Road Culvert Replacement Capital Project Fund 4218 and engagement of The Chazen Companies (Chazen) for technical and engineering services concerning the Project, and WHEREAS, General Municipal Law §103 requires that the Town advertise for bids and award the bid to the lowest responsible bidder meeting New York State statutory requirements and the requirements set forth in the Town's bid documents and specifications, and WHEREAS, by Resolution No.: 376,2017, the Town Board authorized the services of Chazen for design and construction phase services concerning the Project, and an advertisement for bids for the Project in the official newspaper for the Town of Queensbury, and WHEREAS, on May 151h, 2018, the Purchasing Agent duly received and opened all bids, and WHEREAS, the Purchasing Agent and Chazen have reviewed the bids and recommended that the Town Board authorize the bid award to the lowest responsible bidder, James H. Maloy, Inc., for an amount not to exceed $186,000, and WHEREAS, the Town Board wishes to authorize a withdrawal and expenditure in the total estimated amount of$186,000 fiom Capital Reserve No. 64 toward this Capital Project, and WHEREAS, in accordance with New York State General Municipal Law §6(c), the Town Board is authorized to withdraw and expend funds from Reserve #64 subject to permissive referendum, NOW, THEREFORE, BE IT RESOLVED, that the Queensbuiy Town Board hereby awards the bid for the Buckbee Road Culvert Replacement Project (Project) to the lowest, responsible bidder, James H.
