Miller moved. , which was seconded by Mr. Akins tbat the action upon the proposal to supply the Tovm of Queensbury with Vi one used tractor as specified in the notice calling for bids be and the same is hereby set over until December 13, 1958 at 7:30 o' clock p1m. at the Clerk's office. Mr. Akins stated that he had an appointment with James Wallace next Wednesday and invited the other members of the Board to be present. The Board generally discussed the proposed contracts relating; to the Pershing Ashley Sanitary Sewer system. A discussion was had also relating to the individual contracts. The matter was referred to the County Attorney. Mr. Miller presented the follm : December. 6,, 1958 To the Town Board: Mr. Harris directed me, at our meeting of November 22,, 1958, to determine the responsibilities of the parties concerned in relation to the Bingo Law. Such a study requires the separation of these responsibilities into 2 - phases : 1. The Town Board , and 2. the Applicant. This report deals with 1. The Bingo Lai%T itself, as well. as the Rules and Regulations of the State Lottery Control Commission,, place the administration on the Town Board. General Municipal Law, Chapter 854, Laws of 1957. _ 24 The Town Board must provide the necessary forms as drawn by the State Lottery Control Commission_, (one exception_) at the expense of' the - Town. - 3. Every application must be submitted to the Town Board on Form LG--2.,, LC2a and Lc-db,, must be complete and must carry the identi- fication number- assigned by the Commission.. In case the qualified organization is renting the premises where the games are to be played, then there must accompany the application a Form LC-31 "Statement of •Lessor". 4. The Town Board shall receive such applications, proceed to investigate the qualifications of each applicant and the merits of each application. If the Board decides that the license should be granted , it must First, require the payment of the license fee ; secondly, it must complete Form #LCr-4 "Findings and Determination for Bingo License" with one copy- to be sent to the State Lottery Control Commission. The completion of this Form can be delegated to a member of the Board or authorized officer. 5. Upon the favorable action in Par. 4 the Board shall direct the -Town Clerk to •issue Form #LC«-5 "License to Conduct Bingo- Games" , with one copy to the organization for prominent display, one copy to be retained by Town Clerk and recorded on Form #LC-S, "Municipal Bingo License Register"�„ and the third copy to the Local Law Enforcement Agency. 6. The licensee must also be furnished with Form LC-7, "Financial Statement of Bingo Operations". This must be fully completed within 15 days after each occasion with the original bed filed with the Town Clerk and a copy sent by licensee to the Lottery Control Commission. - 7. At the end of each month the fiscal offi-cer (Supervisor) must remit to the Department of Audit and Control one half of the fees collected reporting the same on form AC-320 "Report of Lottery Fees" . (This form is furnished directly to the Supervisor by .62 ,Audit and Control.) 8, It is clear from the Law and Regulations that the Town Board has the responsibility to investigate , pblice , report and account.
