Martin against Town of Queensbury Dear Rey I: have served an answer on behalf of Town of Q4eensbury in the above entitled actions. The matter is now at issue and will be tried at the fall term of Ccu3ity Court, unless 'it is settled sooner. As I: understand it from my conversation with you and other members of the Town Beard and Mr. Vain Dusen, there appears to be no doubt that the road w`as relocated across Mr. Martin"s property after he had signed a purchase agreement with the Delaware and Hudson Railroad Co Since the Town did not have any conveyance from Delaware and Hudson, Mr. Martin did have equitable: title to the property at the time of the allerged -tres- pass and it looks to me like you are probably going to wind up paying him something. Y have had two conferences, one in person and one by telephone with Mr.. Martin and he bias finally agreed to execute a deed to the Town of Queensbury to eonvey title to the land you have taken from his and to give you a general release for all damages claimed for a payment of #00,04. He has claimed f .,:200.40 in `the complaint. but the amount he will recover on trial will depend on his proof. If he should get a. verdict, and it appears that he probably will, he.will also be entitled to a bill of costs which would amount to nearly $144.44. Accordingly, it seems to merit probably would be advisable: to .pay, Mr. Martin 'tbe #1444.40 and obtain the deed and general release. Mr. Martin demands a prompt answer and I should appreciate it if you will taker this up with your Town Board and advise me at your ear- liest convenie%ice as to whether you wish to settle on this basis. The Supervisor presented a copy of a notice notifying the Supervisor of the Town of Queensbury that the intention of Alice Ward was to apply on the 27th day of July, 1959 to the Board of Commissioners of the Land Office of the State of New York for a grant of easement pursdant-to the provisions of Section 3, Subdivision S: of the Public Land Law tmdland under water of the 'State: of New York.
