ATTORNEY DiLALLO BITTER-The structure is set back quite a distance from the road so it's not as if he could tie into the public system which is why it's supported with a holding tank. But as the Supervisor noted and was on a site visit today, it's just a small bathroom for convenience purposes. It's distance, not only from the road but from the residence. REGULAR TOWN BOARD MEETING, 12-17-2018, MTG#46 354 SUPERVISOR STROUGH-It seems to be fairly cut and dry. Any thoughts, concerns, questions for Ms. Bitter while she's here over this resolution? COUNCILWOMAN ATHERDEN-I guess I have a question. So, I know that you've been in front of the Zoning Board many times and this time, there was, a permit should have been required and it wasn't sought, is that correct? ATTORNEY DiLALLO BITER-That's correct. COUNCILWOMAN ATHERDEN-Yea, so I just wonder if there's ever going to be a need for a larger tank or if it's asked for, if there's ever going to be any extension to that? ATTORNEY DiLALLO BITTER-No, I am glad you asked that question. This is purely a garage, there's no living quarters suggestion, no bedrooms anticipated, it's purely for purposes of an accessory structure for storage. So that's why the bathroom is just there to wash hands and ... but no living quarters, no extensions. COUNCILWOMAN ATHERDEN-And no anticipated extensions or anything, okay thanks. SUPERVISOR STROUGH-Okay any further questions from the Board? Okay, none. There is a public hearing on this. Anybody from the public wish to speak to this resolution to approve a sanitary sewage disposal variance. Okay, Stefanie, thank you. Yes, sir. RON BALL-Ron Ball, Queensbury. Many homes in Queensbury convert their garages to living space. It happens all of the time. That's all I have to say, thank you. SUPERVISOR STROUGH-Okay. Anybody else from the public wish to speak to this? Alright, Stefanie, if you want to return. I visited the site. It is a garage. There is no indication of it being a residence and like I said, there's a small sink and a small toilet and that's it. Alright. Any questions from the Board, last minute? COUNCILWOMAN ATHERDEN-I just have one. It is understood that should there ever be a need, that a larger tank would be required. ATTORNEY DiLALLO BITTER-Absolutely and if any further modifications are necessary, permits will have to be sought. COUNCILWOMAN ATHERDEN-Permits, yes. SUPERVISOR STROUGH-It's only a five hundred (500) gallon tank and that's really a good thing. COUNCILWOMAN ATHERDEN-Correct but if that was extended, they would have to come back and ask for a larger tank, if it was built into something else. SUPERVISOR STROUGH-Yes. PUBLIC HEARING CLOSED RESOLUTION APPROVING SANITARY SEWAGE DISPOSAL VARIANCES FOR KRIS ROGLIERI RESOLUTION NO.: BOH 42,2018 INTRODUCED BY: Mr.Anthony Metivier WHO MOVED ITS ADOPTION REGULAR TOWN BOARD MEETING, 12-17-2018, MTG#46 355 SECONDED BY: Mr.George Ferone WHEREAS, Kris Roglieri filed an application to the Local Board of Health for a variance from provisions of the Town of Queensbury On-Site Sewage Disposal Ordinance, Chapter 136, §136-11, which requires applicants to obtain a variance for holding tanks as Mr. Roglieri wishes to maintain an existing 500 gallon holding tank on an accessory structure/garage rather than expand to a required 2,000 gallon holding tank on property located at 40 North Road in the Town of Queensbury,New York, and WHEREAS, the Town Clerk's Office published the Notice of Public Hearing in the Town's official newspaper and the Local Board of Health conducted a public hearing concerning the variance request on Monday,December 17`h,2018, and WHEREAS,the Town Clerk's Office has advised that it duly notified all property owners within 500 feet of the subject property, NOW, THEREFORE, BE IT RESOLVED,that 1. due to the nature of the variance, it is felt that the variance would not be materially detrimental to the purposes and objectives of this Ordinance or other adjoining properties nor otherwise conflict with the purpose and objectives of any Town plan or policy; and 2. the Local Board of Health finds that the granting of the variance is necessary for the reasonable use of the land and is the minimum variance which would alleviate the specific unnecessary hardship found by the Local Board of Health to affect the applicant; and BE IT FURTHER, RESOLVED, that the Local Board of Health hereby approves the application of Kris Roglieri for a variance from the Sewage Disposal Ordinance to allow Mr. Roglieri to keep the existing 500 gallon holding tank on an accessory structure/garage rather than expand to a required 2,000 gallon holding tank on property located at 40 North Road in the Town of Queensbury,New York and bearing Tax Map No.: 302.7-1-37. The Queensbury Town Code is hereby amended as set forth below. A. Queensbury Town Code § 88-23 (A)is amended as follows: A. Operating permits required. (1) Operating permits shall be required for conducting the activities or using the categories of buildings listed below: (a) Manufacturing, storing or handling hazardous materials in quantities exceeding those listed in the applicable tables of the latest edition of the International Fire Code (incorporated by reference in 19 NYCRR Part 1225); (b) Hazardous processes and activities, including, but not limited to, commercial and industrial operations which produce combustible dust as a by-product, fruit and crop ripening, and waste handling; (c) Use of pyrotechnic devices in assembly occupancies; (d) Buildings containing one or more areas of public assembly with an occupant load of 100 persons or more; (e) Parking garages as defined in 19 NYCRR Section 1203.3 0)(2)(iv); and (f) Buildings whose use or occupancy classification may pose a substantial potential hazard to public safety, as determined by resolution adopted by the Town Board of the Town of Queensbury. (2) Any person who proposes to undertake any activity or to operate any type of building listed in this Subsection A shall be required to obtain an operating permit prior to commencing such activity or operation and to comply with any and all related requirements incorporated into this Law pursuant to Section 88-3. In the case of parking garages, the owner and/or operator must demonstrate compliance with the provisions of 19 NYCRR Section 1203.3 0) including, but not limited to,the timely submission of Condition Assessments. The invalidity of any clause, sentence, paragraph or provision of this Local Law shall not invalidate any other clause, sentence, paragraph or part thereof. ARTICLE 3. Duly adopted this 17t'day of December,2018 by the following vote: AYES Mr. Strough,Mr.Metivier,Mrs. Atherden,Mr.Ferone, Mrs. Switzer NOES None ABSENT: None RESOLUTION AUTHORIZING FUNDING TOWARD PURCHASE OF SALT SHED AND BRINE EQUIPMENT AND GRANT ADMINISTRATION RELATED TO ROAD SALT ALTERNATIVES AND BEST MANAGEMENT PILOT PROJECT RESOLUTION NO.: 463, 2018 INTRODUCED BY: Mr.Anthony Metivier WHO MOVED ITS ADOPTION SECONDED BY: Mr. George Ferone WHEREAS, the environmental health and overall quality of life in the Lake George Watershed area is critical to the social and economic wellbeing for the Town of Queensbury, Warren County and the region in general, and the Town of Queensbury has been an active participant in developing the critically important water quality management plan, and REGULAR TOWN BOARD MEETING, 12-17-2018, MTG#46 375 WHEREAS, the adopted document, entitled, "Lake George — Plan for the Future" identifies numerous recommendations and actions as being critical to pursuing the objectives of preserving,protecting and enhancing the water quality throughout the Basin, including examining alternatives to the current practices of using road salts to achieve winter road maintenance and identifying best management practices to minimize the application rates of salt and sand to roads throughout the Lake George Watershed, and WHEREAS,by Resolution No.:537,2008,the Queensbury Town Board authorized submission of the Road Salt Alternatives and Best Management Pilot Project Fund Application for State Assistance Payments in response to New York State's solicitation of Financial Assistance Grant, and WHEREAS,the New York State Department of State awarded to the Town of Queensbury$149,835 in grant funds for implementation of the Road Salt Alternatives and Best Management Pilot Project Fund Program(Project) and by Resolution No.: 260,2012, the Town Board accepted such$149,835 in grant funds, and WHEREAS,by Resolution No.: 195,2017, the Town Board reaffirmed its support of such Grant and NYS Agreement 4C303899 and designated David Wick, Executive Director of the Lake George Park Commission as the person to work with the Town of Queensbury to administer such Grant, and WHEREAS, by Resolution No.: 311,2017, the Town Board accepted the lowest quote for five (5) 3,000 gallon water tanks from National Tank Outlet in the total amount of$6,092 in connection with the Project to be paid for from grant funds received by the Town, and WHEREAS, the Village of Lake George built a salt shed and the Washington County Department of Public Works is purchasing brine equipment related to the Project, and WHEREAS,David Wick has recommended that the Town Board authorize funding of the purchase of these items in the total amount of $45,300.76 to the Village of Lake George and $19,122 to the Washington County Department of Public Works, and WHEREAS, Mr. Wick has also advised that there is currently a $2,500 final bill/invoice from the Superintendent of the Warren County Department of Public Works for writing the Winter Road Maintenance Operations Policies for the Towns of Queensbury, Hague and Ticonderoga, a$1,700 invoice to the Lake George Association toward repayment of an invoice toward the Winter Road Policy, and a $9,924.82 invoice to the Lake George Park Commission for grant administration fees, and WHEREAS,the Town Board wishes to authorize a temporary loan from its Capital Reserve Fund 964 in the total amount of$78,547.58 toward funding of these items, to be paid back when the Town receives its funds from the State, and WHEREAS, in accordance with New York State General Municipal Law §9-A, the Town Board is authorized to temporarily advance moneys held in any fund to any other fund and in accordance with New York State General Municipal Law §6(c), the Town Board is authorized to withdraw and expend funds from Reserve 964 subject to permissive referendum, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby authorizes funding toward the payment of 1) the purchase of a salt shed in the total amount of $45,300.76 to the Village of Lake George;
