A communication was reported from the Automatic Voting Machine Corp. which suggested that the Town Board place a standing order for the annual supplies with the Corporation for the voting machines. The Board generally discussed the matter. No further action taken. The Town Clerk reported that she had received two applications for re- appointment as constables. Such applications :were received from Ray-' mond J. Hoague and Ralph F.-Hill., She also reported that she had re- ceived an application from Eugene Johnson to take care 'of the town. dump. The matters were deferred until the January meeting, The Supervisor handed the following communications which were read to the Board: December 18,, '1953 Mr. H. Russell Harris _ Supervisor Star Route lens Falls ,ls , N .Y. Dear Russell: - You spoke to me sometime aLio about the payment to Irene Devine for water damage to her property -at 682. Glen Street by reason of the stoppage of a. drain. At that time she claimed about $350.00 and,-- as I. recall it, we felt that you should not pay fo`r damage to a trunk and contents or any other property in the basement which she could have moved out of danger but we might consider payment for damages to the oil burner which she could not move. Enelosed is letter from Francis 11. MCGinley in which he item- izes bills of $109.40 incurred -for cleaning up of her cellar and re- pairing the oil burner. If your toim board should decide that this is a just claim which should.be paid, please advise me and I will have Mr.. McGinley prepare releases to be executed by Mrs. Devine to be delivered' to you on payment of the settlement. _ e Yours very truly k < (Signed) Albert E. Beswick ` c _ County Attorney (Encl. Albert-E. Beswick, Esq. , Colvin Building Glenn Falls,, New-York Dear Albert: - - Some time ago we discussed the claim of Irene Devine against the f Town of Queensbury for water damage suffered by her property at 682 Glen Street. As you know, the damage resulted from a backing up of water from a culvert controlled by the Town of highway at that point,, either becauseofnin.adeq ate size norf failure of the Town to keep it cleared of debris so as to permit the free flow of water during hi h-grater periods. The total damage amounted to approximately $350;, but it is my understanding from negotiations pregiously had between you and Judge Loughlin, that an agreement was reached providing for the reimbursement L, of only those items which were not removable from the cellar. With that in mind, I submit the following bills for which Mrs Devine has given me vouchers:. October 14, 1953, Leo Zimmerman, install new motor on oil burner . . . $28.80 December 13, 193, Leo Zimmerman, repair burner motor and supply trans- form . Cleaning man to remove debris from the cellar... . "41.60 September l,, 1953, Monroe and Harrington.,,; repair to 14.00 oil burner (dried burner) cleaned and installed same) . ... 25.00 Total ' 109:40 1, Drs. Devine hopes that some work which the Town has done on the cVlveFt in question and/ or the flow away therefrom, has succeeder; in eliminating the cause of these flash floods in this cellar. We shall hope that is true ; but in the meantime I would appreciate your processing this claim for payment along the lines-previously agreed upon,; it being understood that the last item resulted from further difficulty following your negotiations_ with Judge Loughlin. With best personal regards , Tam, -- Cordially yours, (signed) Francis W. McGinley Resolution Up. 110 introduced by Mr. Sleight who moved its adoption, seconded by Mir.
