Y. 12801 Mike, Mobil Oil - Upper Glen at Aviation Road - F/LG= We have not heard from you since you were in the office early last week, and the signs at the Mobil Station have not been changed to conform with Queensbury's Sign Ordinance. Ed York and Jim Richardson agreed to cover the flying horses on either side of the station and I not4the free-standing sign at the entrance to the store has been uncovered, whereas they agreed to have it covered. There are three wall signs - two on the canopy and one over the store entrance. The ordinance allows two wall signs, so one must be eliminated. The two snap-lock signs are still covered, whereas they prom- isedo remove them. I was assured it would be a simple matter to remove them and that would be done immediately. The setback for the two free-standing signs (one up Aviation Road and one by Albany Savings Bank) are less than 15 feet from property lines, although the signs, with price panel, appear to be less than 50 sq. ft. , according to Jim Richardson. Mobil has a temporary C. O . and will not get a permanent C.O. until these and other deficiencies are corrected, but the signs should be corrected immediately. Sincerely, Robert L. Signs erected without permits - called attorney twice for permits, as signs started to go up - no permits forthcoming. 2. Teijsigns erected - 5 wall 5 free-standing - 3 permitted by ordinance - 2 wall or 1 wall and 1 free-standing plus 1 extra wall sign (on corner). 3. Erected 2 free-standing over-size signs - 64 sq. ft. without price portion only 5 feet from property lines - plus 2 free-standing cigarette/oil signs and one "services provided" sign under canopy. 4. On Wednesday 7/30 agreed with Ed York, District Manager and assistant Jim Richardson to allow temporary permit for one illegal free-standing sign on Aviation Road with price sign, one small canopy sign and one "Mobil Mart" sign over entrance to store. Applications and fee accepted. All other signs to be covered until removal. 5. On this day two higher gentlemen came with Ed York and Jim Richardson to view the station and called the office in a panic - Supervisor not available and did not wish to wait till afternoon so called to ask that I come right down. They did not like the image of covered signs - it did look like some- thing had died and awaiting burial. 6. Agreed - very reluctantly - to let them unveil second illegal free- standinQsign (toward Albany Savings Bank - too large and five feet from r-o-w and side property line) on basis these two free-standing signs would be replaced immediately by a 45 sq. ft. sign (including price) temporarily - until set back variance could be requested at September meeting of the Zoning Board. Three other free-standing signs to be remov- ed and two wall signs removed - subject to Zoning Board approval. What I would like to see , and I believe I would get close to unanh? us agreement by all in government, is what they call "Texas" or "Dallas" signs. I ' ll try to photo my pictures , but there are four of these signs at different oil company stations in Queensbury - Arco and Mini Chopper on Aviation Road, Exit 20 Mobil and Citgo (just north of Montcalm South) on the Lake George Road. Mobil people say, " Not authorized with this style station. "Baloney" (putting it politely). I'd like to see us insist on it. That decision is up to the Zoning Board. HOME OF NATURAL BEAOTY . . . A GOOD PLACE TO LIVE 2. Board. Now we are stuck with a mess of horrible hodge-podge of incompat- ible buildings. This is a case in point. To be sure , much of Mobil' s problems and unnecessary expense could have been avoided had permits been obtained prior to erection of the signs, but basic problem wasa 1. Architect did not place free-standing bases with proper set back. 2. Signs should have been ordered to meet Queensbury's sign ordinance, as to size. There was nothing on the blue prints or elsewhere to indicate the size or message. 3. Signs erected in excess of number allowed in ordinance. All three (Boards and Committee) had copy of blue print, but according to the minutes - Zoning Board concerned with building setback, Planning Board with curb cuts and Beautification Committee with plantings. It is illegal to erect signs in Queensbury without first obtaining a permit. Not only did your company not have permits for the signs at this location, but ten signs (many of which are illegal) were erected, where- as three signs are the maximum allowed. Queensbury' s sign ordinance entitles your firm to three wall signs (as this location is on a corner) , or two wall signs and one free-stand- ing sign. You have five wall signs and five free-standing signs. What I should have done was to insist upon the removal of all signs and allow the legal ones, with permits to be reerected. Fortunately, just at that moment your District Manager Ed York and Jim Richardson arrived. After much discussion and explanation, I agreed to leave two wall signs and one illegal free-standing sign, for which applications and fee were received, so you could obtain a temporary certificate of occupancy on Ed' s agreement to cover all other signs and to replace the illegal free-standing sign,-with what Ed called, a Texas Type Sign, such as you have at Exit 20 Mobil. Two of the free standing signs were not only over-size, but less than fifteen feet from all property lines, especially the highway r-o-w. Ed and Jim were prone to blame the real estate dealer and the attorney. I BELIEVE THE WHOLE PROBLEM WAS CAUSED BY THE ARCHITECT. (That is on the size and number of signs. ) He did not do his homework: On the south side of the property nearest the Albany Savings Bank, he should have placed the curb further in on your property (north) to allow for the fifteen foot setback, if that waa(the desired location for that sign which could have removed it from behind a power pole. There is no excuse for placing the free-standing sign on Aviation Road less than fifteen feet from r-o-w. There is plenty of room there to have set it back farther. Had the blue prints (copy of which I have for another purpose) shown the size of the signs or had applications for permits been filed in advance, as they should have been, the problems would have been resolved, instead of the expense required to make correction. An inspection of the premises revealed that the entire planting that existed behind the former station has been removed. It was one of the most expensive and finest planting of any gas station in this area. The agreement was that all that could be retained would be.
