WHEREAS, the Queensbury Town Board previously established a Capital Reserve Fund
known as the Recreation Assessment Reserve Fund No. 61 (Fund No. 61) for future recreational
developments, and
WHEREAS, the Queensbury Recreation Commission previously discussed and agreed to
partner with the School District to relocate and expand on the campus outdoor tennis and basketball
court facilities, and
WHEREAS, the Department of Parks and Recreation makes use of the basketball and
tennis courts for recreational programs and activities,and
WHEREAS, by Resolution No.: 585,2005, the Town Board authorized, in part, creation of
the joint outdoor facility project known as the Queensbury School District Outdoor Facility Project
and corresponding Capital Project #156, which included construction of tennis courts at the
Queensbury School Campus, and
WHEREAS, by Memorandum to the Town Board dated December 6, 2018, the Town's
Recreation Commission has requested funding approval for a proposed specific capital
improvement and certain maintenance project, i.e., $30,000 toward the estimated $95,000 total cost
to repair and resurface the tennis courts (Project), as the Recreation Commission believes that this
joint project expenditure will continue to be in the best interest of both organizations as well as a
benefit to the community,and
WHEREAS, the School District has provided a draft Agreement for the division of rights
and responsibilities related to the Project, and
WHEREAS,the Town Board wishes to withdraw and expend moneys from Capital Reserve
Fund No. 61 in the amount of$30,000 for such specific capital improvement Project, and
WHEREAS, the Town Board wishes to authorize such Project and the withdrawal and
expenditure of moneys from Reserve No. 61 in the total amount of$30,000, and
WHEREAS, in accordance with New York State General Municipal Law §6-c, the Town
Board is authorized to withdraw and expend funds from Fund #61 subject to pennissive
referendum,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes the joint outdoor facility
project, i.e, the repair and resurfacing of the tennis courts on the Queensbu y School District
Campus Capital Project(Project), and
BE IT FURTHER,
RESOLVED, that the Town Board hereby finds that the withdrawal and expenditure for the
Project is an expenditures for a specific capital improvement for which the Reserve Account was
established and therefore authorizes an expenditure in the amount of$30,000 from Reserve No. 61,

and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes a transfer from Reserve Fund No.: 61
in the amount of$30,000 to Capital Project#156 to fund such Project and further directs that in the
event there are funds remaining after completion of the Project or in the event that the Project is not
undertaken,the moneys shall be returned to the Reserve,and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Budget
Officer to increase appropriations and estimated revenues, amend the Budget and take all actions
as may be necessary to fund such Project as authorized and as follows:
• 156-7110-2899 Capital Construction - $30,000
• 156-0000-55031 Interfund Transfers - $30,000
• 001-9950-9030-0061 - Transfer to a Capital Project$30,000
and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes and directs the Town Supervisor to
execute a Recreation Agreement between the Town of Queensbury and Queensbury Union Free
School District setting forth the parties' rights and responsibilities as related to the Project and use
of the facilities, such Agreement to be in a form acceptable to the Town's Director of Parks and
Recreation and Town Counsel, and
BE IT FURTHER,
RESOLVED, that this Resolution is subject to a permissive referendum in accordance with
the provisions of Town Law Article 7 and the Town Board hereby authorizes and directs the Town
Clerk to publish and post such notices and take such other actions as may be required by law, and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes and directs the Town Supervisor, Town
Budget Officer and/or Director of Parks and Recreation to sign any other documentation and take
any other actions necessary to effectuate the terms of this Resolution.

RE: RESOLUTION FOR USE OF RECREATION RESERVE FUNDS AT
QUEENSBURY SCHOOL TENNIS COURTS
The Recreation Commission recently voted unanimously to approve the use of Recreation Reserve Funds
(#61)for the repair and resurfacing of the public tennis courts located at Queensbury School Campus. The
Recreation Commission has had recent and previous discussions with school district personnel regarding
the current condition of the tennis courts that are used by both the School District and the Commission.
In 2005, the School District and the Commission/Town of Queensbury entered into an agreement to build
new tennis courts (10) and a basketball court. During that agreement, which lasted until 2015, the
partnership provided for each entity to have designated use of the courts,as well as a shared responsibility
for annual maintenance. Notably, even after the agreement expired, Queensbury School has continually
partnered with the Recreation Commission to sustain public use of the courts. It has been 13 years since
they were last sealed and resurfaced and it is critical that this work be done in order to ensure the
continued integrity of the playing surface, not only for the school district, but for the public as well.
While the Recreation Commission provides annual community programming and open play for the public
at this location,they understand the importance of assisting in the proper, scheduled maintenance of the
courts. The Recreation Commission is proposing to contribute $30,000 of the estimated $95,000 needed
in order to complete the necessary work. The Commission is proposing that the contribution be executed
using a similar resolution and agreement as in 2005 (see attached). The previous agreement confirmed
that use of the Recreation Reserve Fund #61 was proper and allowed. The current balance of the Fund
#61 is $62,000 and we are advocating use of less than 50%of the reserve to assist with this work.
In order to satisfy our need and ability to provide recreational programming and public access to these
courts, we must also be prepared to assume some level of financial investment to ensure their availability
for public recreation. These are the only public tennis courts within the Town of Queensbury under some
level of control by the Recreation Commission.

Dear Queensbury recreation Commission,
In 2006, the Queetisbury Union Free School District and the Tovyn of Queensbury collaborated on a shared
project to complete a renovation of the tennis courts and a basketball court on the Queensbury Union Free
School District campus.This joint effort has provided both the school district and the town of Queensbury
residents a quality facility for physical education classes, interscholastic athletic competition, instructional
lessons and recreational activities. It Is a facility that everyone can be very proud of.
As with any facility, routine maintenance is required.These courts are now in need of a resurfacing. It has
been over twelve gears eince they were metalled.This resurfacing requires a thorough cleaning,crack
repair, resurfacing topcoat and painting.This degree of maintenance can help assure that the respective
constituents continue to enjoy the facility and all that it brings to the school and iornmunity.
We would like to respectfully request consideration for another collaborative project on the maintenance of
these courts,We wish to further discuss the possibllities of obtaining funds to assist with the necessary
maintenance.to tape place sometime this spring.A date in dune after Glasses are finished lasing the.courts
and prior to the 4th of.Daly holiday weekend would be ideal.

WHEREAS, the Queensbury Town Board previously established a Capital Reserve Fund
known as the Recreation Assessment Reserve Fund No. 61 (Fund No. 61) for future recreational
developments, and
WHEREAS, the Queensbury Recreation Commission has previously discussed and agreed
to partner with the School District to relocate and expand on the campus outdoor tennis and
basketball court facilities, and
WHEREAS, the Recreation Commission supports this joint project expenditure which
would be in the best interest of both organizations as well as a benefit to the community, and

courts for recreational programs and activities in both the summer and winter seasons,and
WHEREAS, a draft Agreement setting forth the proposed division of responsibilities
between the organizations has been prepared as the result of many months of discussions and
negotiations between Counsel and representatives of both organizations,and
WHEREAS, such Agreement is acceptable to the Town's Director of Parks and Recreation,
and
WHEREAS, such Agreement is in form approved by Town Counsel, and
WHEREAS,the Town Board wishes to withdraw and expend moneys from Capital Reserve
Fund No. 61 in the amount of $140,000 for specific capital improvements and certain items of
equipment for the School District Outdoor Facility Project to include construction of four(4)tennis
courts which will be lighted and can be flooded and used as an ice rink in the winter as further set
forth in the draft Agreement, and
WHEREAS, in accordance with New York State General Municipal Law §6(c), the Town
Board is authorized to withdraw and expend funds from Fund #61 subject to permissive
referendum,
NOW, THEREFORE,BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes creation of the joint
outdoor facility project known as the Queensbury School District Outdoor Facility Project and
Capital Project #156 and authorizes expenditures in the total amount of$140,000 for the purposes
described in the preambles of this Resolution, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes and directs the Town Supervisor to
execute the Recreation Agreement between the Town of Queensbuny and Queensbury Union Free
School District substantially in the form presented at this meeting, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes a transfer from Fund No.: 61 in the
amount of$140,000 to fund such Project as set forth in the Agreement, and
