The following letter was reed to the board: - ALBERT E. BEVICK Attorney at Law _ Glens Falls.,-N.Y. March 15, 1957 Mr.. H. Fussell Harris . Supervisor - Star Rt,. Glens Falls, N.Y. Dear Russell Ernest Lackey tells me that the Town Board has decided to a.p prove the purchase of the Gar Wood stone. spreader from Mett-Manbeck Machinery Co., Inc.,, and also.will approve the separate purchase of the transport and the attachments and accessories. Mr. Lackey also brought,in a bill from R.B. Wing & Son Corp. for the cab for the main- tainer in the ampunt of .$498.00, and a bill from.Tarrant Manufacturing Co. of $aratoga $prings, .for the-purchase of a new salt spreader for $640.00 less a trade in of the old spreader of 00.00, ; leaving a bal- ance of.$590,00,. I,have drafted and enclose herewith three resolutions. The first resolution approves the three purchases from M©tt-Vbnbeck.Machinery I Co, and ,malm s a. determination that the purchase:a were made at dif .. _ ferent times and ,without..being ordered separate to avoid public bid- ding. .14 this sarip..e resolution 1- have included a provisioit rejecting the clam of $375.00. for rental of-the spreader, and I have also. added a. ,provision. requiring the Town Superintendent to . submit all purchases for prpper approval except in the cases of routine .pur - 4 chases or an emergency,, You may ,want to strike out this part of the I resolution. f r The other two resolutions cover the crab for the maintainer and the said spreader. Mfi. Lackey ,asked me the .other day. if he had to obtain approval. of the Town Board every time he wanted to buy a new rake or some small tool. I.ha.d to tell him that tha Highway Law makes no elimination, but I al'so_ told him that I was sure your Town-Board would not expect him to have ,to hold .up routine purchases of small tools , etc. for Board ap- prova;l:, ,and certainly in cases of emergency he has authority to make i purchases. He said he understood that he did not have to have Board approval; for anything under $500.00 but I find no such provision in the Highway ,Law. I think he_ may have in mind..the old section, 142 of the Highway ,Law, which required a public hearing by the Town. Board on any purchase.- of more ,than $500.OQ,, but that requirement has been repealed,; and in any event ,it covered only a public hearing and did not mean that the Town Superintendent could purchase without Board approval,. Mr. Bentley introduced Resolution No. 28 and moved its adoption, secon- ded by Mr. Lampson:; f i i 4� Whereas-, Ernest Lackey, Town Superintendent, has heretofore pur- chased a Gar Wood Model 5 material spreader from Mott-Manbeck vachin- ery Go. , Inc,.., at the. price of 96.00 and has traded in -on the.__pur- chasa price of the new spreader.a Flink Even Seal spreader for $995.00 leaving a net balance of $1.00 to be paid, and Whereas,, the said Ernest Lackey, Town Superintendent of Highways, subsequently ordered a transport unit for $240.00- and attachments and accessories for $379.36, and Whereas , neither the purchase of the spreader, transport unit and attachments and accessories or the trade in of the Flink were submitted by Mr. Lackey to the Town Board or approved by the Town Board, and Whereas, the Town Board has caused an investigation to be made and is satosfied that the Flink spreader was not satisfactory and that the purchase of the Gar Wood spreader was justified, and further that the transport unit and the attachments and accessories are not integral parts of the Gar Wood spreader, that the Gar Wood spreader was actually purchased and in use prior to the purchase of .the transport unit, attach- ments and accessories, and that the same were not purchased separately for the purpose of avoiding the requirement of competitive bidding, RESOLVED that the purchase of the Gar Wood. Model 5 material spread- er from Mott-Manbeck Machinery Co. Inc., for .a price of $996.O0-and the trade in of the Flink Even Seal spreader on such purchase price for an allovandt of $995.00 be and the the same hereby are ratified and approved,, and it is further RESOLVED that the purchase of a transport unit from Mott-Manbeck Machinery Co. -Inc. , for a price. of $240.00 and the purchase of the at- tachments and accessories for the Gar Wood spreader from the same firm for a price of $379.36 be and the same hereby are ratified and approved, and it is further i _ RESOLVED that, upon the advice of Albert F:. Beswick, County At- j tarney, the claim of Mott-Manbeck Machinery Co. .Inc.P, in the amount of $376.00 for the rental of the spreader which-was. eventually purchased, �.- be and the same hereby is denied and rejected, and it is further RESOLVED that the Town Superintendent of Highways be and he here� by is directed to comply with the provisions of- the Highway Law and to submit to the Town Board for approval .prior to purchase and delivery of all machinery, - tools and equipment except those. of a routine nature or in cases of emergency. Duly adopted by the following vote: i Ayes - Mr. Bentley, Mr. Lampson, Mr. Akins and Mr. Harris Does - none Mr. Lampson .introduced Resolution No. ag and moved its adoption, secon- ded by. Mr Bentley: Whereas, Ernest Lackey, Superintendent of Highways of the Town of Queensbury, has purchased from,R.B. Wing & Son Corp. of Albany, New York, a cab for Hueber Marco maintainer. at .the price of $498.00, which pur- chase was not authorized by the Town Board prior to the date of the pur- chase. s RESOLVED that the purchase of a cab for Heuber Marco maintainer owned .by the Town of Queensbury from R.B. Wing- & Son, Corp. for the sum. of $498..00 be and the same hereby is ratified and-, approved. Duly adopted by the following vote : i . 1 Ayes - Mr.. Bentley, Mr.. Whereas, Ernest Lackey, Torn Superintendent of Highways, has pur- eftased from Tarrant Manufacturing Co. of Saratoga. Springs, New York, a Tarco "Scotchman" salt spreader for the sum of $W.00 and has traded in on the purchase price of the new spreader an.old spreader for an al- i lavance of $50,00, and, Whereas neither the purchase of the new spreader or the trade in of the cold spreader has been approved by the Texan Board prior to the pur- chase and trade in but the Town Board is satisfied that said purchase and tradee in are proper,, RESOLVED that the purchase of a Tarco "Scotchman",.salt spreader from the Tarrant Manufacturing Co. of Saratoga Springs-for the. price of $W*0G and that the trade in of the used spreader owned by the Torn of Queensbury for the sum of $50.00 be and the same hereby are ratified and approved. - Duly `adopted by the following vote Ayes .- Mr. Bentley, Mr. Lampson, Mr. Akins and Mr. Harris i Noes - nqns Mr. Menbeck of the Mott-Manbeck Co. Inc. , was present and discussed `with the members of the Town Board and Superintendent of Highways the acquisition of spreader by the Town. Mr. Manbeck was referred to the County ..Attorney. Ernest Lackey, Town Superintendent of Highways , discussed with the Board the Glen Lake Road - the proposed extension of tht4 Country Club Road, Linwood Chase was present and discussed with the Board water sewers to a. house which he is building.
