BE 1T ENACTED BY THE TOWN BOARD OF THE TOWN OF t)UEENSBURY" AS FOLLOWS:
Section I .
Local Law titled, A Local Law Imposing Sewer Rents for the
Queensbury/tivaker Road Sewer Uistric:l (Chapter .136) is hereby amended to amend
or ►uodity certain provisions and fees set_ rorth in Article IV, Section 1 (136=
1370 as follows:
Section 1. "There is hereby established and imposed a scale of "sewer
rents" for services rendered by the sewer system to the real property within the
. lirc►its of the Central tlueerisbury/Quaker Road Sewer District.
Annual charges pursuant to Article 1, Section 1, Subdivision 1 hereof:
A. For residential properties $50.00 annually for each residential unit,
plus $2.75 per thousand gallons of average ,yearty wafer consumption in excess
of 50,000 gallons as indicated by the average water ►r►eter readings for the two
year period ending prior to the November lst quarterly billing period and
irrw►ediately preceding the calendar ,year for which sewer rents are assessed.

B. For non-residential properties $4.7992 per thousand gallons of
average yearly water consumption as indicated by the water meter readings for
the two year period ending prior to the November 1st quarterly billing period
and immediately preceding the calendar year for which sewer rents are assessed.
C. For non-residential properties that are not equipped with functioning
meters, the following schedule of charges shall apply:
All properties except restaurants, taverns, bars or similar uses with
one restroom - $239.96, annually.
Al properties except restaurants, taverns, bars or similar uses with
two or more restrooms - $479.92 annually.
Properties with restaurants, taverns, bars or similar uses - $719.88
annually.
Annual charges pursuant -to Article 1, Section 1, Subdivision 2.
A. For residential properties $2.2957 per thousand dollars of assessed
valuation:
Plus $50 per residential unit for the first 75,000 gallons of yearly water
consumption as indicated by the water meter readings for the one year period
ending prior to the November 1st quarterly billing period and immediately
preceding the calendar year for which sewer rents are assessed, and
$3.5681 per thousand gallons for water used in excess of 75,000 gallons of yearly
water consumption as indicated by the water meter readings for the one year
period ending prior to the November 1st quarterly billing period and immediately
preceding the calendar year for which sewer rents are assessed plus one of the
following charges:
1 . $289.1184 per acre for occupied residential properties, (classified A) ,
2. $289.1184 per acre for vacant residential properties, less than one acre,
(classified B) :

3. $173.4710 per acre for vacant residential properties more than one acre
area (classified C) , provided that said vacant residential properties are not
part of a multiple family dwelling unit site, condominium development, town house
development or other like development where vacant land is part of the
development and/or provided for as part of the development by any site plan or
development approvals granted by the Planning Board of the Town, in which
developments the housing units and/or entire development wi. tl qualify for this
rate for that part or portion of the vacant land of the entire development which
is in excess of that amount of land equal to one acre times the total number of
dwelling units.
4. 8115.64735 per acre for residential properties not having access to a
public street or highway in which a sanitary sewer is located or deed restricted
(classified DI); provided that said vacant residential properties are not part
of a multiple family dwelling unit site, condominium development, town house
development or other like development where vacant land is part of the
development and/or provided for as part of the development by any site plan or
development approvals granted by the Planning Board of the Town, in which
developments the housing units and/or entire development will qualify for this
rate for that part or portion of the vacant land of the entire development which
is in excess of that amount of land equal to one acre times the total number of
dwelling units.
5. $28.9118 per ac"•re for parcels which have been designated as a wetland under
the Environmental Conservation Law, (classified D2) .
B. For non-residential properties i) $2.2957 per thousand dollars of
assessed valuation, plus ii) $289.1184 per acre for vacant commercial properties,
(classified E) or S289.1184 per acre for commercial properties (classified F) ,
plus iii) $3.5681 per thousand gallons of yearly water consumption as indicated
by the water meter readings for the one year period ending prior to the November
1st quarterly billing period and immediately preceding the calendar year for
which sewer rents are assessed or for non-residential properties that are not
equipped with functioning water meters, the following schedule of charges shall
apply:
All properties except restaurants, taverns, bars or similar uses with

one restroom - $178.41, annually.
All properties except restaurants, taverns, bars or similar uses with
two or more restrooms - $356.81., annually.
Properties with restaurants, taverns, bars or similar uses - $535.22,
annually.
C. Al acreage shall be computed as listed and found upon the assessment
roll of the Town of Queensbury and if not so listed, as computed by the Town
Assessor's Office of the Town of Queensbury.
Section 2.
The local law referenced in Section 1 (Chapter 136) is hereby further
amended to modify certain provisions set forth in Article IV, Section 3 (136-
139) as follows:
Section 3. Sewer rents shall begin to accrue as of January 1, each year
for use in that year and shall be billed as early in the year as possible, but
not later than May 1st of any year.
Section 3.
The local law referenced in Section 1 (Chapter 136) is hereby further
amended to add a new Section following Section 5 in Article 1V (136-137) and to
be know as Article IV, Section 6 (136-137.1) as follows:
Section 6. Quantities of water, used at any premises, which are 1) used
exclusively for lawn watering or in a manufacturing process 2) results in the
said water not being deposited in the Town sewer system and 3) are metered by
a separate and specially installed and dedicated water meter to record such use,
shall not be used in calculating the total amount of charges or sewer rents due
by the owners of the said premises under this local law. The meter referred to
shall be installed in accordance with the rules and regulations of the Water
Department and any and all meters installed pursuant to this provision shall be
at the expense of the property owner and become property of the Town which shall
maintain the same.

Section 4 The modified rates and amendments proposed in this local law
shall be effective for sewer service and use, and rents due and owing commencing
January 1, 1991 and thereafter. Sewer rents, service and use or previous years
shall be in accordance with previously adopted local laws.
Section 5.
This local law shall take effect immediately.
