Richard Bartlett,; Attorney, representing Royden Scofield, appeared and dis- cussed with the Board the proposed widening of the "T" Hill Road. He stated that Mr. Scofield was willing to convey a portion to- the Ton for widening of the road upon receipt of a "fair's consideration for it. He also wanted the line fixed. Resolution No. 84 introduced by Justice Akins seconded by Councilman Walkup: RESOLVED that all the lands conveyed in a deed from. William. All exposed hardware above the pipe 'cap shall be of non-ferrous - material to avoid rusting-and resultant streaking of the sign faces. Pipe caps may be close grained cast iron galvanized or #10 gauge drawn steel galvanized for mounting on steel pipes with a sufficient device for locking securely in position. All sign plates shall be made from f20 gauge enameling iron or heavier, punched, shaped and cut to dimensions specified. All plates shall be embosse5 and have a porcelain enamel coating on both sides with letters and border if desired on one side only. FABRICATION The fabrication of all metal parts shall be accomplished in a uni- form workmanlike manner. All fabrication, including shearing,: cutting, and punching of holes shall be done prior to enameling. Surfaces of the metal faces shall be ground or otherwise freed from defects resulting from fabrication. ENAMELING v - Preparation of Metal Surfaces The base metal surfaces shall be thoroughly cleaned preparatory to the application of the enamel coatings Enamel Coatings not paint t Signs shall be coated on the face and the back with one ground coat and one cover coat of porcelain enamel , fused to the metal at a temperature above red heat. Over this coating shall be applied such succeeding coats as may be necessary, so fused as to produce, in the finished plate, a single integral coat of porcelain of the desired ign plates colors and design. During the enamel coating and fusing all s 67 shall. be hung by hooks through one of `the punched holes so that no point marks , scars or other imperfections will appear on either the face or the back of the sign plates. Finishing and Embossing Signs shall have no surface defects . All letters and borders , if desired , shall be clear cut , sharply outlined, embossed and free from cracks, blisters , etc. COLOR The finished plates ahall have a white color background with black color borders (if desired) and letters. The color coats of enamel shall not fade or darken when the sign is exposed to an accelerated test of ultra--violet light exposure equivalent to two Fears of outdoor exposure. LETTER AND NUMERAL SIZE The depth of embossing of both letters and border shall not be less than one-tenth of one inch (1/1010 . " The street name letters shall be four inches (411) high and the width and design thereof shall be in accordance with U.S. Standard Alphabet Series , A,B,C,D or E, depending upon the length of the name involved , with the spacing as -per standard practice:. ` The street name plate shall be six inches ('611) by twenty-four (2411) or thirty inches (30 11--) in size , and the border (if-desired) shall be one quarter (1/4") to give-sixteenths (5/1611) of one inch wide. Plates longer than thirty inches (30,11) shall be used t© avoid crowding on extremely long street names. THIjG=SS OF ENA14EL COATING The maximum coating thickness shall be 0.020 inches unless three or coatings are necessary, owing to the color design, in which case the I maximum coating thickness shall not exceed 0.028 inches on the face or .� front of the plates . The coating thickness shall be measured by a suitable gauge having an accuracy of 0.001 or better. ADHERENCE Enamel coatings when tested for adherence in accordance with the paragraph follot,Ting shall show not more than 50 per cent exposed metal. A specimen shall be placed `on a steel anvil having in its surface a cylindrical depression, 'one and one-eighth inches (1-1/811) in diameter, and five-thirty .seconds inches (5/32") in depth. The specimen.- shall_ be strick, at a point centered directly above the depression„ with a steel ball, one inch (111) in diameter, by allowing a plunger to fall Upon the steel ball from such a height that the steel ball will deform the metal and -force the specimen under test to touch the bottom of the depression. PACKING AND DELIVERY All plates shall be packed in such a manner to insure adequate pro- tection against damage in shipment. All packages shall be labeled clearly with an itemized list of their contents. 'Glens Falls , N.Y. September 6, 1955 Mr. Harold D. Aikens .,D, 3 - . Glens Falls , N.Y* Dear Mr. Aikens You have asked me about the status of the proposed. application for flash signals at the Glen Lake crossing of the Delaware & Hudson Rail- road. - _ On May 5, 1954,. I prepared a proposed petition_ by the town board of the Town of Queensbury to the Public Service Commission for an order requiring the Delaware & Hudson Railroad to install automatic warning signals and mailed it to Mr. Bentley on that day. I have two copies of this petition in my file but apparently the original was never executed and returned to me. At the request of Mr. Harris, I wrote to the Delaware & Hudson Corporation on the same day requesting them to install such signals and I have in my file a copy 'of a letter from Alfred D. Kelly, Counsel,, under date of June 24, 1954, in which he states that they had recently cut trees on both sides of the track to improve the vision, that the sight approach is approximately 1000 feet, and in view of the fact that there are very few trains and that there has not been an accident at this cors- sin. since 1915, the railroad feels that the .expense of installing warn- ing signs is not warranted. The original of the letter from Mr. Kelly was mailed to H. Russell Harris on June 30 , 1954. From all of this it appears that for some reason your town board decided not to make a petition to the Public Service Commission. At about that time the town board of the Town of Caldwell did make a petition to the Public Service Commission for the installation of automatic signals at the crossing near the Martin saw mill. This application went to a 1 hearing and was denied by the Public Service Commission. I doubt wheth- er you would have any better success with the Glen Lake crossing, but --� if you do now decide that you do want to make a petition, you may either use the one which I prepared over a year ago, changing the dates,. or I will prepare a new one. Dear Mr. Aikens : You have asked' me about the liability of the Town of Queensbury for sidewalks constructed in the Broadacres area. A tos:n board may con8truct sidewalks , and if the sidewalks are con- structed with town funds, the town is liable for the maintenance of such sidewalks. The town is not responsible for the maintenance of sidewalks unless, the walks were originally constructed with town funds, or unless the town has assumed the maintenance thereof. It is my understanding the sidewalks in the BveadAcres area were originally laid by the BroadAcres Corporation and not by town funds. If this is true , then the Town of Queensbury is• not� liable for the mainten- ance of the walks unless you have at sometime voluntarily assumed the T 69 responsibility. Normally, the assumption of maintenance would consist of an appropriation_ by the town board for the purpose of maintaining side- - walks and some acts of the town superintendent in repairing or maintaining sidewalks. Unless the• town board or your tom superintendent of highways has assume6 -such responsibility, then in my opinion there is no liability. May I call your attention to subdivision 2 of Section 25 of the Highway.
