Webster Supervisor Harold Akins Justice of the Peace Curtis Lampson Councilman The Supervisor called the meeting to order at 7:30 p.m. The following persons appeared in reference to the licensing of race- tracks for go-cart racing: Walter A. Smith, Ronald L. Purdy, Sidney Timms, Al Ouderkerk. The following petition was presented which stated that "the signers thereof could find no good reason why this track should be allowed." The petition contained 77 signatures. Albert E. Beswick, County Attorney, was also present. Resolution No. 113 introduced by Mr. Akins, seconded by Mr. Lampson: WHEREAS Sidney Timms, Albert Ouderkerk, and Walter Smith have sub- - mitted an application in writing for permission to hold so-called "go- cart races" on property owned by Sidney Timms located on the Country Club Road, THEREFORE BE IT RESOLVED that a permit or license be granted to the said Sidney Timms, Albert Ouderkerk, and Walter Smith to hold racing of #82 go-carts on-property of Sidney Timms upon the following terms:' (1) The use of the racing track shall be limited only to Saturday and Sunday during daylight hours; (2) A certificate of liability insurance shall be filed with the Town Clerk covering the operators from any liability which may be occasioned by the use of said track; (3) That the operators shall in all respects comply with the ordinance relating to racing events in the -Town ,of Queensbury adopted May 10, 1952. Duly adopted by the following vote: - - Ayes - Mr. Lampson, Mr. Akins and Mr. Webster Noes - none - Resolution No. 114 introduced by-Mr. Akins, seconded by Mr. Lampson: _. REVENUE ANTICIPATION NOTE RESOLUTION OF SEPTE1,1BER-159 19600 OF THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW-YORK, IN THE AMOUNT OF $1,500.00. - BE IT-RESOLVED, this 15th day of September, 1960, by the Town Board of the Town-of Queensbury, Warren-County, New York, as follows: Section 1. That, pursuant to the Local Finance Law the State of New York, the said Town of Queensbury, Warren County, New York, in anticipation of the collection of a specific revenue other than real estate taxes or assessments, to-wit: the receipt of water rents to be collected in the North Glens Falls Water District and Extension No, l to the North Glens Falls Water District, to become due and payable during the fiscal year commencing January' l, 1960, shall issue and sell a revenue- anticipation note in the amount of $1,500.00 to mature on-November 1, 1960, Section 2. That the amount of the uncollected specific revenue aforesaid, to wit: the receipt of water rents to be collected in the North Glens Falls Water District and Extension No. 1 to the North Glens Falls Water District against which the said note is authorized to be issued is as the date hereof, in excess of the sum of $1,500.00, and that there are no other outstanding revenue anticipation notes issued in anticipation of the receipts of such revenue. Section 3. That, except as herein specifically prescribed, said note shall be of the date, terms, form, contents and place of payment and at a rate of interest not exceeding three and one-half per centum per annum as may be determined by the Supervisor, consistent, however, with the provisions of the Local Finance Law of the State of New York, and shall be executed in the name of the said Town by its Supervisor and the seal of the Town shall be, attached thereto. _ Section 4. That said note shall be sold at private sale by the Supervisor at.a price of not less than par value and accrued interest, if any, and upon the execution and sale of said note, the same shall be delivered to the purchaser upon the payment by him to the Super- visor of the purchase price in cash, and the receipt of the Super. visor shall be a full acquittance to the purchaser who shall not be obliged to see to the application of the purchase money. Section 5. The full faith and credit of the Town of Queensbury, Warren County, New York, are pledged to the punctual payment of the principal of and interest on said note. Section 6. This resolution shall take effect immediately. The foregoing 'resolution was duly put to vote which resulted as follows: Ayes - Mr. Lampson, Mr. Akins and Mr. Webster Noes - none The resolution was thereupon declared duly adopted, 83 Resolution No. 115 introduced by Mr. Lampson who moved its adoption, seconded by Mr. Akins: WHEREAS, the Town Board of Queensbury, Warren County, has author- ized the issuance and sale of a revenue anticipation note in the amount of $19500.00 to mature on the 1st day of November, 1960, to provide funds for the payment of expenses of operation of the North Glens Falls Water District and Extension No. 1 to the North Glens Falls Water District, prior to collection of water rents , RESQLVED that the Supervisor be and he hereby is authorized and directed to invest $1,500.00 of the funds in the Capital Reserve Fund of the Town of Queensbury by purchasing said revenue anticipation note,, - The foregoing resolution was duly put to vote which resulted as follows. Ayes Mr, Lampson, Mr. Akins and Mr. Webster Noes - none Resolution declared adopted. The Clerk reported that she has had served on her the following cert- iorari actions. The papers were served on her September 4, 1960. Action has been commenced by numerous taxpayers of the Town of Queens- bury to review their assessments. September 9, 1960 Mr, John 0. Webster, Supervisor Chestnut Ridge Road Glens Falls, N. Y. Dear John: 85 The Town Clerk delivered to me the application of City of Glens Falls for permit to operate a dump on property which they have acquired in the Town of Queensbury. I understand this was delivered to me for an opinion as to whether the application satisfied the requirements of your town ordinance. This application does give a description of a parcel of about 48 acres , but there is nothing to indicate what part of this 48 acres is to be used for the dump, and I assume from that the City intends to use the entire plot for that purpose. Your ordinance also requires a map to be filed, and I understand that there has been presented a map or sketch, which I have not seen. It may be that this map or sketch will show what part of this considerable tract is going to be used for dump purposes. - The application does describe the landfill method which it is stated the City intends to use if the permit is granted. It seems to me that paragraph "61* of the petition does describe sufficiently the proposed method of disposal. It seems to me that you may want the City to state in their applica- tion whether they intend to use all of the 48 acres for disposal, and if not to describe in the application the particular portion which they are going to use for disposal. Your ordinance gives the Town Board the right to require additional information to be filed by an applicant, prior to the hearing. `Assuming that you do have the map required by your ordinance, then I believe the petition does conform to the requirements of your ordinance, unless your Town Board decides to require the City to state specifically whether all of the property is to be used for disposal purposes. Beswick County Attorney Resolution No. 116 introduced by Mr. Akins , seconded by Mr. Lampson: WHEREAS the City of Glens Falls has filed an application for per- mission to use certain property owned by it as defined in the application for. disposal purposes which was filed on the 22nd day of August, 1960 in the office of the Town Clerk, and WHEREAS, the Town Board deems it necessary for the City of Glens Falls to more specifically state and describe what portion of the land described in said petition it proposes to use for such disposal efidrubbish, THEREFORE BE IT RESOLVED that the Town of Queensbury hereby requests the City of Glens Falls to state what portion'of the land described in said petition it proposes to use as a disposal area and to supply the Town with a map and description showing said disposal area. FURTHER RESOLVED that the County Attorney, Albert E. Beswick, be and is hereby authorized and directed to make the foregoing request to the City of Glens Falls. The following letter was read to the Board: WARREN COUNTY DEPARTMENT OF HIGHWAYS Superintendents Office September` 12, 1960 John Webster, Supervisor P.O. Box 36 Glens Falls, New York Dear Sir: Under date of August 10, 19599 1 wrote LeRoy Gordon, Supervisor of 86 the Town of Queensbury at that time, stating what the County proposed to do in relocating the so-called Glen Lake Road, a town highway across the Glens Falls Country Club property. During 1960 the County has relocated this town highway by the construction of a new road from the Blind Rock road northerly across the lands of the Country Club and Elizabeth Mannis Swan to intersect the original road at a distance of approximately 1700 ft. in length. This town highway has been graded, graveled and primed by the County, and I can see no reason why the Queensbury Town Board should . not pass the necessary resolution to include it in the town system.
