WHEREAS Burr M. Stark as agent for Joseph Brendose, has pre - sented a claim in the amount of 42003.10 for laying a water main along Homer Avenue, RESOLVED that siad board retain 10% from said claim to be paid by -the Town upon final acceptance of said work and that said claim be paid in the amount of $1802,79 being 900 of said claim. Duly adopted by the following vote: Harris Ayes - Mr. Walkup , Mr. Lampson, Mr. Sleight, L�?o. 1 ; _ fir, Noes - none Resolution i#48 introduced by Justice Sleight, seconded ky 'Councilman Walkups WHEREAS, the Town of Queensbury is the owner of property known as the Pine View -Cemetery property and by Chap, 814 of the. Laws of 1948 said town board is authorized to appoint a cemetery commission, and WHEREAS said town board has appointed such cemetery commission and said commissioners are duly organized and are now operating said cemetery pursuant to said lawf and WHEREAS it is necessary to purchase a truck for use in operat- ing and maintaining said cemetery, and WHEREAS the town board has purchased an International 1938 truck, D 30, kindred Engine #232-36300 for the sum of Five Fifty i Dollars (4550.00) , and WHEREAS there is not sufficient funds in the treasiAry for the payment of said truck and it is necessary to borrow on the faith and credit of the Town of Queensbury said sum for the purpose of paying the purchase price of said truck, RESOLVED 1. That the Town of Queensbury issue its serial bond in the amount of $550.00 to finance the purchase price of sai�I truck. 2. Said bond shall be numbered 1 and shall mature one year from date hereof. This bond may be called for redemption on any date prior to maturity after giving at least thirty days notice to the _ l 123 i holder thereof at the address shown in the book of the town clerk of the Town of Queensbury, and interest shall cease to be paid thereon after laid date ,of redemption, and the power to determine the date upon which said installment shall become due and payable is hereby delegated to the Supervisor. The bond shall be issued in bearer form without coupons and shall bear interest at a rate not exceeding three per cent (3�) payable annually. Payment of such interest shall be evidenced by notation thereof on the bond at the time of payment. The bond shall be in substantially the following form: I No. bl UNITED STATES OF AMERICA $550.00 STATE OF NEW YORK COUNTY OF 'WARREN TOWN OF QUEENSBURY SERIAL BOND OF 1948 The Town of Queensbury, in the County of Warren, a municipality of the State of New York, hereby acknowledges itself indebted, and for value -received, promises to pay to the bearer on the day of July, 1949, the sum of Five Hundred Fifty Dollars (4550.00) and interest at the rate of two and one half per cent per annum at the office of the Supervisor of the Town of Queensbury, New York. This bond is authorized and is issued pursuant to a resolution of the Town Board of the Tovm of Queensbury, duly adopted by said Town Board on the 8th day of July, 1948. The faith and credit of said Town of Queensbury, New York, are hereby irrevocably pledged for the punctual payment of the principal of and interest on this bond according to its terms. It is hereby certified and recited that -111 conditions , acts and things required by the Constitution and statutes of the State of New York to exist, to have happened and to have been performed precedent to and in the issuance of this bond, exist, have happened and have been performed, together with all other indebtedness of said Town of Queensbury, New York, is within every debt and other limit prescribed by the Constitution and laws of such State. IN WITNESS 'WEEREOF, the Town of Queensbury, New York, has caused this bond to be signed by its Supervisor, and its corporate seal to be hereunto affixed and attested by its Town Clerk and this bond to be dated as of the day of July, 1948. The Supervisor is hereby delegated the power to prepare such bond 'and to sell such obligation at not less than par .and accrued interest, and at such sale to fix the interest rate to be borne by such obligation within the limitation set forth in this I resolution. The Supervisor shall deliver such obligation to the purchaser thereof only against cash or a certified check. The pro - �--- ceeds of the sale of such obligation shall be deposited in the Pine. View Cemetery Account as required by Section 65 of the Local Finance Law. The power delegated to the Supervisor by this resolution shall be exercised in conformity with the provisions of the Local Finance Law. 4. This resolution shall take effect immediately. Bentley 124 The above resolution having received at least a two-thirds vote of the members of the Town Board, was declared by the Supervisor to be duly adopted. i Town Clerk Resolution # 49—introduced by Councilman Walkup, seconded by Coun- c_ n ampson: It is resolved that the Supervisor be and is hereby author- ized and directed to invest five hundred fifty dollars of the cap- ital reserve fund in Serial Bond No. 1 of the Town of Queensbury issued for the purpose of financing the cost of a truck for use in the Pine View Cemetery.
