Proof of pasting„ filed; Proof of Publication,, filed. Joseph Benack and Robert Griffin were present and discussed the proposed extension, and no one appeared opposing the proposed extension. r Resolution #37 introduced by Justice Akins,, seconded by Councilman Lampson:: WHEREAS, a written petition has been presented to and filed with the Town Board of the Town of Queensbury requesting the creation of an extension_ of the North. Glens Falls Water District, to be known as Ex- tension #4, and _ WHEREAS, a certified copy of the order_ of the Board calling a hear- ing thereon, was duly and regularly published in the. Glens Falls Times on the 22nd day of March, 1957, and certified copies thereof were. pos;fted in five public places within the proposed extension, and WHEREAS, a, public hearing having taken place at the Town Clerk's office in said Town an the 2nd day of April, 1957, at 7:30. P.M., and-no one having appeared and offered objections or protest to the creation of this proposed extension, and, WHEREAS, no part of the cost of the construction of the proposed improvement will be changed to or paid for by all the property owners in the said proposed extension!, and no obligations are to be issued by - the Town to finance the cost of the construction of the said improvement, and the consent of the State Comptroller to the creation of the extension is riot required, and WHEREAS, the Town Board has given due deliberation to the hearing and the facts and allegations presented, and has determined to grant the prayer of said petition, it is Found and Ordered and Determined that the said petition for the creation of the extension #4-of the 8xisting North Glens Falls Water District, is signed, approved and acknowledged, as required by law, and is otherwise sufficient;; that all the property and property owners -within the proposed extension are benefited thereby; that all the prop- erty and property owners benefited are included within the limitations of the proposed extension, and that it is in the public interest to grant in whole the relief sought, It is further' Ordered that the extension of said district as re- quested in said petition be and the same is hereby established, and the boundaries of such extension as hereby established are hereby determined to be ALL, that eertain piece or parcel of land situate ,, lying and being in the Town of Queensbury, County of Warren and State of New York, more particularly bounded and described as follows : BEGINNING at the southeasterly corner of lot 105 Montray Heights , a map of which is on file in the Warren County Clerk's Office at Lake George,. N.Y., running from thence in a northerly - direction along the easterly bounds of the said Montray, Heights subdivision, passing along the westerly bounds of the lands of a portion of Pineview Cemetery, and also passing along the f 286 westerly bounds of a portion of the lands of Sidney Timms , and also passing along the west- erly bounds of the lands of Isabelle Harris, Edwin Gage. and Kenneth Gage , .to the most north-- easterly corn r. of Montray Heights subdivision, said point being al'o the northwesterly corner of the lands of the said Kenneth Gage; thence in an easterly direction along the northerly bounds of the lands of the. said; Kenneth Gage, eight hundred (800.00) feet; thence in a southerly direction and in a straight line to the northeasterly corner of the lands of the said Isabelle Harris ; thence running in an easter- ly direction along the northerly bounds of the lands of the said. Sidney Timms two hundred fifty (250.00) f�3e�; thence in a southerly direction and parallel to the easterly bounds of the lands of the said Isabelle Harris, crossing Sweet Road, to the. southerly bounds of the lands of the said Sidney Timms; thence continuing the same course southerly, crossing a portion of Pineview Cemetery, to a point ip the northerly bounds of Extension No. one, North _ Glens Falls Water District; thence running in a westerly direction-along a portion of the north- erly bounds of the said North Glens Falls Water Disirict, Extension Number one, to the easterly bounds of the original North Glens Falls Water District; thence in a northwesterly--di recVion along ,a portion of the easterly bounds of the said original North Glens Falls Water District, to the point and place of beginning. - r Duly adopted by the following vote:. Ayes - Mr. Walkup, Mr. Lampson, Mrs Akins and Mr. Harris w - r Noes - none Resolution #381introduced by Justice Akins , seconded by Councilman Lampson:- WHEREAS, the Town Board has created extension #4 of the North Glens Falls Water District, andit is required to obtain the approval. of the-Water Power-& Control Commission as to the source of the water supply RESOLVED, that Albert Beswick, County Attorney, be and is _ hereby requested and directed to prepare the necessary legal docu- ments and make the application to the Water Power & Control Cora- mission for its consent as to the source of the water supply for the aforesaid extension. Duly adopted by the following vote : Ayes - Mr. Walkup, Mr. Lampson, Mr. Akins and Mr. Harris Noes none t Robert Griffin also brought. up the matter of installation of fire hydrants on the Aviation Road. The matter was generally discussed. Walter Caldwell, Fred Hay, Miroslave Pistek, James Quinlin and Arthur Winters: were present in reference to the Reservoir Park Road. Resolution #39 introduced by Councilman Walkup, seconded by Justice Akins WHEREAS it appears that, at the head of Dunham' s Bay where the waters of Lake George meet the lands of the State Highway known 287 as 9L, and whereas This property should be maintained for the use of the public as a whole, and for no individual in particular, and whereas It appears that certain structures are being built by and for the use of and at a profit to certain individuals , thus depriving the public of all of the use of said lands,, THEREFORE BE IT RESOLVED that ire,, the Town Board of the Town of Queensbury, request. the• State---of New York, the State Highway Depart- ment, and any other State agency to take immediate action to restrain any individual from building, constructing or maintaining any structure or in any way depriving the public of the use of the aforesaid lands and water.
