Resolutions 1. Planning Board recommendation Project Description Applicant proposes to tear down the 4,935 sq. ft. building to construct a new 3,855 sq. ft. building for a new convenience store. Project includes removal of the fuel canopy and installation of a new 2000 sq. ft. fuel canopy. Pursuant to Chapter 179-3-040 of the Zoning Ordinance new commercial construction shall be subject to Planning Board review and approval. Variance: Relief is sought for setbacks and signage. Planning Board shall provide a recommendation to the Zoning Board of Appeals. Staff Comments  Location-The project location is at 347 Aviation Road, across the street from Soko’s Plaza.  Arrangement- The site has an existing 4,935 sq ft commercial building that is to be demolished and a new 3,855 sq ft building to replace it.  Site Design- The new building is to be setback further at 3,855 sq ft and orientation is perpendicular to the road. A new fuel canopy is also proposed. The building is to be used for the Stewart’s Shops convenience store no other tenants are proposed.  Building – The plans indicate a 3,855 sq ft building is to be constructed with orientation to be perpendicular with the property.  Signage-The applicant proposes two wall signs both to be 30 sq ft, with the wording to be Stewart’s Shops. Also, to be installed is a 42.5 sq ft free standing sign that is to have the same wording but will also have fuel price space for gas and diesel.  Site conditions-The existing commercial site is adjacent to a bank, offices, and a religious facility.  Traffic- The plans indicate the existing parking spaces on site are 33 and the required is 25 proposed is 30. (The application on page 3 states the parking incorrectly –it is correct on the plans). The plans show the existing curb cuts at 27 ft and they are to be increased to 30 ft. wide curb cuts.  Site layout and utility plan – There existing utilities that will be used for connection to the new building and fuel canopy on the site. The plans also show a new leach field for the on-site septic.  Grading and drainage plan –The submission included a stormwater management report that is being reviewed by the Town Designated Engineer. The plans due show fill to be brought on site, some areas will need to be raised greater than 10 inches.  Sediment and erosion control –The plans show silt fence to be placed around the entire site.  Landscape plan –The plans shows planting beds at the building, four planting beds on the sides and two planting beds in the front. The plans shows three red maples. Staff would suggest additional tree or evergreen plantings.  Site lighting plan – The site lighting indicates there are new pole lights, wall mounted lights and canopy lights for both the store and the fuel canopy. The site lighting is 2.02 foot candle average, the canopy is 24.42 where the guidance indicates 10 foot candles.  Elevations - The cover page indicates the elevations and color scheme of gray cobble and white accent trim.  Floor plans –The plans show there are two separate entrances to the building  Waivers-The applicant has not requested waivers. Nature of Variance The applicant proposes a 3,855 sq ft building that is to be 5 ft from the west property line where 20 ft is required. The fuel canopy is to be 2,000 sq ft and is to be 48 ft from the front property line where a 50 ft setback is required. Relief is also requested for permeability where 27% is proposed and 30% is required. The applicant proposes two wall signs both to be 30 sq ft, with the wording to be Stewart’s Shops where only one 30 sq ft wall sign is allowed. Also, to be installed is a 42.5 sq ft free standing sign that is to have the same wording but will also have fuel price space for gas and diesel that is to be located 5 ft from the side property line where a 15 ft setback is required. Summary The Planning Board is to provide a recommendation to the zba in regards to the relief requested for setbacks, permeability and signage. Board discussion items The board may suggest additional deciduous and or evergreen plantings on the site. st Meeting History: PB: 1 meeting; - 2 -
