Resolutions 1. SEQR 2. PB Decision Project Description Applicant proposes a revision to an existing 1,110 sq. ft. area as blacktop where a previous approval was for this area to remain as lawn. Revision is 882 sq. ft. of lawn and 228 sq. ft. of permeable pavers to be installed. Property use is an existing lodging facility. Applicant requested approvals in year 2012 for addition to lobby, storage over lobby, sign towers, handicap ramp location and a canopy area. Pursuant to Chapter 179-3-040 of the Zoning Ordinance, permeability relief shall be subject to Planning Board review and approval. Staff Comments  Location- The project is located at 1449 State Route 9 nearby to the Outlets.  Arrangement- The site is used as lodging facility with four existing buildings. During a 2012 site plan review the applicant was granted approval for several improvements and variance for permeability.  Site Design- The applicant had completed the improvements with one exception an area of 1,110 sq ft that was to remain as lawn was paved over. The area is between two existing buildings as shown on the photo  Building – The four buildings on the site are to remain all exterior work granted in 2012 has been completed.  Signage-There are no changes to the signage.  Site conditions-The applicant proposes no site changes.  Traffic- The site has an existing 39 parking spaces and there are no changes proposed.  Grading and drainage plan and Sediment and erosion control – The stormwater of the 1,110 sq ft hard- surfaced area drains towards existing lawn area on the south west side of the buildings.  Landscape plan –There are no changes to the landscaping.  Site lighting plan –There are no changes to the lighting.  Elevations and Floor plans –There are no changes to the buildings floor plans or elevations. Pursuant to Section 179-9-050 the Planning Board may grant waivers on its own initiative or at the written request of an applicant. The application form identified as “Requirements” outlines the items to appear on the site plan or included as attachments. At the time of application the applicant has either requested waivers, indicated the item not applicable or has not addressed the item/ left check box blank. This includes the follow items listed under Requirements of the applicant’s application: g. site lighting, h. signage, j. stormwater, k. topography, l. landscaping, n traffic, o. commercial alterations/ construction details, p floor plans, q. soil logs, r. construction/demolition disposal s. snow removal. Nature of Variance Variance Granted 11/14/18 with plan revisions noted –increasing the permeability. Board had provided guidance about increasing the permeability to 25% as original granted. The applicant revised plans to amend the 1,110 sq ft area of hard surfacing with 882 sq. ft. of lawn and 228 sq. ft. of permeable pavers to be installed with a 25% where a 30% relief is required. The approved plans of 2012 indicate the proposed permeability was to be 25%. The Code Compliance Officer notified the applicant in 2017 the site was not developed as per approved plans. Summary The application has completed a site plan modification to an approved plan to amend the 1110 sq ft of hard surfacing with 882 sq. ft. of lawn and 228 sq. ft. of permeable pavers.
