PB Staff Notes SP 4-2019 Taylor_1 15 19 Town of Queensbury Planning Board Community Development Department Staff Notes January 15, 2019 Site Plan 4-2019 TRACY TAYLOR 21 Jay Road / WR – Waterfront Residential / Ward 1 SEQR Type II Material Review: application, survey, elevations, floor plans Parcel History: SP 40-2017 & AV 38-2017 1,935 sf addition; 93702-3453 septic alt.; AV 3-2019 __________________________________________________________________________________________ Requested Action Recommendation to the Zoning Board of Appeals for relief for setbacks and expansion of a non-conforming structure. Resolutions 1. PB Recommendation Project Description Applicant proposes to remove a 161.60 sq. ft. enclosed porch and to construct a new 161.60 enclosed porch with a 64 sq. ft. covered balcony above. No other site work or alterations are to occur. The new porch is no closer than existing porch. Pursuant to Chapter 179-13-010 of the Zoning Ordinance, expansion of a non- conforming structure shall be subject to Planning Board review and approval. Variance: Relief is sought for setbacks and expansion of a non-conforming structure. Planning Board shall provide a recommendation to the Zoning Board of Appeals. Staff Comments  Location- The project site is located at 21 Jay Road on Glen Lake off of Glen Lake Rd.  Arrangement- The applicant proposes to maintain the existing 2,149 sq ft camp and to construct a 161.60 sq ft addition with a 64 sq ft balcony..  Site Design- The existing site is 0.31 acres and includes a recently renovated home  Building – The existing home had an addition put on in 2017. The project was to have an attached garage but has not been constructed yet. The current project proposes to remove the existing enclosed porch to construct a new enclosed porch of the same size and to construct a balcony above.  Site layout and utility plan –The site contains on-site septic and a drilled well.  Grading and drainage plan and Sediment and erosion control -–The applicant has indicated there will be plantings around the porch area.  Elevations and Floor plans –the plans show the layout of the proposed addition. The floor plan of the home is also included indicating the basement is a crawl space.  Waivers-Planning staff has reviewed the applicants request for waivers that include items g. site lighting, h. signage, j. stormwater, k. topography, l. landscaping, n traffic, o. commercial alterations/ construction details, p floor plans, q. soil logs, r. construction/demolition disposal s. snow removal.  The waivers requested–Staff finds it reasonable to request a waiver as these items are typically associated with commercial projects.  Pursuant to Section 179-9-050 the Planning Board may grant waivers on its own initiative or at the written request of an applicant. The Board is to review the waivers and to determine if they are to be granted. Nature of Variance The proposed addition is to be located 31.6 ft from the shoreline where a 50 ft setback is required.
