The Budgets were read by the Clerk. Mr. Webster, explained at length the intentions of the Town Board in the proposed improvement of the sewer system in Reservoir Park Sewer District. Mr, Joseph Kestner the engineer discussed the findings in the sewer system. The original sewer-tank will be utilized in the proposed remodeling of the system. A letter was read from a resident of the Broadacres Drainage District as follows: 77 Dixon Road, Glens Falls, N. Y. October 11, L962 Town Beard Town of Queensbury, N. Y. Dear Sirs: We live on the corner of Dixon Road and Bullard Ave. , for the past eight years we have been paying a drainage tax on this land. We have received very little benefit from this .system. I think it ,is about time you did something about it. Not only do I get water in my cellar from the spring thaw, hart now with all the fall rain we have had, myy, cess- poolswill not function properly. This is all due to the abscence of one piece of Pipe which connects Dixon Road to the middle of Bullard Avenue. This pipe should have been installed when the system was first put in . It was stated that the ,area of the Town of Queensbury is eligable for Federal Aid in the installation of the Water Supply System as planned. A special meeting was arranbed with Mr. Kestner for Friday, October 19, 1962. , A discussion on the objection of Mr. Mark Doyle to do with the laying of water mains on Glenwood Avenue and Country Club Road was aired at this time. Following discussion on the proposed truck bids by Mr. Corlew and Mr. Codner, it was agreed by Mr. Codner, Superintendent of Highways that the bid of Carswell Motors, Inc. should be accepted. Mr. Ball stated that the deeds for the 13 foot road on Birch Lane, was ready to be presented to the board at this tides. ' Mr. Codner, recommended that the road ,should be accepted. WARREN COUNTY, NEW YORK, IN THE AMOUNT OF $25,000.00, TO PAY THE COST OF IMPROVEMENTS IN EXTENSIONS NOS. 1, 7 and 8 TO NORTH GLENS FALLS WATER DISTRICT. RESOLVED this 11th day of October, 1962, by the Town Board of the Town of Queensbury, Warren County, New York, as follows: Section 1. The laying of water mains and providing connec- tions thereto with the necessary hydrants, valves and fittings 1 in Extensions Nos. 1, 7 and 8 to the North Glens Falls Water District are hereby authorized. For the purpose of providing funds to pay the cost thereof, a capital note of the Town of Queensbury, Warren County,,, New York, in the amount of $25,000.00 to be of the terms, farm and contents hereinafter specified shall be issued by the Town of Queensbury pursuant to the provisions of the Local. Except as herein specifically provided; said note shall be of the terms, form, contents and place of payment . as shall be determined by the Supervisor, consistent , however, with the provisions of, the Local Finance Law of the State of New York, and that said note shall mature and be paid in full within one year from the date of this resolution,, and shall bear interest at, a rate not to exceed three and one half .per centum (3'%) per annum Section 6. The seller represents that the Town Board of the Town of Queensbury duly adopted a resolution, subject toper- missive referendum, on the 20th day of September, 1.962 authorizing the sale by the seller to the purchaser of the said real property for said price and that notice of the adoption of said resolution has been duly published and posted in accordancie 'with the prov- isions of the Town Law. If no petition shall be filed, As provided by the Town Law, said resolution. shall `take effect thirty days. after the date of its adoption. If a petition shall be filed within the time limited by law and in much form and with a suff- icient number of signatures thereon to require a referendum on the prroposition of the sale of the' said real �property by the seller to the purchaffier for the aforesaid price, the seller agrees to submit such proposition to the qualified voters of the Town ofQueensbury at a special election to be held not later than thirty days after the date of the filing of such petition. A condition of this purchase agreement is that id a referendum shall be required on the proposition on the sale of said real property to the purchaser for said purchase price and such proposition .shall be defeated at the special election on such proposition, then this purchase agreement shall be null, void and without effect and the seller shall forthwith refund to the purchaser any and all moneys paid under and by the terms of this agreement, "and neither patty shall be further liable to the other by reason of the making of this agreement. Another condition of this§ agreement is that the principal tenant of the purchaser or its assigns shall be ,Nbntgomery Ward & Co. 30. (b) that there is not now in force in the Town of .Queensbury aiLy zoning ordinance or other ordinance whtdh will in any way prohibit or restrict the use of said real property for business or commercial uses (c) that the` Town Board of the Town of Queens- bury will not hereafter adopt any zoning ordinance or other ordinanc which will prohibit or restrict in any way the use of said rea� property by the purchaser or its assigns for business or commercial use. 6. The aforesaid real property is bounded on the south by the highway limits of the county road known as Quaker Road. The purchaser has been advised by the seller that it is contemplated eventually a second lane of Quaker Road will- be constructed northerly of the existing Quaker Road either by the County of Warren or by the State of New York. Mr. Joseph Kestner,e Jr., the engineer employed by the Town of Queensbury, on Sewer and Water system projects was present. Mr. Wo-bster, presented and discussed the bills for the total cost of Ext. #6, of the North Glens Falls Water District. This extension was planned with the sole purpose of supplying water for Mr. Edward Smith in the construction of a "'Florist Shop." The cost of said installation is to be borne by Mr. Smith. Following discussion it was agreed by all members of the board, that the amount of said bill should be $603.75. This amount will be paid to the Town of Queensbury. t
