1964-12-03 SP 390 RESOLUTION TO APPROVE APPLICATION FOR MOBILE HOME COURT by RESOLUTION I NO. 217, Introduced by Mr. Lampson, seconded Mr. Robertson WHEREAS, Mr. & Mrs. John A. Miller of 53 Montcalm Street, Glens Falls, New York, has made application for a permit to operate a new Mobile Home Court containing 3' lots for mobile homes on property situated at R.F.D. #3, Luzerne Road, and WHEREAS, the Town Board has, after investigation, given approval of this application and plans, therefore- be it RESOLVED, that the application of Mr. & Mrs. John A. Miller of 53 Montcalm Street, Glens Falls, New York fora permit to operate an new Mobile Home Court containing 3 fits for Mobile homes, on property situated at• R.F.D. #3 Luzerne Road, West Glens Falls, New- York be and the same is hereby approved and that the Town Clerk is hereby authorized and directed to notify the applicant of the decision of this Board, Be it further RESOLVED, that the Town Clerk is hereby authorized to issue the permit to operate a Mobile Home Court upon receipt of the fee, in accordance with Section 2, paragraph 4 of the Mobile Home Ordinance of the Town of Qaeensbury. The following visitors were greeted by the Town Board. Attorney Arthur Greenburg - Mohican TV Cable Martin Karig - Mohican TV Cable Attorney Bernard McPhillips - Newhouse Broadcasting Corp. Coduer - Superintendent of Highways Thomas Flaherty Qu.eensbury Water District The public hearing was declared open on the subject of the three applications for a franchise to construct a Community- Coaxial Cable Television service. Proof of Publication was presented by the clerk. The clerk read the notice of' the hearing as published in the Post Star and the Glens Falls Times. Supervisor Webster explained the plan of handling the hearing. Attorney Arthur Greenberg was granted the floor. Mr. Greenburg appeared as a representative of Martin Kar1g and the Mohican TV Cable Corporation which is affiliated with the Jerrold Manufacturing Company, of Philadelphia, Pa. The general construction of the system which would be installed by the applicant who he represents was discussed by Mr. Greenburg. It was explained at this time that a site for the proposed construction of the reception tower has been leased in the Town of Moreau. The application for lease of the necessary telephone lines have been prepared and submitted to the utilities who would grant the pole use to the Mohican TV Cable Corp. A general discussion on all efforts Which have been made up to this date was advanced by Attorney Greenburg. Mr. Greenburgs opinion is of the nature that only one applicant will be granted use of the necessary poles to complete an installation. Attorney Bernard McPhillips, the representative of the Newhouse Broad- casting Corporation was granted the floor. Mr. McPhillips introduced Mr. Charles Schoeneck and Mr. Albert Eicholzer who were present as representatives of the Newhouse Broadcasting Corporation. Mr. Charles Schoeneck spoke on the subject of the installation of the Coaxial Cable system which his company has proposed. A statement on the subject of the extended service which the customers will receive was advanced by the speaker also an explanation on the popularity of the system in other communities, was forthcoming. Mr. Schoeneck discussed the back ground of the Newhouse Broadcasting Corp. , as well as the financial stability of same. Mention was made at this time on a question as to the activity of the Mohican TV Cable Corporation to complete a franchise with the City of Glens Falls. Mr. Schoeneck stated that his company is of the opinion that; if a franchise was granted for Queensbury, they would proceed with plans, to install a system without the inclusion of the City of Glens Falls in the installation. Mr. John B. Lynch of the Normandy Broadcasting Corporation was granted — the floor. Mr. Lynch wasnot represented by any legal consul, but stated that there has been no activity on the part of the Mohican TV Corporation to carry out the franchise with the City of Glens Falls. The site which his company has acquired for the antenna location was available to any group who might have leased same. The Normandy Broadcasting Corporation would run a TV Coaxial Cable line into all schools at no charge. 392 Following the presentations of the three applicants, the fact was made clear that each company would reimburse the Town of Queensbury 2% of the net profit which would result from the monthly charges to the customers. Councilman Beaty questioned Attorney Greenberg as to the location of the site of the proposed tower in the Town of Moreau. The results of all tests to prove signal strength was discussed by Mr. Greenberg. Mr. Karig stated that amplifiers would be installed at approximately 2000- feet apart. Mr. Eicholzer explained that the system could be installed with as many as 30 amplifiers involved. Councilman Beaty questioned the representatives of the Newhouse Corporation as to any progress in obtaining a location for the tower which the company might provide. Councilman Robertson asked Mr. Eicholzer of the Newhouse Corporation what time would be needed to construct the system. All points of detail was discussed by Mr. Eicholzer at this time. Supervisor Webster advanced a general question to all applicants as to the possibility of installing the cable underground. The response was that this can be done when necessary. The possible gross revenue which the Town of Queensbury would receive was discussed by the Supervisor. Mr. Karig stated that his company anticipate acceptance of the system by approximately 60% of the homes in the area. Supervisor Webster advanced the question as to who would make the decision as to what television channels would be provided in the proposed system. A question was raised as to why the three different .- companies would make the urgent requests for a franchise at this time when the Mohican TV Cable Corporation has had a tentative franchise with the City of Glens Falls for one year. Mr. Webster questioned the Newhouse Corporation as to whether or not the service to the Town of Queensbury would result as soon as a franchise might be granted. Attorney Albert E. Beswick provided a resumee of all information obtained from the interviews. Mr. Raymond Moench stated that he agreed with Mr. Beswicks opinion that the well being of the residents of the Town of Queensbury should be protected in the granting of a franchise. Mr. Richard Irving 'questioned all applicants for the franchise as to the amount of investment and return which could be possible in the proposed system. A statement by Mr. Irving had to do with the fact that the proposed Coaxial Cable would -create .a financial loss to local television service men in the area. Supervisor Hallenbeck of the Town of Kingsbury questioned 'the applicants; if any other localities had considered asking for bids before granting a franchise. Mr. Harold Rathbun suggested that a joint meeting with representatives of all adjoining towns and the City of Glens Falls would be advantageous. The hearing was declared closed at 10:00 p. m. 993 Following a short recess the Town Board discussed the result of the hearing. Decision was reached that any action should_ be taken at a later date. The report of New Construction was received and placed on file. There were 14 reports filed for the month of_November, 1964. A plan was discussed to provide temporary water supply for the residents of the town. With the sizeable lack of water a tap will be provided at the Town Storehouse on Aviation Road. JOSEPH A. WHITE _ 394 RESOLUTION TO APPOINT A TOWN PLANNING BOARD MEMBER RESOLUTION NO. 218, introduced by Mr. Beaty, seconded by Mr. Robertson. WHEREAS, the term of Maurice H. Simmonds, as a member of the Town Planning Board of the Town of Queensbury expired on October 1, 1964, and WHEREAS, Mr. Simmonds has requested that he not be considered for reappointment at this time, be it RESOLVED, that John E.- Sinnott, RFD- #1, Chestnut Ridge Road, Glens Falls, N. Y. , a citizen and resident taxpayer of the Town of Queensbury be and he hereby is appointed a member of the town planning board for a term of seven years, to commence on December 3, 1964 and expire on Septembet 30, 1971. Duly adopted by the following vote: Ayes - Mr. Beaty, Mr. Lampson, Mr. .Robertson and Mr. Webster. Noes - None RESOLUTION OF APPRECIATION RESOLUTION NO. 219, introduced by Mr. Robertson, seconded by Mr. Beaty WHEREAS, Maurice H. Simmonds, RFD #1, Chestnut Ridge Road, Glens Falls N.Y. , has served as a member of the Planning Board of the Town of Queensbury since its organization on October 1, 1962, for a term of two years, and has requested that he not be reappointed at this time, be it RESOLVED, that the members of the Town Board hereby express to Maurice -H. Simmonds their sincere appreciation for the interest he has shown in the -welfare bf our town and community, and for the valuable and dedicated service he has rendered to the Town of Queensbury as a member of the Planning Board. Noes - None RESOLUTION AUTHORIZING THE APPOINTMENT OF SPECIAL TOWN POLICEMEN RESOLUTION NO. 220, introduced by Mr. Lampson, seconded by Mr. Robertson. WHEREAS, Chief of Police LeRoy Phillips has recommended to this board that special town policemen be appointed, to serve -without salary, to supplement the present part-time personel of the department. THEREFORE BE IT RESOLVED, that the appointment of special policemen . by this board- is hereby -authorized, not to exceed 6 in number, to serve without salary, but that they be authorized to receive re- numeration at the rate of $1.25 per hour when called to duty authorized by the Chief of-Police, and upon verified claim approved by this board, and be it further RESOLVED, that the compensation fixed above for policemen is for Criminal matters and -that the policemen -shall retain and are entitled to retain all Civil fees. Duly adopted by the following vote: Ayes - Mr. Beaty, Mr. -Lampson, Mr. .Robertson and Mr. Webster Noes - None 395 RESOLUTION TO APPOINT A SPECIAL POLICEMAN RESOLUTION NO. 221, introduced by Mr. Beaty, seconded by Mr. Lampson WHEREAS, this board has received a recommendation from Chief of Police LeRoy Phillips that Donald E. Van Vorst be appointed a special police- man of the Town of Queensbury, in accordance with Resolution # 220, adopted by this board on December 3, 1%4, therefore be it RESOLVED that Donald E. Van Vorst, RFD #1, Lake George, New York be and he hereby is appointed a special-policemen of the Town of Queensbury to serve at the pleasure of this board for a term not to exceed December 31, 1965. Duly adopted by the following vote: Ayes - Mr. Beaty, Mr. Lampson, Mr. .Robertson and Mr. Webster. Noes - None Mr. Bernard J. Codner, Superintendent of Highways recd mended the acceptance of a 50 foot road known as Bennett Road, subject to the approval of the County Attorney. RESOLUTION TO ACCEPT DEED FOR TOWN HIGHWAY RESOLUTION NO. 222, introduced by Mr. Robertson, seconded by Mr. Lampson WHEREAS-Beverly Ruth Tucker Bennett, -of Aviation Road, °Town of Queens- bury, Warren County, New York-, has executed and offered a deed to convey to the Town of Queensbury land for a 50 foot roadway known as Bennett Road, said road to eventually be connected with Eldridge Road ( T.R.#129) by an extention through lands presently owned by Olmstead, and WHEREAS, Bernard J. Codner, Superintendent of Highways, has advised this board that he recommends the acceptance of this road into the town highway system, and that it will eventually eliminate the present "dead end" situation with respect to T.R. #129, now therefore be it RESOLVED, that the deed of Beverly Ruth Tucker Bennett, as above described, be and the same is hereby accepted and approved, subject to the approval of the County Attorney, Albert E. Beswick, and that after such approval the Town Clerk -is hereby authorized and directed to cause usaid deed to be recorded in the Warren County Clerks Office, after which said deed shall be properly filed in the office of the Town Clerk, and be it further RESOLVED, that this new town road is hereby added to the official inventory of town highways, and is described as follows: Road: #276 Description: T.R. 1129 N. to D.E. Name: Bennett Road Mileage: 0.21 And be it further, - RESOLVED, that a copy of this resolution be forwarded to the Warren County Highway Department, the New York State Department of Public Works, The Town Planning Board, and John B.
