Project Description
Applicant proposes a renewal of a produce stand on Cronin Road at the Elks Lodge – previous approval was for
a 20x20 tent and to operate for 5 years. Applicant request five years, a 20x30 tent and a display area (25 ft.
from edge of pavement). Pursuant to Chapter 179-3-040 of the Zoning Ordinance, produce stands shall be
subject to Planning Board review and approval.
Staff Comments
Location- The project is located at 32 Cronin Road and using a portion of the property facing Cronin Rd.
Arrangement- The applicant proposes to operate a produce stand with a 20 x 30 canopy with 3 tables on a
portion of the Elk’s Lodge property and use no more than 11 parking spaces at any one time. The produce
stand is to operate 7 days a week from 10am to 6pm daily with produce delivery daily during the week.
Site Design- The applicant notes one exception where the produce stand will not operate when the Elks
lodge has an event
Building – The existing Elks Lodge is to be used for restrooms by the employees but there is no use of the
building for the produce stand.
Signage- The applicant does propose signs where the code identifies Roadside stands in all zoning districts
shall be permitted two signs: one for identification and one for current products for sale, each sign not to
exceed 32 square feet.
Traffic- The applicant as described the parking needs of the site, the number of spaces needed for the
produce stand and the anticipated traffic to the stand is 100 cars during peak operating days Fridays,
Saturdays Sundays and Mondays.
Site plan overall- The applicant has requested a 5 year agreement with the Elks Lodge
Site layout and utility plan The operation is seasonal and does need any utility connections to operate –no
electricity. The Elks lodge will allow us to use restroom facilities and fill the carboys to anchor the canopy
on the site.
Landscape plan – There is no landscaping plan proposed however the applicant proposes to place a display
area 25ft from the edge of pavement that would include two 8 ft wide structures with 3 shelfs each for
display.
Site lighting plan –no lighting is necessary for the project.
Site details The produce that at the end of the day is covered nightly and refuse removed from the site on a
daily basis. The applicant has explained there are no site changes and existing site conditions to remain as
they are –no changes to stormwater, landscaping, lighting.
Waivers-Planning staff has reviewed the applicants request for waivers that include items g. site lighting, h.
signage, j. stormwater, k. topography, l. landscaping, n traffic, o. commercial alterations/ construction
details, p floor plans, q. soil logs, r. construction/demolition disposal s. snow removal.
The waivers requested–Staff finds it reasonable to request a waiver as these items are typically
associated with commercial building projects.
Pursuant to Section 179-9-050 the Planning Board may grant waivers on its own initiative or at the
written request of an applicant. The Board is to review the waivers and to determine if they are to be
granted.
Summary
The applicant has completed a site plan review application for operation of a produce stand for a five year
period that includes a 20x30 tend, a display area, shared parking area with the Elks lodge, and operations to be
seasonal –spring to fall.
