Project Description
Applicant requests to maintain an existing clearing within 50 ft. of the shoreline. The disturbance of
approximately 9,260 sq. ft. included brush and small trees and placing topsoil within 50 ft. of the shoreline.
Applicant stabilized the area with seed, mulch and straw, no further disturbance is proposed. Pursuant to
Chapter 179-6-050 of the Zoning Ordinance, clearing within 50 ft. of shoreline shall be subject to Planning
Board review and approval.
Staff Comments
Location-The project site is located at 135 Eagan Road off of Big Bay Road.
Arrangement-The project site has an existing home and shoreline frontage on the Hudson River.
Site Design-The applicant has complete some tree clearing on the property within 50 ft of the shoreline and
has added some topsoil to the same area.
Building -There is no building involved
Site conditions-the applicant has provided some before and after pictures of the site. The site contained
small trees that have been removed and the applicant has placed topsoil down. The images show the area
strawed and it’s to be a grassed area.
Grading and drainage plan and Sediment and erosion control – The applicant has stabilized the site with
straw. The site was reviewed by the Code Compliance officer and noted the site was stabilized with straw.
Landscape plan- the area is to be a new lawn area for the applicant.
Waivers-Planning staff has reviewed the applicants request for waivers that include items g. site lighting, h.
signage, j. stormwater, k. topography, l. landscaping, n traffic, o. commercial alterations/ construction
details, p floor plans, q. soil logs, r. construction/demolition disposal s. snow removal.
• The waivers requested–Staff finds it reasonable to request a waiver as these items are typically
associated with commercial projects.
• Pursuant to Section 179-9-050 the Planning Board may grant waivers on its own initiative or at the
written request of an applicant. The Board is to review the waivers and to determine if they are to be
granted.
Summary
The applicant has completed a site plan review application for removal of trees and placing topsoil in an area
within 50 ft of the shoreline. The applicant was made aware site plan review was required and the applicant has
supplied a letter in response to the work without approvals.
