Frank Morgan was granted the floor in regards to the acceptance of the balance of the lots in the Land-of-Pines Subdivision. Mr. Morgan stated that he had contacted the Department of Health and that the final acceptance would be forth doming at an early date. Edward McCullough was granted the floor in regards to 4 complaint about the condition of the road in front of his residents on the Aviation Road. 38 First Street Waterford, N. Y. Y. , who is the Attorney for your town, relative to a 100 share certificate 190 in the name of my grandfather J. K. P., Pine in the Pine View Cemetery for an interest in one half the proceeds of sale of use of lots. The item is signed by Charles E. Gardner as Treas. and William D. Lane as Pres. , being dated August 3, 1899 and having a seal attached showing incorporation in New York State the same year. On August 3, 1963 Mr. Beswick told me on the telephone that he would investigate 'the matter if I wrote him a letter , ag to the details, however he must have overlooked the request. Now I must settle several open details relative to the Estate of Mr. James K. P. Pine and this is still one of them, Will you please assist me to determine the valuetof this stock and of any dividends paid in the past which might have been turned over to the State of New York under the Abandoned Property Act, Mr. Pine having .died Sept. 17, 1919 a resident of 853 Second Avenue, Troy, N.Y. As this old matter could be acclaim on the present land- of the Cemetery, including the now lot owners, and as I know none of the lot but do know that you have disposed of some of theJand to Montgomery-Ward, I am taking the liberty of sending them a copy of this letter at their Menands store. On Route 32, SH 656, at its intersection with Highland Avenue, a Town road, and with River Street, SH 656; in the Town of Queensbury, Warren County: F . Revises specifications for Signal No. 1 to provide for dual indication. The order for this signal filed with the Secretary of State is identified as Section 2052.10, subdivision (f), of the regulations of the State Traffic Commission. To my knowledge, we are 'in. compliance with all of the provisions of the mobile home ordinance, having a standard sceptic sanitary installation, and after using our well for- some time we have just recently made application for a water tap with the Queensbury Water District. Webster Chestnut Ridge Road Glens Falls, N. Y. Dear John, • R Sorry for the delay concerning some of the following items. First of all concerning the complaint against Lockhart's Nursing Home and the subsequent letter from the Department of Health concerning the same, I bring to your attention the following, In June, before I left on vacation, I called several _of the doctors who use the facilities of Lockharts: ' They felt that the general sanitation and nursing care was entirely adequate. Last week- 1 paid a surprise visit to the nursing home and likewise feel that this establishment is over-all quite adequate. Beds were made, things were put away in closets etc. Tables, chairs, floors and the like were clean, as was the kitchen. There is no dgnbt that _the building ,is somewhat older and the furniture used but nonetheless it is entirely satisfactory functionally. This ,nursing 4gme .4erves a`definitd and desperately needed function in this general area of the community and in particular to the WeLfare Department ,and I have found nothing to make me feel that this function should not be continued. The second matter involving Mrs. Sissan Ingraham and her tenant, Mrs. Roger Bump is as follows: It was my understanding that Mrs. Ingraham was going to correct ..,this situation, or discontinue to rent the property. If my memory• serves me correctly (from a phone conservation ) she had a few unkind things to say about the Bumps. If the situation is still the same I would feel that Mrs. Bump should make a complaint in writing stating the dates and the water reports so that we have concrete evidence of contamination. If this is done I will be glad to go out and inspect the property and talk to the individuals concerned and make a recommendation. 279 Finally, let me apbligize for the situation in which you found yourself on my recent vacation. The problem has always been that the ordAnary doctors who cover for me, whenever I might go away, are not qualified health" officers. This indeed does pose a problem and I will be glad to talk to Dr. Loudon or yourself in regards to what can be done under these circumstances. Incidentally, the complaint from Animal Land should have posed no particular problem, since a year ago I wrote them with the precise steps as towhat to do whenever someone was bitten by any of their animals. Merrill of the Assembly Point Association to do with a violation of-the newly adopted ordinance for the Regulations of Mobile Homes. A letter received and placed on ,file from Richard C. Tefft, Jr. , of Cleverdale, New York, to do with the proposed zoning in sections which border on the shores of Lake George. A letter was received and placed on file from the Health Association of Warren County, Inc. , to do with the possibility 6f water being supplied to the Health Camp by the Queensbury Water District. This request was referred to the Engineer of the Water District, Mr, Joseph A. Kestner, Jr. WARREN COUNTY MUNICIPAL CENTER Lake George, N. Y. 4 Department Law August 139 1964 To: John 0. Webster, Supervisor Re: Expense of maintenance of drainage systems You have told me that several years ago the Town installed a drain on Garrison Road and that some property owners along the street have drains from their properties connected to this drain to carry off surface water. during this year, your Town Superintendent has had to undertake an expensive program of removing roots from this old drain and you are concerned with the proper source of funds which to pay the cost. Under subdivision 11-a of Section 64 of the Town Law a Town Board may construct drains in town highways and the expense of oon- struction and maintenance are a general town charge. This is generally done to provide highway drainage through catch basins and -the fact that adjoining owners may have cellar drains connected to it does not alter the making of the cost of the improvement a general town charge. On the othei' hand, where a Town Board undertakes to provide drainage -for a considerable area for the benefit of property owners in the area and not for highway drainage, then the proper procedure is the establishment of a Drainage District. Under Section 202 of thec -Town Law, the expense of establishing a drainage district and of constructing a drainage system must be charged to the owners of property in the district bn a benefit basis. Under Section 202-a of the Town Law, the expense of maintenance of a drainage system in a drainage district must likewise be charged on a benefit basis on all real property in the district and cannot be made a general town charge. I know of no legal way by which your Town Board may charge to the property owner's on Garrison Road thse expenses which you have 2 incurred for cleaning the old drainage tile. Albert E. Beswick.
