1962-06-14 4s Among the water districts discussed at this .ti.me, was tba .ext- ension on the Bay Road in the North Glens Falls Extension. This new extension will be known am- Extension #6. The cost which will be borne by the customers will be $750,00,. Upon discussion, of the extension on Homer and Everetts Avenue's known as Extepsi.on• #8,• the total cost estimated cost is $9000.00. The engineers estimate• on• North Glens Falls Water District #7 on Montray Road was studied at this time. The total cost for the project is estimated at #7200.00. of which $5400.00 is chargeable to the proposed water district extension and -$1-800.00 is'- to be charged to North Glens Falls Water District Extension. Bernard J. Codner Supt, of Highways Mr. George Liapes Supt. of N.G.F, Water blot. Mr. Griffin, approached the board with a request for a ruling on restriction on new construction in the section of Gaunt Line Road. Res Assembly Point Tax Gases -Dear John: - I have been working on the Assembly Point tax cases* for the past three years, off and on, and up to this point have had no compensation. In 1_959, there were 32 seperate _proceedings which required 32 separate answers. There were 29 cases represented by St.. Louis and Weber in which the petitions were defeated. I made a motion to dismiss but the Court permitted them to serve amended petitions. 14.9 Letter Continued. Re: Assembly Point Tax Cases In 1960, there were 28 proceedings which required .28 seperate answers. Some proceedings were discontinued and two which were bro4ht 'by Attorney Frankel, of Schenectady, have never been brought ,to trial and ,presumably have been abandoned, which leaves 25 proceedings to be tried.- ' Each proceedng. involvss two issues, Cl) alleged over valuation, which relates only -ti► the subject prQpertyr and (2) alleged inequality, which involves proof- of sample parcels selected by each side. Only the Barber case has- been tried but we have agreed that. the proof- in that case as- to inequality shal. be `the proof- in the remaining cases, so the rest should go in quite fast. The customary charge for legal service in this area is $1.5.00 per hour for office work and $150.00 per day for trial work. I am submitting a bill for $1,2:00.00 for all services to date which is on the basis of $10.00 per hour and $100.00 per day for trial work. I do quite a bit of trial work for Niagara Mohawk Power Corporation which pays $150.00 per day. I trust that, my 'bill will be satisfactory to you and the Town Board. Yours very truly, ' Albert E. WHEREAS, a map, plan and report. have been prepared, in such maanner. and in such detail as has heretofore been de- termined by the Town Board of. the Town of Queensbpry relating to the establishment of 'Extension No. 7 to the existing North Glens Falls- Water District in the Montray Heights area of the Town of Queensbury, and WHEREAS,the .map, plan. and report. have been. duly filed in the office� of the 'Down Clerk of said Town, and, WHEREAS, §Aid i , Milan and report were prepared by Joseph A, Restner, a compe.tent engineer duly licensed by the State of 'New York, showing the boundaries., of the proposed ex- tension and a general plan of the proposed extension and a report on the proposed method of operation and other pertinent facts relating thereto, and WHEREAS, the boundaries of the proposed Extension No. 7 to the North Glens Falls Water District are as follows: BEGINNING at a point in the present northerly bounds of North Glens Falls Water .District at the southwesterly corner of lot 74, Montray Heights; running from thence in a northly direction along the westerly bounds of lots 74,73*72v71,70,6,9„68,6:7, 66 and '65 to the northwesterly corner of lot 65 thence iunnimg ,in, an easterly direction along the ` northerly bounds of lot 65 to a point in the the bounds of Montray Road; thence running in a north- easterly direction, crossing .Montray Road, to a point on the easterly bounds of the said road it the north-- easterly corner of lot 137, Montray Heights; thence running in an' easterly direction along the.northerly hounds of said lot: 137 to a point in tie easterly bounds. of Montray Heights at the northeasterly corner of lot 137; thence running in a southerly direction. 157 Establishment of Extension No. 7 (continued) along the easterly bounds of .lots 137,136,135,134, Montray Heights and a portion` of the easterly bounds of lot 26, Edwin R. Winchip Development to a point at the northeasterly corner of the North Glens Falls Water District; thence running in &. westerly direction along the northperly bounds of the present North Glens Falls Water District to the point and place of be- ginning. and WHEREAS, the improvement proposed consists of laying an 8 inch main along Montray Road, and' the estimated total cost of the improvement, including engineering and legal services, is the sum of $5,400.00', and WHEREAS, the"° proposed method of financing the cost of said improvement consists of the issuance of serial bonds of said Town of Queensbury to mature in annual installments over , a period not exceeding thirty years, payable in the first in- stance from an ad valorem tax levied on all taxable real prop- erty in the proposed extension,. and WHEREAS, said map, plan and report describing the proposed extension and improvement therein are on file in the Town Clerk's office for public inspection, NOW, on motion of Councilman Harold Akins,, and seconded by Councilman,: Curtis Lampoon, it is hereby ORDERED, that the Town Board of the Town of Queens- bury shall hold a public hearing at the Queensbury. Public School. on Aviation Road in said Town on the 28th day of June, 1962, at 9:30 o'clock P. M. (D.S.T.) on that day to consider said map,,. plan and report and to hear all persons interested in the subject thereof concerning the samme, and to take such action thereon as is required or authorised by law. The adoption of the foregoing order was duly put to a vote, and upon roll call, the vote was as follows: r John O. Webster, Supervisor Yes Harold C. Akins, Councilman Yes N. Harwood Beaty, Councilman Yes Curtis Lampoon, Councilman Yes Theodore Turner, Councilman Yes The order was thereupon declared duly adopted. Mr. Webster, presented a map of a section of land which could be #sable for cemetery purposes. If the' land can be purchased same would-be utilized for additional eemetery use at a later date. The purchase price which was discussed at this time was $6000.00. Futther discussion to do with the ultimate sale of the Pine View Cemetery frontage on Route 9 was discussed at this time. t The Schedule of Audits for the Town of Queensbury,, N.Y. for the month of June, 1962, was examined and approved by. the Board. RESOLUTION NO. 9 introduced by W. Akins seconded by Mr: Beaty. RESOLVED, that the March 8, 1962' Audit of Claims as listed in ' Abstract #62-6 containing claims numbered 330 through 412 im- elusive and totaling $31,249.92 is hereby approved.
