Section 6. Penalties . Every violation of any of the provisions of
thi ° ordinance shall be a misdemeanor and upon. conviction thereof,.
such person shall be subject to a fine of not more than $100.00 or
imprisonment for a period of not more than three months or both.
Every, violation of any provision or condition of any permit issued j
and granted by the Town-Board of the Town of Queensbury to any person
pursuant to this ordinance as hereinbefore provided shall be deemed
to be a violation of this ordinance and shall be a misdemeanor and
be pun.ishible as herein provided, and in addition upon conviction of
such violation,, the Town Board shall have the power by resolution to
'reveke any such permit. The Town Board shall also have the p(mler to
enfbrce' this ordinance by civil action for injunction.
Section 7. The judgement of any court of competent jurisdiction that
any. partion of this ordinance is invalid shall not invalidate the whole
ordinance but only that part thereof declared to be invalid and the
remainder of thus ordinance shall remain in full force and effect.
Section 8. This ordinance shall take effect ten days after s
publication and, posting as provided by the Town Law..

seconded by Henry J SkVight, Justice of the Peace. eso vea:
l.'L That the Town of Queensbury electes to exclude from eligibility
for membership in the New York S-tatd Employees' Retirement System such
class or classes of its officers and employees-for whom old.--age and
survivors'- insurance coverage is elected herein.
2. That the Town of Queensbury elects to extend old-age and sur
vivors '. , insurance coverage provided by the Federal Social Security Act
to the -following class or classes of its officers and employees:
All employees in the labor class.
which coverage is extended pursuant to Section 218 of the Federal Social

Security Act and Chapter 619 of the Laws of 1953,, being,Article 6 of
the Civil Service Law'
and Chapter 620 of the Laws of 1953 , being an
amendment"of Article 5 of such law, and which coverage is subject to the
conditions thereof and to any amendments to the laws relating thereto.
3. That it is hereby cbtermined that old-age and survivors ' insurance
coverage should not be extended to the following class or classes of
officers- and employees because of impracticability, and that such class
or classesshall continue to be eligible for membership in the New York
State Employees ' Retirement System.
All. elected town officers and all employees in the compet-
itive and non-competitive classes off' the Civil Service.
4. That H. Russell Harris , Supervisor, execute the proposeo agree-
; went attached hereto and hereby..,made a part hereof in the name and on
behalf of the Town of Queensbury and submit such proposbd agreement to
the Director of the New York State Social Security Agency for the pur-
Doee-of obtaining old-age and.,.survi-vors ' insurance coverage for officers
of the Town of Queensbury in accordance -with this resolution.

Attorney Frank Hurley was present and requested the board to adopt a
resolution asking for approval of the Department of Public Works for
the laying out of a highway less than three rods in width.

to dedicate lands for highway purposes , designated on the accompanying
map, the original of which is on file 'in the 'Marren County Clerk' s
office, and which lands so to be dedicated are indicated thereon -as
XAT1-2RI1E AVENUE which would be less than three rods in width and not
less than ten feet in width, to wit; 38 feet in width, and
11HEPREAS the said property Qwner has proposed prior to the ded-
ication to - the Town to rough grade the proposed land tobe *ded..'Lcated
for highway purposes,
IT IS RESOLVED that the Town Superintendent of Highways be and
is hereby-autborized and directed to request a certificate of the
Superintendent of Public Works of the necessity of the laying out of
$uch highway less than. three rods in width h and not less than ten feat
in width, to wit -. 35 feet along the course indicated on the said map
as KATHERINE AVENUE.
