Meeting called to order by Deputy Supervisor Daniel Olson
Attorney Dusek-The Town has been considering action against
Saratoga Associates for some time now, in order to expedite
the handling of the case and also assist in the defense of
the case that Saratoga Associates has against us we feel
that it is appropriate now to commence our action against
Saratoga Associates .
RESOLUTION COMMENCING ACTION AGAINST THE SARATOGA ASSOCIATES
RESOLUTION NO. 579, 1989, Introduced by Mrs . Marilyn Potenza
who moved for its adoption, seconded by Mr. Ronald Montesi :
WHEREAS, the Town Board of the Town of Queensbury is
authorized, pursuant to Town Law, to commence any action or
proceeding for a Town or for its benefit, in the name of the
Town, and _
WHEREAS, pursuant to Town Law, the Town Board may authorize
and direct any officer to institute any action or legal
proceeding in the name of the Town,
NOW, THEREFORE BE IT
RESOLVED, that the Town Supervisor of the Town of Queensbury
is hereby directed and authorized to commence an action
against Bristol , Litynski , Wojcik, P.C . , d/b/s The Saratoga
Associates , and a Summons with Notice and Complaint shall be
prepared and served upon the said Bristol , Litynski ,
Wojcik, P .C . , d/b/a The Saratoga Associates, and
BE IT FURTHER
RESOLVED, that the Town Attorney, Paul B. Dusek, Esq. , and
Patrick J. Tomaselli , Esq . , of Counsel , shall be the legal
counsel for said suit.
Duly adopted this 6th day of October, 1989 by the following
vote :
Ayes : Mrs . Potenza, Mr. Montesi , Mrs . Monahan
Noes : None.
Absent: Mr. Borgos , Mr. Kurosaka
