Dear Bob: I have your letter regarding the Community Workshop sign and the new application. I agree that Malcolm' s letter does not tell you very much about where the sign is but, in any event, the ordinance is clear that the sign must be on the property being advertised (Section 5 . 100( 1 ) ) . It would seem, from the correspon- dence, that the present Community Workshop sign is not on their property but may be in the easement. The property line for set back purposes means fee ownership not merely an easement, so that that would come into play here with respect to the location of the sign. Also, it is the burden of the applicant to prove the ownership of its property, together with the location of the sign. In this instance, before the application is approved, if there is a question of location or ownership, that should be cleared up. It may be that the sign is not on the workshop premises and is not authorized. If they don' t have any other place for it, it may be that they will need a variance. It would be my position, however, that even though this is a charitable institution its compliance with the ordinance would be the same as any other business entity. INVITATION FOR QUOTATIONS Sealed Quotations for site improvements at the Community Workshop, Inc. will be received by Morse Engineering at their offices at 99 Lower Dix Avenue, Glens Falls, New York, until 2:00 PM on Friday, October 2, 1987, at which time they will be opened and read. The proposed work shall consist of the following: Installation of concrete curbs and sidewalks, storm drainage, asphalt concrete pavement, entrance sign, landscaping items and various removals. All work shall be performed in accordance with the drawings, specifications and other documents prepared by Morse Engineering, 99 Lower Dix Avenue, Glens Falls, New York 12801. The Owner reserves the right to waive any informalities and reject any and all quotations. • SCOPE OF WORK The work shall consist of, but not be limited to, the following major items: (a) Unclassified excavation (b) Dispose of any removed materials. (c) Installation of concrete curbs and sidewalk. (d) Asphalt concrete pavement. (e) Place topsoil and seed. (f) Install shrubs and trees. (g) Subbase material. (h) Tree and chain link fence removal. "Contract" the Agreement or Contract between the Owner and the Contractor for the performance by the Contractor of services described herein. These specifications or the applicable portions thereof are a part of the Contract. "Contractor" shall mean the person, persons, or corporation which has executed the Contract with the Owner for the proposed work. "Owner" shall mean the Community Workshop, Inc. "Engineer" shall mean the firm of Morse Engineering, . . Consulting Engineers, or its authorized representative. "Inspector" shall mean the authorized representative of the Owner or Engineer assigned to the inspection of work and materials. Authority and Duties of the Engineer All work shall be performed to the satisfaction of the Engineer and the Owner at such time and places, by such methods and in such manner and sequence as he may require, and shall at all stages be subject to his inspection. Upon request of the Contractor, the Engineer will confirm in writing any oral order, direction or requirement. Injury to Persons or Property The Contractor shall be responsible for all injury to persons, or damage to property, either directly or indirectly, that may result from his operation. PERFORMANCE CONTRACT BOND AND PAYMENT BOND The Contractor, at the time of the execution of the Contract, must deposit with the Engineer a surety company bond for the satisfactory completion of the work and a surety company bond for the payment of all debts pertaining to materials, rental of equipment, and labor used or employed in the execution of the Contract. These bonds shall each be• in an amount equal to the amount of the Contract award. 1 The surety must be a corporate surety licensed to sign surety bonds in the State of New York and also listed by the United States Treasury Department in its latest list as a qualified surety acceptable to the United States Government. INSURANCE The Contractor shall furnish to the Engineer, prior to the commencement of any work, satisfactory proof that all provisions, herewith specified, relating to the Contractor's insurance have fully been complied with. CONTRACT NOT TO BE SUBLET OR ASSIGNED WITHOUT APPROVAL The Contractor shall give his personal attention constantly to the faithful prosecution of the work. He shall not assign, transfer, convey, sublet or otherwise dispose of the Contract, or his right, title or interest in or to the same or any part thereof without the previous consent in writing of the Engineer. Each proposed subcontractor shall file with the Engineer triplicate copies of a form to be furnished by the Engineer attesting to his knowledge of the provisions of the Contract and his Agreement thereto. ACCIDENTS AND INSURANCE The Contractor shall carry compensation insurance covering employer's liability in a manner approved by. the Engineer. The Contractor shall assume full responsibility for the safety of his employees, injury to others, and property damage. The Contractor must promptly report in writing to the Engineer and Owner all accidents whatsoever, arising out of or in connection with the performance of the work, whether on or adjacent to the site, which cause death, personal injury, or property damage, giving full details and statements of witnesses. In addition, if death or serious injuries or serious damages are caused, the accident shall be reported immediately by telephone to the Engineer. If any claim is made by any third person against the Contractor or any subcontractor on account of any accident, the Contractor shall promptly report the fact in writing to the Engineer and Owner giving full details of the claim. 2 • WORKMEN'S COMPENSATION AND LIABILITY INSURANCE The Contractor agrees to procure and maintain at his own expense until final acceptance by the Owner of the services covered by this Agreement, insurance of the kinds and in the amounts hereinafter provided in insurance companies authorized to do business in the State of New York, covering all operations under this Agreement whether performed by him or by subcontractors. Before commencing the work the Contractor shall furnish to the Engineer and Owner a certificate or certificates in form satisfactory to the Engineer, showing that he has complied with this article, which certificate or certificates shall provide that the policies shall not be changed, or cancelled until thirty days' written notice has been given to the Engineer. The kinds and amounts of insurance required are as follows: a. Policy or policies covering the obligations of the Contractor in accordance with the provisions of Chapter 41, Laws of 1914, as amended, known as the Workmen's Compensation Law, and amendments. .This agreement shall be void and of no effect unless the Contractor procures such policy or policies and maintains it until acceptance of the work. b. Policies of bodily injury liability and property damage liability insurance of the types hereinafter specified, each with limits of liability of not less than $300,000 for all damages arising out of bodily injury, including death at any time resulting therefrom, sustained by one person in any one accident and, subject to that limit for each person, not less than $500,000 for all damages arising out of bodily injury, including death at any time resulting therefrom, sustained by two or more persons in any one accident, and not less than $300,000 for all damages arising out of injury to or destruction of property in any one accident and, subject to that limit per accident, not less than $500,000 for all damages arising out of injury. to or destruction of property during the policy period. 1. Protective Liability Insurance issued to and covering the liability of the Engineer and the Owner and all their employees or agents with respect to all operations under this agreement by the Contractor including omissions and supervisory acts of the Engineer or the Owner and their employees. 3 LAWS TO BE ENFORCED The Contractor at all times shall observe and comply with all State Laws and Local By-Laws, ordinances and regulations in any manner affecting the conduct of the work or applying to employees on the project, as well as all orders or decrees which have been promulgated or enacted, by any legal bodies or tribunals having authority or jurisdiction over the work, materials, employees or contract. DAMAGE TO PROPERTY The Contractor shall obtain all necessary permits and licenses at his own expense from the authorities having jurisdiction and shall comply with all local ordinances of the city, town, or village in which the work is being done. The Contractor shall be responsible for carrying out the work in accordance with the provision of all permits. The Contractor may occupy during his operations only those portions of streets or public places for which the required permits have been obtained by him. If the Contractor desires to use additional areas outside of those required for the construction, he shall arrange for such areas at his own expense. The Contractor shall take every precaution against injuring paving, utilities or private properties and shall promptly repair at his own expense any damage to such paving, utilities or private property to the satisfaction of the Engineer. The requirement includes the filling of all holes and the resodding of any areas where the grass is damaged. Any abutting property which is damaged as the result of the Contractor's operations shall be repaired at the Contractor's expense to the satisfaction of the Engineer. The location of all stationary and mobile equipment shall be subject to the approval of the Engineer and upon the completion of the Contractor's operations at each site he shall remove equipment therefrom and shall clear the area of all debris and restore it to the condition existing before the start of his operations. The Contractor shall carry on his operations with a minimum of interference or delay to traffic. The Contractor shall furnish all labor, materials, watchmen, barricades, signs, lights and any additional expenditures necessary to maintain traffic, to protect his work and the public during the operations and to 4 comply with all orders of the Engineer and all other agencies having jurisdiction when applicable. The cost of this work shall be included in the Lump Sum Price. The Contractor is cautioned that there shall be no entry of his equipment or personnel upon private property without first informing the property owner of his intent and purpose, and attempting to secure the written permission of the property owner to perform work under this Contract on such property. He shall, at all times, carry out his operation so as to inconvenience no resident at or near the working area. The Contractor shall make clear to all his personnel the importance of proper relations. The Engineer and Owner will not condone any rude or inconsiderate treatment of any persons by personnel employed on this project. The Engineer reserves the right to require the removal from the work of any person or persons employed by the Contractor who has violated this section of the specifications, and such person or persons shall not be employed again thereon without the written consent of the Engineer. CLEANING UP At no time is the Contractor to leave any litter. After completing the work, the Contractor shall, promptly remove all plant and other materials brought by him to the site and restore the site as nearly as possible to its original condition. NON-LIABILITY OF ENGINEER'S OR OWNER'S REPRESENTATIVES No officer, agent or employee of the Engineer or the Owner shall be charged personally by the Contractor with any liability to him under any term or provision of this Contract or because of its execution or attempted execution, or because of any breach thereof. PROTECTION AND RESTORATION OF PROPERTY The Contractor shall use suitable precautions to prevent damage to pipes, conduits, and other underground structures. His attention is called to the various public or private services which include but are not limited to: water, sewer and drainage pipes, springs and their sources, wells, septic tanks, and cess . pools, telephone and electrical services, etc., that may be: located on or adjacent to the project above, on or under the ground, and whether shown on the plans or not. He shall take proper precaution during construction to avoid damage to said public or private services as it is necessary that these services be maintained. 5 TIME SCHEDULE The Contractor, as stated in agreement, shall begin the work to be performed under the contract,.within 10 days of the date set by the Engineer in the written notice to proceed. The Contractor shall notify the Engineer at least 24 hours in advance of the time he intends to start and shall present to him for approval a written progress schedule consisting of forecasted dates and methods for carrying out each phase of the work to be performed. Consideration should be given to scheduling grading and paving operations early during a given week to avoid conflict with increased build-up of traffic entering the area. No work operations are to be performed on Saturday or Sunday without • prior approval. The Contractor shall conduct the work in such a manner and with sufficient materials, equipment and labor as is considered necessary to insure its completion within the time limit set forth in the agreement. Should the prosecution of work for any reason be discontinued by the Contractor with the consent of the Engineer, he shall notify the Engineer at least 24 hours in advance of resuming operations. CONTROLS The Contractor's attention is called to reference points on the plans which are to be used to establish the alignment and grade as shown. This work is subject to the check and correction by the Engineer. UTILITIES Extreme care must be exercised to avoid damage to an existing gas main running somewhat parallel to the roadway section at an unknown distance and depth from the edge of pavement. Any damage to this utility during construction will be repaired at the Contractor 's expense. INSURANCE The Contractor shall furnish the Owner with a Performance Bond and Payment Bond in the amount covering the full cost of this contract. The responsibility for complete payment of the premium shall rest with the Contractor. Other insurance certificates to be furnished to the Owner and the Engineer by the Contractor shall include: Type Amount Public Liability $ 1,000,000 Property Damage $ 100,000 Workmen's Compensation State Requirements Bodily Injury $ 1,000,000 6 INSPECTION OF WORK The Engineer will inspect any and all operations of the Contractor at any time and for any reasonable duration. ' . The Engineer should he feel that the work or materials are not in accordance with the plans and specifications or are not proceeding in a workmanlike manner shall notify the Owner to terminate the contract until such work and materials meets with the plans and specifications. The Engineer also reserves the right at any time including when all work is completed to cut test holes (not to exceed 4" dia. or 10 holes) to check the thickness of material furnished. The Contractor shall repair these areas at his expense and to the satisfaction of the Engineer. AGREEMENT BETWEEN CONTRACTOR AND OWNER SITE IMPROVEMENTS AT THE COMMUNITY WORKSHOP, INC. THIS AGREEMENT, entered into this day of 19 , by hereinafter referred to as the "Contractor" , and Community Work- shop, Inc. , hereinafter referred to as the "Owner" . WITNESSETH, that the Owner and the Contractor, for the consideration hereinafter named, agree as follows: ARTICLE 1. WORK TO BE DONE. The Contractor shall furnish all the materials, appliances, tools and labor of every kind required, and construct and complete in the most substantial and workmanlike manner, the site improvements as per plans and .specifications prepared by Morse Engineering, and pertinent addendum which contain general specifications for the contract and materials of construction required by the Contract as defined herein. ARTICLE 2. DOCUMENTS FORMING THE CONTRACT. The Contract (and Contract Documents) shall be deemed to include the Request for Quotations; the Contractor's quotation; the agreement; the specifications referred to above; the plans; any addenda to specifications if the same are issued prior to the date of receipt of quotations and all provisions required. by law to be inserted in the contract whether actually inserted or not. ARTICLE 3. EXAMINATION OF DOCUMENTS AND SITE. The Contractor agrees that before signing the agreement he. carefully examined the Contract Documents, together with the site of the proposed work, as well as its surrounding territory, and is fully informed regarding all of the conditions affecting the 8 1 , work to be done and labor and materials to be furnished for the completion of this contract, including the existence of poles, wires, pipes and other facilities and structures of municipal and other public service corporations on., over or under the site, and that his information was secured by personal investigation and research and that he will make no claim against the Owner or Engineer by reason of estimates, tests or representatives of any officer or agent of the Community Workshop, Inc. or Morse Engineering, Consulting Engineers. ARTICLE 4. DATE OF START AND COMPLETION. The Contractor further agrees that he will begin the work herein embraced within ten days of the effective date hereof, unless the consent of the Owner, in writing, is given to begin at a later date, and that he will prosecute the same so that it shall be entirely completed and performed within 60 continuous calendar days. No extension beyond the date of completion fixed by the terms of this contract shall be effective unless in writing signed by the Owner. Such extension shall be for such time - and -upon such terms and conditions as shall be fixed by the Owneror Engineer. Notice of application for such extension shall be filed with the Owner and Engineer at least five days prior to thedate of completion fixed by the terms of this agreement. ARTICLE 5. ALTERATIONS AND OMISSIONS. The said work shall be performed in accordance with the true intent and meaning of the Contract Documents without- any further expense of any nature whatsoever to the Owner other than the consideration named in this agreement. The Owner reserves the right, at any time- during the progress of the work, to alter the plans or omit any portion of the work as it may deem reasonably necessary for their interest; making allowances for additions and deductions in the lump sum proposal, for this work without constituting grounds for any claim by the contractor for allowance for damages or for loss- of anticipated- profits, or for any variations between the approximate quantities and the quantities of the work as done. 9 ARTICLE 6. NO COLLUSION OR FRAUD. The Contractor hereby agrees that the only person or persons interested as principal or principals in the quotation submitted by the Contractor for this contract are named therein, and that no person other than those mentioned therein has any interest in the above-mentioned quotation or in the securing of the award, and that this contract has been secured without any connection with any person or persons other than those named, and , that the quotation is in all respects fair and was prepared and the contract was secured without collusion or fraud and that neither any officer nor employee of the Community Workshop, Inc. and Morse Engineering has or shall have a financial interest in the performance of the contract or in the supplies, work or business to which it relates, or in any portion of the profits thereof. ARTICLE 7. PAYMENT OF ESTIMATES. As the work progresses in accordance with the contract and in a manner that is satisfactory to the Owner and Engineer, the Owner hereby agrees to make payments to the Contractor therefor, based upon the quotation attached hereto and made a part hereof, as follows: The Owner shall, on such days as it may fix, make an estimate of the quantity of work done and of material which has actually been put in place in accordance with the terms and conditions of the contract and compute the value thereof and pay to the Contractor the moneys due. No monthly estimate shall be rendered unless the value of the work done equals 5% of the contract amount or $1,000, whichever is the lesser. Semi-monthly estimates may be rendered provided the percentage of the work performed is in agreement with percentage determined by the Engineer. ARTICLE 8. NO ESTIMATE ON CONTRACTOR'S NON-COMPLIANCE. It is further agreed that so long as any lawful or proper direction concerning the work or material given by the Community Workshop, Inc. and Morse Engineering or their representative, shall remain uncomplied with, the Contractor shall not be entitled to have any estimate made for the purpose of payment, nor shall any estimate be rendered on account of work done or material furnished until such lawful or proper direction . aforesaid has been fully and satisfactorily complied with. 10 ARTICLE 9. FINAL ACCEPTANCE OF WORK. When in the opinion of the Engineer the Contractor has fully performed the work under the contract, the Engineer shall recommend to the Owner the acceptance of the work so completed. If the. Owner accepts the recommendation of the Engineer, he shall thereupon by letter notify the Contractor of such acceptance, and copies of such acceptance shall be sent to other interested parties. ARTICLE 10. FINAL PAYMENT. After the final acceptance of the work, the Engineer shall compute the value of such work under and according to the terms of the contract. This estimate shall be certified to as to its correctness by the Engineer. The right, however, is hereby. reserved to the Engineer to reject the whole or any portion of the final estimate, should the said certificate of the Engineer be found or known to be inconsistent with the terms of the agreement or otherwise improperly given. All certificates upon which partial payments may have been made being merely estimates, shall be subject to correction in the final certificate or estimate. Final payment shall be due '60 days after completion of the work provided the work be then fully completed and the contract fully performed. ARTICLE 11. RIGHT TO SUSPEND WORK AND CANCEL CONTRACT. It is further mutually agreed that if at any time during the prosecution of the work the Engineer determines that the work upon the contract is not being performed according to the contract, or for the best interests of the Owner, the execution of the work by the Contractor may be temporarily suspended by the Engineer, or the Engineer or Owner may terminate the Contractor's employment under the contract while it is in progress, and thereupon proceed with the work, in affirmance of the contract, by contract negotiated or publicly let, by the use of his own forces, by calling upon the surety to complete the work in accordance with the plans and specifications or by a combination of any such methods; or he may cancel the contract and readvertise. Any excess in the cost of completing the contract beyond the price for which it was originally awarded shall be charged to and paid by the Contractor failing to perform the work or his surety. 11 Whenever the Owner or Engineer determines to suspend or stop work under the contract, a written notice sent by mail to the Contractor at his address and to the sureties at their respective addresses, shall be sufficient notice of its action in the premises. ARTICLE 12. DETERMINATION AS TO VARIANCES. In case of any ambiguity in the plans, specifications or maps, or between any of them, the matter must be immediately submitted to the Engineer, who shall adjust the same, and his decision in relation thereto shall be final and conclusive upon the parties. ARTICLE 13. REMOVAL OF REJECTED WORK AND MATERIAL. The Contractor agrees that all work or material which may be rejected by the Engineer or its representatives shall be at once removed from the site of the work by the Contractor at his own expense, and replaced by work or material satisfactory to the Engineer. ARTICLE 14. SUCCESSORS AND ASSIGNS. This agreement shall bind the successors, assigns and representatives of the parties hereto. ARTICLE 15. CONTRACT AMOUNT. It shall be understood that if an estimate of quantities is furnished to the Contractor by the Engineer, they are given in good faith and were figured from the best information available. However, they are for convenience only and are not to be construed to be accurate or the actual quantities necessary to complete the project. .This is a lump sum contract and all materials and work necessary for completion according to the plans and specifications to the satisfaction of the Engineer will be furnished under this amount. No overpayment will be allowed except in the case of an authorized written request by the Owner or Engineer for additional work not covered by the plans or specifications. 12 ARTICLE 16. CONTRACT SUM The Owner shall pay the Contractor for the performance of the contract, subject to additions and deductions provided herein, in current funds as follows: as a Lump Sum contract. PROVISIONS 1. 01 GOVERNING SPECIFICATIONS: The New York State Department of Transportation Specifications of January 2, 1985, with current modifications and addenda shall apply for all referenced contract items except as modified herein. All reference made to titles and departments of the New York State Department of Transportation shall apply to the Community Workshop, Inc., or their duly authorized representative. The methods of measurement and the basis of payments stated for the specified items shall not apply except for determination of Change of Contract Price Authorized by Change Order. Copies of the New York State Department of Transportation Specifications of. January 2, 1985, with current modifications and addenda may be obtained at the New York State Department of Transportation Administration and Engineering Building, State Campus, 1220 Washington Avenue, Albany, New York 12226. 1.02 BURNING: In accordance with the Public Health Law, no open burning whatever will be permitted within or adjacent to the limits of the Project. 1.03 CONCRETE SOURCE: The Contractor shall specify the supplier of concrete prior to commencement of the work. All concrete incorporated in the project shall be from a New York State Department of Transportation approved source. 1.04 ASPHALT CONCRETE: The Contractor shall specify the supplier of asphalt concrete prior to commencement of the work. All asphalt concrete incorporated in the project shall be from a New ' York State Department of Transportation approved source. 1 1.05 UTILITY COORDINATION: The Contractor shall be solely responsible for the coordination of his work and that of any affected utility including, but not limited to, Niagara Mohawk Power Corporation, New York Telephone Company and Glens Falls Cablevision. Any delay by utility forces, whether anticipated or actual, shall be considered in the Contractor's schedule of work and shall not be considered as a basis for a claim of delay of work or additional compensation. 1.06 INTERRUPTION OF WATER AND SANITARY SEWER SERVICE: It shall be the Contractor's responsibility to insure that there will be a minimum of interruption to the water and sanitary sewer services to the adjacent properties. The Contractor will insure that all adjacent properties have both utilities in full operation at the end of each work day. If the Contractor fails to meet these conditions, the Owner reserves the right to take any necessary steps to make the utility connection. The Owner will deduct the amount of expenses incurred from the amount due the Contractor plus $100 for each deficiency. 1.07 ACCESS TO ADJACENT PROPERTIES: The Contractor shall insure that there is a suitable access to all properties at the end of each work day. If it is necessary to block off the access to any property, the Contractor shall notify the affected property Owner and the Engineer. If the Contractor does leave the project at the end of the work day with the access to a property blocked, the Owner may take any necessary steps to open the access. All costs incurred by the Owner shall be deducted from the amount due the Contractor. Since there is only the single entrance to the Community Workshop, Inc. facility, the Contractor shall schedule the work to insure minimal disruption or inconvenience to their operation. The Contractor shall notify the Owner of his scheduled operation, in order for the Owner to schedule deliveries, etc. 2 SECTION 2 DETAILED TECHNICAL SPECIFICATION 2.01 UNCLASSIFIED EXCAVATION AND DISPOSAL: All of the requirements for Item 203.02, Unclassified Excavation and Disposal, of the New York State Department of Transportation Specifications of January 2, 1985, with current addenda shall apply, except as herein modified. 2.02 EMBANKMENT IN PLACE: All of the requirements for Item 203.03, Embankment in Place, of the New York State Department of Transportation Specifications of January 2, 1985, with current addenda shall apply, except as herein modified. 2.03 SCARIFY AND COMPACT SUBGRADE: The Contractor shall provide all labor, equipment and materials and perform all work necessary to scarify the roadway subgrade to a minimum depth of -six (6)- inches below the subgrade surface and compact the material in accordance with the requirements of Section 2.01 of -these specifications. All particles with a maximum dimension greater than three (3) inches shall be removed and material satisfactory to the Engineer shall be furnished and installed to replace any disposed materials. The method of measurement will be square yard of subgrade surface. 2.04 UNSUITABLE MATERIAL EXCAVATION AND BACKFILL: The Contractor shall excavate all unsuitable material such as muck, peat, clay, etc. to the dimensions defined by the Engineer, and replace the excavated material with material meeting the requirements of Item 203.07 Select Granular Fill of the New York State Department of Transportation Specifications of January 2, 1985, with current addenda and as modified herei-n. In areas of unsuitable material, the requirements of Section 2.03 will be waived. 3 2. 05 TRENCH AND CULVERT EXCAVATION: All of the requirements for Item 206.02, Trench and Culvert Excavation, of the New York State Department of Transportation Specifications of January 2, 1985, with current addenda shall apply, except as herein modified. The Contractor's attention is directed to the fact that there may be existing gas, water, and storm sewers within or near the areas to be excavated under this Section. The Contractor shall make every effort to proceed with caution where existing lines may exist and give 72 hours written notice to Niagara Mohawk Power Corporation before excavating near any gas line, and protect from any injury the existing water pipe, gas pipe and storm sewer. The Contractor is hereby notified that no blasting whatsoever will be permitted within the limits of or in conjunction with this project. The Contractor is hereby advised that he is solely responsible for keeping the trench free from water, snow and ice during the construction. At no time during the installation of the pipe shall the level of the water in the trench rise above the elevation of the invert of the pipe to be installed. In areas of unsuitable soil conditions, as determined by the Engineer, the Contractor shall furnish and install #3 crushed stone bedding material to a minimum depth of one (1) foot below the invert and to a width of two feet plus the outside diameter of the pipe. The Contractor may be required to perform dewatering and bedding. The excavated trench material may be used for backfill unless declared to be unsuitable by the Engineer. Unsuitable material such as wood, peat, muck, rock, etc. shall be removed from the site and replaced with material acceptable to the Engineer and at the Contractor's expense. Backfill material at structures, pipes and culverts shall be deposited in horizontal layers not exceeding 6 inches in thickness prior to compaction. The Engineer will conclude from visual observations that proper compaction has been attained. However, the Engineer reserves the right to perform density test at any time. A minimum of 100 percent of the Modified Proctor Maximum Density is required. Backfill around pipes shall be deposited to ' progressively bury the pipe to equal depths on both sides. 4 All the backfill and compaction requirements shall apply up to the bottom of the roadway subgrade. 2.06 FRAMES AND GRATES: All of the requirements for Item 655.01, Frames and Grates (Castings) , of the New York State Department of Transportation Specifications of January 2, 1985 with current addenda shall apply, except as herein modified. 2.07 F)OT MIX ASPHALT CONCRETE PAVEMENT: Surface Course: All the requirements for Item 403.18, Asphalt Concrete - Type 7, of the New York State Department of Transportation Specifications of January 2, 1985, with current addenda shall apply, except as herein modified. Base Course: All the requirements for Item 403.11, Asphalt Concrete - Type 1, of the New York State Department of Transportation Specifications of January 2, 1985, with current addenda shall apply, except as herein modified. 2.08 PROP INLETS: All drop inlets shall be precast concrete and shall be as manufactured by Fort Miller Company or equivalent. Dimensions shall be as detailed on the plans, or as per the manufacturer 's standards. All drop inlets shall be approved by the Engineer prior to. installation. The Contractor• shall provide all labor, materials and equipment necessary to complete the work as shown, except excavation and backfill shall be provided under Section 2. 05, Trench and Culvert Excavation. 2.09 CONCRETE SIDEWALKS: All the requirements for Item 608.0101, Concrete Sidewalks, of the New York State Department of Transportation Specifications of January 2, 1985, with current addenda shall apply, except as herein modified. The Contractor shall incorporate concrete handicapped ramps as shown on the plans in this Item. Wire mesh 6" x 6" - #6 gage shall be installed in the sidewalk and ramps: 5 ' A 2.10 ORDINARY TOPSOIL: All of the requirements for Item 613.0101, Ordinary Topsoil., of the New York State Department of Transportation Specifications of January 2, 1985, with current addenda shall apply, except as herein modified. 2.11 SEEDING. FERTILIZING AND MULCH: All of the requirements for Item 610.0201, Seeding, of the New York State Department of Transportation Specifications of January 2, 1985, with current addenda shall apply, except as herein modified. The seed mixture shall be as follows: WEIGHT OF PURE NAME VARIETY LIVE SEED Kentucky Bluegrass Commercial 25 (POA PRATENSIS) Creeping Fescue Commercial 25 (FESTUCA RUBRA) Perennial Ryegrass Commercial 10 (LOLIUM PERENNE) TOTAL 60 Seed shall be applied at the rate of 60 pounds per acre. Mulch shall be straw and applied at the rate of 2 tons per acre and secured in place with a bituminous tack coat. The fertilizer shall conform to New York State Specification Section 713.03 Type 3, 10-6-4, and be applied. at the rate of 1000 pounds per acre. 2.12 PLANTING: All of the requirements for Section 611, Planting, of the New York State Department of Transportation Specifications of January 2, 1985, with current addenda shall apply for the various varieties of planting, except as herein modified. The cost of providing and installing the wood chips and prepared backfill for planting shall be included in this item. 6 2.13 TREE REMOVAL: All of the requirements for. Item 614.03, Tree Removal, of the New York State Department of Transportation Specifications of January 2,' 1985, with current addenda shall apply, except as herein modified. Stump removal shall be included under this Section. Stump holes shall be backfilled with suitable material as specified under Section 2.01. Four inches of topsoil as specified under Section 2.10 shall be placed over the stump hole areas for establishing grass. Seeding and fertilizing areas shall be as specified under Section 2.11. 2.14 STORM SEWER PIPE: All of the requirements for Item 603.06, Corrugated Steel Pipe - Paved Invert (2-2/3 x 1/2) , of the New York State Department of Transportation Specifications of January 2, 1985, with current addenda shall apply except as herein modified. 2.15 TRAFFIC MARKINGS: • All of the requirements for Item 640.0201, Yellow Reflectorized Pavement Stripes, and Item 640.04, White Paint Reflectorized Pavement Symbols, of the New York State Department of Transportation Specifications of January 2, 1985, with current addenda shall apply, except as herein modified. A minimum of 30 days shall elapse after paving is complete before any traffic paint is applied. 2.16 MAINTENANCE AND PROTECTION OF TRAFFIC: The Contractor is placed on notice that maintenance and protection of traffic is considered as important as the . .. construction itself. The Contractor shall, therefore, at all times conduct his operations in a manner to insure the convenience of the motorist, the pedestrian and the abutting property owners and their safety as well as the safety of his own employees. The Contractor shall be responsible for maintenance of traffic throughout the duration and length of the project. 7 c All of the requirements of Item 619.01, Basic Maintenance and. Protection of Traffic, of the New York State Department of Transportation Specifications of January 2, 1985, with current addenda shall apply, except as herein modified. The Engineer will have the final decision as to the acceptability of the maintenance protection of traffic. However, this in no way relieves the Contractor of his responsibilities under the terms of the Contract and this item. If the Engineer determines that the maintenance and protection of traffic is unsatisfactory in any respect, he shall immediately notify the Contractor in writing of the deficiency. If at the end of the first 24 hou.r period or any time thereafter, the Contractor has failed to satisfactorily correct the situation, the Owner may correct the adverse condition by any means he deems appropriate, and shall deduct the cost of the corrective work from any monies due the Contractor. The cost of this work shall be in addition to the deduction listed above. 2.17 MOBILIZATION: All the requirements of Item 699.01, Mobilization, of the New York State Department of Transportation Specifications of January 2, 1985, with current addenda shall apply, except as herein modified. 2.18 CONSTRUCTION SURVEY: The Contractor shall, based on information provided by the Owner, provide all labor, materials and equipment to develop and make all detailed surveys necessary for construction including, but not limited to, slope stakes, batter boards, and other working points, lines and elevations. The Contractor shall carefully preserve bench marks, reference points and stakes, and, in the case of destruction thereof by the Contractor or resulting from his negligence, the Contractor shall be charged with the expense and damage resulting therefrom and shall be responsible for any errors that may be caused by the loss or disturbance of such bench marks, reference points and stakes. 8 a 2.19 TRAFFIC SIGNS: Description: Under this work the Contractor shall furnish and install traffic signs and their appurtenances, in accordance with Section 645, Guide Signs, Traffic Signs and Special Devices, of the New York State Department of Transportation Specifications of January 2, 1985, with current addenda, except as herein modified. Materials: All materials 'shall be as specified or as shown on the Plans, Standard Structure Sheets, or as specified herein. All materials used in signs,_ including supports and foundations, shall be subject to the inspection and/or certification for like materials as required by the . . . Department of Transportation Specifications, or as herein specified. Component sizes given are nominal dimensions and are subject to standard mill tolerances. Panels for guide signs shall be aluminum alloy of 0.125 inch thickness. Panels for traffic signs shall be aluminum alloy of 0.100 inch thickness. Posts for both guide and traffic signs shall be steel as manufactured by the Franklin Steel Division of the Borg- Warner Corporation or approved equal. 2.20 CHAIN LINK FENCE REMOVAL: Under this Item, the Contractor shall remove the existing chain link fencing to the limits shown on the plans. The removal shall include all fence fabric, posts, concrete bases, barbed wired, etc., which are part of the fence. The Contractor shall be careful not to-damage the fence parts and deliver all salvagable material to Haber's Export Agencies, Inc., 38 Everts Avenue, Glens Falls, New York. 2.21 COECRETE CURB: All of the requirements for Item 609.04,. Concrete Curb (Types AB, AC, BB, BC & as indicated) , of the New York State Department of Transportation Specifications of January 2, 1985, with current addenda shall apply, except as modified herein. 9 I 2.22 PRECAST CONCRETE CURB (ALTERNATE) : All of the requirements of Item 609.08, Precast Concrete Curb (Types A, B, C, D and as. indicated) , of the New York State Department of Transportation Specifications of January 2, 1985, with current addenda shall apply, except as modified herein. 2.23 SUBBASE COURSE: All of the requirements of Item 304.05, Subbase Course, Type 4, of the New York State Department of Transportation Specifications of January 2, 1985, with current addenda shall apply, except as modified herein. 2.24 PAVEMENT REMOVAL AND REPLACEMENT: The Contractor, in areas of trench excavation and installation of curb and sidewalk, shall remove the existing pavement in accordance with the details, shown on the plans. All uneven edges shall be saw cut to provide a straight line and a tack coat applied prior to repaving. 2.25 PLANTER AND SIGN: The Contractor, as part of this Item, shall remove the existing sign and store the parts in an area designated by the Owner and disconnect the existing electrical service. The new sign and planter shall be constructed in accordance with the details shown on the plans. The sign shall be of the type manufactured by R.D. Wheeler, Custom Signs, or equal. The, Contractor shall submit details of the new sign for approval prior to installation. All electrical work shall be in accordance with the National Electric Code. The proposed light fixtures shall be Holophane PANL 100 MV, 12, STD, W.G. or equal, one installed on each side of the sign. 10 SECTION 3 SPECIAL TECHNICAL SPECIFICATIONS 3.01 GENERAL: The Contractor shall be aware that the underground conditions and utilities as shown are based- on limited investigation. The necessity for some field revisions of line and grade is anticipatedand such will be furnished by the Engineer as quickly as possible. The Contractor shall check for correct elevation and position all proposed and existing manhole covers, grates and similar structures located within areas- to be paved or surfaced and make, or have made, any necessary adjustments in such structures as required to guarantee a' top surface that is flush with surrounding surfaces or as shown on the plans. The Contractor shall be aware that other Contractors and Utility Corporations ' may be involved in construction; therefore,- the Contractor shall make every effort to coordinate these operations with his' -own- in a' sequence approved by the Engineer. The Contractor shall be responsible for maintaining and protecting' existing services within the project area unless such responsibility is waived through written approval of the affected area. The Contractor's attention is invited to Chapter 731 of the Laws of 1953, as amended Chapter 829 of the Laws of 1957 adding Section 1918 to the Penal Law requ•ir-ing-72 - hours advance notice in writing to anyone engaged in the distribution of gas before' excavation in- any street,. highway or public place where gas lines exist.""Copies-'of.- such notification will be forwarded to the Engineer within eight (8) hours of original transmittal. 3.02 .EOUIPMENT ACID MATERIAL STORAGE: The Contractor shall make necessary provisions for equip- ment and material storage in an area acceptable to the Owner and Engineer. 11 • • A 3.03 SHEETING: The Contractor is reminded that sheeting may be required in the trench excavation, dependent on the excavation depths and methods, in accordance with labor and safety codes. 3. 04 DISTURBED AREAS: Any areas disturbed by the operations of the Contractor shall be restored to original condition even though the restoration is not shown or detailed on the plans. Claims for extra work for restoration of areas damaged by the operations of the Contractor will be rejected. Restoration shall include, but is not limited, to the following: Grassed Areas: Provide a minimum of 4" topsoil, fertilize, seed and mulch. Asphalt: Saw cut to eliminate uneven edges, restore existing subgrade surface, thoroughly compact and replace with Item 2.07, hot mix asphalt concrete pavement, surface course, of these specifications to the existing pavement depth or a minimum depth of six (6) inches, whichever is greater, four inches of base course and two inches of top course. Concrete: Saw cut or break at joint to eliminate. ragged edge, restore existing subgrade surface, thoroughly compact and replace with concrete pavement, and metal reinforcement for concrete pavement of these specifications to the existing pavement depth or a minimum depth of eight (8) inches, whichever is greater. 3.05 ADJACENT PROPERTIES: The Contractor shall secure written permission from all adjacent property owners to enter onto their respective properties. A copy of the written permission shall be delivered to the Engineer before any work begins on the Project. All costs incurred resulting from obtaining permission or the delays therefore shall be the Contractor's responsibility and will not be used as a basis of a claim against the Owner or Engineer. The written permission does not relieve the Contractor of his responsibilities under the terms of the Contract. 12 • 3.06 DISPOSAL OF WASTE MATERIALS: It shall be the responsibility of the Contractor to dis- pose of all waste materials off site. 3. 07 PLACEMENT OF EXCAVATED MATERIAL: Excavated material may be placed adjacent to the trench provided that at least one=way traffic is maintained at all times. 3. 08 WATER VALVES: The top of all affected water valves within the construc- tion limits shall be adjusted to finish grade of the adjacent pavement. 3. 09 MATERIALS STORED ON SITE: Description: Payment will be allowed for the following materials delivered at the project site in approved condition. The Engineer shall be the sole judge of an approved condition. Material Item Reference Frames and Grates 2. 06 Storm Sewer Pipe 2.14 Drop Inlets 2.08 Basis of Payment: The amount of progress payment shall be based_ on the invoice amount of the delivered items less ten percent (10%) retainage up to the quantity incorporated in the work or shown in the Engineer's estimate of quantities, whichever is less. All invoices showing amounts due for each item of material plus all required material certification must be received and approved by the Engineer before payment will be authorized. Any material which is damaged, stolen or in any way becomes unsuitable between the time of acceptance for payment and incorporation in the work shall be replaced and/or repaired at the Contractor's expense to the satisfaction of the Engineer. 13 r 3.10 SEALANTS: The Contractor shall furnish and install a sealant conforming to the requirements of Section 705-07, Premolded Bituminous Joint Material, of the New York State Department of Transportation Specifications of January 2, 1985, with current addenda, and as shown on the plans. 14 i - . . .
