1959-07-25 74 Proof of the publication of the notice of hearing was- filed, No one appeared either for or against: the proposed entering into con- tracts to fia.rnish fire protection in the Queensbury Fire Protection District, Resolution No. 89 introduced: by Justice Akins , seconded by Councilman Miller:: WHEREAS' a Public Hearing has been held on the 21st day of July, 1959, upon the proposed contracts with five fire companies (the West Glens Palls Fire Co. No.. l,, Inc. ,, Queensbury Central Volunteer Pyre Co. , Inc., Bay-Ridge Volunteer Fire Co. , Inc. , North Queensbury-Volun- teer Fire Co., Inc. ,. and the South Queensbury Volunteer Fire Co.) , to furnish fire.protection in Fire Protection District in -the Town of _ Queensbury, and - WHEREAS no one appeared opposing or otJectingtto the Town enter- ing into such contract, and it is in the public interest that the Town enter into said contracts, THEREFORE BE IT RESOLVED that the Town Board enter, sign, and execute the said contracts-with the said . Fire- Companies. Duly adopted by the following vote:: Ayes - Mr. Miller, Mr. Bentley, Mr. Lampson, Mr. Akins and Mr. Gordon Noes -- none Thereupon. and after the adoption of the foregoing resolution, the members of the Town Board signed and executed the proposed contracts. Miller Councilman Absent Curtis Lampson Councilman The Board convened at 7:30 p.m. Harrold Lebowitz was present and discussed with the Board his applica- tion for a junkyard license. He stated in substance that he had sent in a letter about 7 months ago requesting a license. He also said he sent in the required fee. He asked what action., if. any, was taken on his application. Thereupon, there was some discussion had respect- ing compliance with the junk yard license. Mr. Akins reiterated his position in opposing the granting of the license. Resolution No. 90 introduced by Justice Bentley, seconded by Councilman Miller: i Whereas the West Side Auto Parts has previously submitted an application for a Junkyard license for the yeart1959 to be operated on property on the north side of the Corinty Road and has paid the re- quired fee thereof, Therefore be it RESOLVED that a junkyard license be issued for . r 1 ( 5 the year 1959 to the said West Side Auto Parts to be operated on -property situate on the north side of the. Gordon, Supervisor July Bl, 1959 Foster Avenue Glens Falls , New York Re: Donald Higgins Dear Roy: _ Sometime ago, you brought me a map of the Donald Higgins property in Ridge Meadows which showed an encroachment of-the house over the set back line,: and told me that Higgins had requested the Town to convey to him a few feet of the highway which would extend- his property line. At that time, I told you that the- Town had received the conveyance from Tom Rogers and wife for highway purposes only and you certainly could. not _convey any part of it without the consent of Rogers.. Mr. Higgins came to me and told me that Schenectady Savings Bank had refused to approve a mortgage because of the encroachment and that this had left him in a bad financial situation. I have had some corres-_ pondence with: the attorneys for the Schenectady Savings Bank and they tell me that they will approve a conveyance by the Town. of Queensbury Jointly with Tom Rogers and Cleo Rogers to Mr. Higgins to bring his house within the set back Tine. As I recall it, the highway at that point is considerably more than fifty feet in width and you will still have ample land left for the highway. Will you please discuss this with the Town Board and advise me whether you are-willing to make the conveyance requested. Yours very truly, /s/ Albert E. Beswick The matter was referred to the Supervisor for action. James D. Griffin and Harley Purdy were present and discussed with the Board the matter of speeding, on the Country Club Road. Mr. Griffin requested that the road be patrol,Yed. Resolution-No. 91 introduced by Justice Bentley, seconded by Justice Akins,. Whereas complaints have been received from residents along the Country Club Road relative to the excessive rate of speed at which motor vehicles travel on the Country Club Road, RESOLVED that the Town Board of the Town of Queensbury request the Sheriff l�s.Department. to take necessary. acti on to cwtaU such excessive rate.-of speed at which vehicles are traveling on the said road by causing such road to be patroled. Further RESOLVED that the Town Clerk forward a copy of this reso- lution to the Sheriffs Department. Duly -adopted by the following vote- ,Ayes - Mr. Millen, Mr. Bentley, Mr. Akins and Mr. Gordon. Noes - none 176 There was discussion had respecting the volume of water used in air- conditioners in the North Glens Falls Water District. It was stated that the National Bank and_ Trust -Co. branch office on Glen Street had a 35 unit water cooler. There: was discussion had respecting the installation of water.meters in any place where an unusual amount of water is being used. There was a further discussion on the water rates to be charged. The matter was referred to the Water_ District Committee, The Supervisor submitted for filing a stipulation of discontinuance of an action by Dorr T. Martin against the Town of Queensbury and a release signed by Mr. Martin on ,connection therewith. Resolution No. 92 introduced by Justice Bentley, seconded by Justice. . Akins.. RESOLVED that the land conveyed for highway purposes by a deed dated July- 10, 1959 from Dorr T. Martin to the Town of Queensbury be and the same is hereby accepted for- such purpose. The foregoing accep- tance is subject to the approval of the County Attorney as to form and sufficiency of the instrument of conveyance. Mr. Codner requested that the Town purchase a new pick-up truck. He said that the present one is a, 651 International and needs ,repla.cing. 177 The matter was laid on the. table until the meeting of August 12, 1959. A further discussion was had respecting the Town Hi its condition and replacement, if anyt in the Town HiighwayaD Department. This matter was referred to the Highway Committee for examination and report. John-Van Dusen, Town Surveyor, was present and discussed with the Town Board several road surveys which he had made in connection with lands owned by the Town of Queensbury fronting on bake George and Glen Lake. A discussion was had among the members of the Town Board respecting the properties owned by the Town-abutti the Town liability respecting the installationiofedocks the question of �- individuals thereon.
