1997-06-23 SPECIAL TOWN BOARD MEETING JUNE 23, 1997 4:37 P.M. MTG #30 RES. 255-256 BOARD MEMBERS PRESENT SUPERVISOR FRED CHAMPAGNE COUNCILMAN BETTY MONAHAN COUNCILMAN THEODORE TURNER COUNCILMAN CONNIE GOEDERT COUNCILMAN CAROL PULVER TOWN COUNSEL MARK SCHACHNER TOWN OFFICIALS Paul Naylor, Highway Superintendent John Goralski, Executive Director of Community Development Dave Hatin, Director of Building & Codes Chuck Rice, Facilities Manager Supervisor Champagne called meeting to order... RESOLUTION RESOLUTION AUTHORIZING PERMIT FOR FIREWORKS DISPLAY RESOLUTION NO. 255, 97 INTRODUCED BY: Mr. Theodore Turner (MOTION WITHDRAWN later WHO MOVED FOR IT'S ADOPTION in meeting) SECONDED BY: Mrs. Carol Pulver Councilman Monahan questioned who would be in charge of letting off the fireworks? Councilman Turner noted that Mr. Garvey himself would be doing it. Councilman Monahan noted concern that the town is giving permission to a person whose not licensed for explosives. Councilman Pulver referred to the town issuing a permit to West Mountain and to the West Glens Falls Fire Company for their celebrations. Councilman Monahan noted those permits were issued to organizations with companies licensed to do explosives, not individuals. Town Board held discussion regarding whether the town can legally grant permission to an individual rather then to an organization. (Discussion held awaiting Mr. Garvey's arrival) ATTORNEY MATTERS Town Counsel Mark Schachner noted that the town was served with papers regarding Fuller Road... time frame to respond would be around July 11th... would like to have an executive session to discuss the case some time prior to the July 7th meeting... Town Board held discussion and agreed to schedule special meeting for eleven o'clock, Monday, June 30th. COMMITTEE REPORTS Supervisor Champagne noted that the County will be meeting here with Paul Naylor on Wednesday at two o'clock to discuss plowing and ice removal of county roads. Discussion - Highway Roof Mr. Chuck Rice, Facilities Manager and Mr. Tom Nace, engineer submitted and reviewed specifications for the highway building roof with the Town Board... would like the board to consider entertaining resolution to go to bid for Monday, July 7th... PLANNED DISCUSSION ITEMS 4.01 EVA GRANGER UNSAFE STRUCTURE Mr. Dave Hatin, Director of Building and Codes gave an update to the board of the Eva Granger Unsafe Structure located at Crossover Lane in Assembly Point... noted that the board took action in January of 1997 requiring the owner to board up the structure and in the spring, clean up the debris around the structure... they did do some but very little, half of the debris if not more of the debris is still present... submitted pictures... looking for some direction from the board on how to proceed... Town Board held discussion, agreed that owner should appear again before the board. (Councilman Goedert entered meeting) 4.02 CRONIN ROAD DRAINAGE Councilman Turner referred to the Cronin Road drainage project... would like the board to consider hiring an engineer to move forward on the project... Town Board held discussion, agreed to get an estimate from Mr. Nace for engineering costs for the project. CONTINUED DISCUSSION - FIREWORKS DISPLAY Mr. Shawn Garvey, applicant present Town Counsel reviewed with Mr. Garvey the criteria required for issuing the fireworks display permit noting the following: the permit is issued to a sponsor, (the sponsor being a legal organization or corporation), the sponsor provides the needed insurance listing the Town of Queensbury as an additional insured with the hold harmless clause and provide his experience with the discharging of fireworks. Town Board withdrew motion... agreed to review application when applicant can provide the required information needed for fireworks permit. 4.04 TOP OF THE WORLD GOLF RESORT Mr. Greg Shay, Property Manager and unit owner present Mr. John Goralski, Executive Director of Community Development referred to letter received last week from the attorney for the Top of the World Golf Resort, Inc. officially requesting that the Town Board consider amending the PUD approval to allow them to maintain the eight motel units that were originally slated for demolition in the original plan. The Planning Board had tabled the subdivision request until such time this is ironed out. The letter from their attorney also says that they've applied to the Adirondack Park Agency to amend their park agency permit regarding the motel. The applicant is requesting the town to set a public hearing for July the 22nd, 1997 and it's my recommendation that you hold a public hearing. I have requested the owner that they provide us with a map showing us exactly the relationship of the motel units to the rest of the property, the location of the parking, what the septic system consists of, typical items that you would look at in doing this type of review... Town Board held discussion, agreed to hold from taking action until the AP A approves their permit. 4.05 EDDY GROUP Supervisor Champagne noted that the board had previously met with the Eddy Group who are considering an independent living facility at the corner of Meadowbrook and Hiland... they were asking for a pilot with the county and town and that pilot would be fifty percent first year taxes and an increased additional five percent over the next ten years reaching one hundred percent at the end often years... also asking for exemption from taxation from the special district for school taxes... Town Board held discussion, no decision made at this time. TOWN BOARD MEMBER MATTERS Supervisor Champagne noted that DOT has requested the town to consider moving our Welcome to Queensbury sign to another location closer to the Northway... Town Board held discussion, agreed to leave the sign right where it is. Councilman Goedert updated the board regarding the Highway Committee meeting noting that Sweet Road is a go, will be completed in full as proposed... would like to have resolution prepared for Monday night to transfer the funds. Councilman Pulver noted that Marylee Gosline contacted her and requested that a road tonnage limitation be placed on Glenwood Avenue... Town Board held discussion, noted that it's a County Road and would have to refer the request to thern... Supervisor Champagne noted a dangerous situation on the corner of Rockwell Road and Sunnyside Road... have received complaints regarding the lack of visibility due to the growth of shrubbery on the right hand side when leaving Rockwell Road and entering Sunnyside Road... Mr. Naylor, Highway Superintendent noted that the County owns a fifty foot right -of-way there and would need to contact thern. RESOLUTION CALLING FOR EXECUTIVE SESSION RESOLUTION NO. 255, 97 INTRODUCED BY: Mr. Theodore Turner WHO MOVED FOR IT'S ADOPTION SECONDED BY: Mrs. Carol Pulver RESOLVED, that the Town Board of the Town of Queensbury hereby adjourns from Regular Session and enters Executive Session to discuss personnel and contract negotiations.
