1960-12-15 SP 143 that a serious traffic hazard exists in our area. The spot in question is at the intersection of Coolidge Ave. and Ashley Place. The visi- bility is poor there because of trees and large ledge on one side of the road.. This ' is much more dangerous in summer when the leaves are on the trees and bushes. There are no traffic signs at the corner and there is always confusion as to who has the right of way. Many Queensbury School buses travel this route and several of our� own school children walk,or ride bikes through there on the highway as there is no sidewalk in this par- ticular area. We believe that a stop sign should be placed on Ashley Place requiring a full stop before entering Coolidge Avenue. Miller Councilman Harold Akins Justice of the Peace Curtis Lampson Councilman The Supervisor called the meeting to order at 7:40 p.m. The Board generally discussed the matter of the application of the City of Glens Falls for a permit to use lands described in the application for disposal area. 144 RESOLUTION DENYING APPLICATION OF CITY OF GLENS FALLS FOR PERMIT TO ESTABLISH A DUMP OR RUBBISH DISPOSAL AREA IN THE TOWN. OF QUEENSBURY. Mr. Akins introduced Resolution No. 145 and moved its adoption, seconded by Mr. Lampson. Whereas, the City of Glens Falls has for many years owned and operated a dump in the Town of Queensbury which, by reason of uncontrolled burning, smoke, fumes and stench, and the presence of rats and vermin, has been a public nuisance and a meaa.ce to the health, welfare and property of residents of the Town of Queensbury living in the area west of the city, and Whereas the State of New York has ro riated a app p portion of the existing city dump for the construction of the Northway which will eventually force the City to find some other means of rubbish disposal, and Whereas, the area of the Town of Queensbury around the City of Glens Falls has in recent years been built up into good residential developments and, as evidenced by the last census, the population of the Town of Queensbury has increased tremendously during the past ten years while the population of the City of Glens Falls has decreased during the same period, and Whereas , in anticipation of further residential development in the Town of Queensbury in the area generally westerly of the City and to protect the residents of the Town of Queensbury from a repetition of the intolerable conditions which have existed in recent years at the present city dump, this Town Board adopted an ordinance which provides, among other things, that no dump or disposal area shall be established in the Town of Queensbury unless the Town Board shall by resolution grant a permit therefor after written application and a public hearing, and Whereas , after the adoption of such ordinance, the City of Glens Falls purchased a tract of some thirty acres of land on Sherman Avenue in the Town of Queensbury as a site for a new city dump or rubbish dis- posal area but failed to ascertain from the Town Board prior to the purchase whether such tract would be acceptable as a site for a dump — under the provisions of the town ordinance regulating the establish- ment and operation of dumps, and Whereas , after the Town of Queensbury obtained a permanent injunc- tion restraining the City of Glens Falls from establishing and operating a dump or disposal area in the Town of Queensbury without a permit therefor as required by said ordinance, the City of Glens Falls did make application to this Town Board for a permit to establish and T operate a dump or disposal area on said tract purchased by the City for that purpose, and Whereas, the Town Board held a public hearing on such application at the Queensbury _High School on the 20th day of October, 1960, at which the City of Glens Falls was represented by Hon. J. Ward Russell, Mayor, and by Frank Hurley, City Attorney, who presented a proposal to dispose of rubbish generally by digging a trench and burying the rub- bish which will decompose but concrete, brick stone, metal, rubber tires, stumps, tree trunks and other material which will not decompose would be left piled on the surface, - and the question as to whether the so- called land fill method proposed could be used during the heavy snows and deep freezing of the ground in the winter months was left unanswered, and Whereas, numerous persons were heard in opposition to the applica- tion including several who have opened a real estate subdivision adja- cent to the tract for which the City has made application, and ,,. Whereas, it appears that there is considerable doubt as to whether the method proposed could be used during the winter'months which would make necessary the burning of all rubbish during those periods and in 145 any event materials such as stumps, trees and rubber tires which will not decompose would have to be disposed of by burning the same as at the present dump, and Whereas, the property which the City of Glens Falls desires to use as a dump or rubbish disposal area is located in the middle of a large area which is especially well adapted for residential purposes and the establishment of a dump on the site owned by the City would make the entire area undesirable for residences, and Whereas, this Board has given lengthy and serious consideration to the merits of the application of the City and has come to the conclu - sion that even with the imposition of the most stringent restrictions it would not be in the best interests of the residents of the Town of Queensbury to grant the application of the City for the particular site requested but at the same time the members of this Board do revognize that the problem of disposal of rubbish is one which the City will eventually have to meet and solve, be it C RESOLVED, that the Town Board of the Town of Queensbury, after due deliberation, hereby denies the application of the City of Glens Falls for a permit to establish and operate a dump and rubbish disposal area on the lands owned by the City as described in the application of the - City, and be it further RESOLVED that the Mayor and Common Council of the City of Glens Falls be invited and requested to meet with the Town Board of the Town of Queensbury and to undertake a joint study of the problem of rubbish and garbage disposal. Duly adopted by the following vote: Ayes - Mr. Miller, Mr. Lampson, Mr. Akins, and Mr. Webster Noes - none Resolution No. 146 introduced by Mr. Miller, seconded by Mr. Akins: RESOLVED that the Town Clerk be and is hereby directed to transmit a certified copy of the Resolution above adopted denying the application of the City of Glens Falls for pepmission to use part of its land as described in the application for a disposal area, to the Mayor of the City of Glens Falls , New York. Duly adopted by the following vote: Ayes - Mr. Miller, Mr. Lampson, Mr. Akins, and Mr. Webster Noes - none A discussion was had respecting the throwing of trash and other waste materials along the Town highways. Mrs. Geneva Elmore called the Board's attention to the burning of cars on Howard Street, The Board discussed the proposed additional take home pay for its employ- ees under the State Retirement System. After discussion the following resolution was proposed: Mr. Akins introduced Resolution No. 147 and moved its adoption, seconded by Mr. Miller: Whereas, the Town of Queensbury has heretofore become a participa- ting employer under the New York State Retirement System, and Whereas, by Section 70-a of the Retirement and Social Security Law it is provided that a municipality may provide additional take home pay for its employees under tie State Retirement System by the payment of a portion' of the employees' contribution equal to five per cent of the compensation of the employee for a period to end with the payroll period immediately prior to `that the First day of which is nearest to April 1, 1961, be it 146 RESOLVED that the Town of Queensbury adopt and hereby does adopt the provisions of Section 70-a of the Retirement and Social Security Law with respect to the employees of the Town of Queensbury who are members of the State Retirement System, and be it further RESOLVED that beginning with the payroll period commencing January 1, 1961, the Town of Queensbury make contributions to the pension accumulation fund to the extent and in the amounts authorized by Section 70-a of the Retirement and Social Security Law of the compensation of each member of the State Retirement System who is employed by the Town of Queensbury and that the amount of contributions required to be made by such employees who are members bf the State Retirement System shall be reduced by the amount of the increased contribution by the Town of Queensbury as provided for and authorized by this resolution, and be it further RESOLVED that the Town Clerk be and she hereby is directed to file in the office of the State Comptroller and in any other office where the same may be required a certified copy of this resolution, and be it further RESOLVED that the Supervisor be and he hereby is "authorized and directed to make payments of the contributions herein authorized from funds appropriated for that purpose and to execute any and all agree- ments , notices or other documents on behalf of the Town of Queehsbury which may be required to carry the foregoing into effect. ' Mr. Akins introduced Resolution No. 14?A and moved its adoption, secon- ded by Mr. Lampson: WHEREAS, it is provided by Section 164 of the Social Welfare Law, as amended, that employable persons receiving home relief may be` " required to perform such work as may be assigned to them by the public welfare official furnishing such home relief, and that in the case of a county public welfare district whiclf is responsible for providing home relief within towns and cities within the county and the Board of Supervisors has authorized work relief projects for persons receiving home relief, such determination shall` be deemed to authorize the assignment of such persons to work for any city, town or village within the county upon request, and WHEREAS, home relief assistance is provided by the County of Warren as a county public welfare district in all of the towns and the Board of Supervisors has authorized work relief for employable persons receiving home relief, and the Town of Queensbury is entitled to have work on town projects performed by home relief recipients assigned by the Commissioner of Public Welfare, be it RESOLVED, that the Town Supervisor, the Town Superintendent of Highways and the Cemetery Commission be and they hereby are authorized to apply to the Commissioner -of Public Welfare of Warren County from time to time for the assignment of persons receiving home relief to perform work in the Town of Queensbury. REID, M.D. 6 Bacon Street Glens Falls, N. Y. 147 November 22nd, 1960 Mr. John 0. Webster _ P.O. Box 86 ` Glens Falls , N. Y. Dear Mr. Webster and Meutbers of the Queensbury Town Board: This is a report on my activities ea Health Officer in the Town of Queensbury during this past year. Three clinics were held in the Queensbury School for the injection of the polio vaccine. In March and April approximately 125 immunizations were given and in October 47 injections were given. A fourth clinic is to be held November 30th. The largest group of problems facing a health officer are those that are sb-called "nuisance calls." These generally have to do with odors and unsanitary conditions and I have tried to settle these by voluntary action' on the part of the people complaining so that the Town BoardIneed not be bothered with minor problems. On occasion, more investi- gation has been necessary. I visited Assembly Point in April to investi- gate the overflow of a culvert and the subsequent stagnation of water. I investigated problems in and around Hovey Pond on two occasions and had the Warren County sanitarian investigate several problems. mostly in connection with Hovey Pond. ' Other complaints included two bites by monkeys at Animal Land; a�doglwhich ote strychnine which had been left out for skunks, and one problem involving commitment of an individual. w Bathing beaches were visited and inspected and bathing permits issued. In addition to this, a considerable amount of time was spent in qualifying myself for the position of Grade II Health Officer. This ne'cessFitated three full days of a course given in Albany, one full day in Syracuse, attendance at the anual Health Officers Meeting in New York City in May and several hours time spent with our former District Health Officer, William Meyer. In connection with these activities, I have spent about Eighty Dollars , which, according to the Public Health Law, is reimbursable to me from the Town. However, I understand that there has been no allowance for these expenses to date and, if this is the case, I will not present a bill to the Town for this year's expenses. _ If I can be of any help to any of you at any time, please do not hesitate to call' me. t Sincerely yours, Robert A.
