Chapter 136 of the Code of the Town of Queensbury is hereby amended to amend or modify certain provisions and fees set forth in Article XXIV, Section 136-137 as follows : i i Section 136-137 Annual Charges Established. There is hereby established and imposed a scale of "sewer rents" for services rendered by the sewer system to the real property within the limits of the Central Queensbury/Quaker Road Sewer District. A. Annual charges pursuant to 136-135A hereof: ( 1) For residential properties $50. 00 annually for each ' residential unit, plus $2 . 75 per thousand gallons of water consumption in excess of 50,000 gallons per year as indicated by the current water meter readings billed on a quarterly basis . (2) For non-residential properties $4 . 19 per thousand gallons of water consumption as indicated by the current water meter readings . (3) For non-residential properties that are not equipped with functioning meters, the following schedule of charges shall apply: (a) All properties except restaurants, taverns, bars or similar uses with one restroom - $209 .50, annually. (If additional space is needed, attach pages the same size as this sheet, and number each.) (1) DOS•239 (Rev. 7/90) (b) All properties except restaurants, taverns, bars or similar uses with two or more restrooms - $419 . 00 annually. (c) Properties with restaurants, taverns, bars or similar uses - $628 .50 annually. B. Annual charges pursuant to 136-135B: ( 1) For residential properties $2 .28 per thousand dollars of assessed valuation: (a) Plus $50 per residential unit for the first 75,000 gallons of yearly water consumption as indicated by the water meter readings for the one year period ending prior to the November 1st quarterly billing period and immediately preceding the calendar year for which sewer rents are assessed, and (b) $3.22 per thousand gallons for water used in excess of 75,000 gallons of yearly water consumption as indicated by the water meter readings for the one year period ending prior to the November 1st quarterly billing period and immediately preceding the calendar year for which sewer rents are assessed plus one or more of the following charges : [ 1] $291 . 84 per acre, proportioned accordingly for properties less than one acre, for occupied residential properties, (classified A) , (2 ] $291 .84 per acre for vacant residential properties, one acre or less proportioned accordingly for properties less than one acre, (classified B) , (3] $175 . 12 per acre for all acreage over one acre a part of residential properties more than one acre area (classified C) , [4 ] $116 .74 per acre for all acreage over one acre a part of residential properties not having access to a public street or highway in which a sanitary sewer is located or deed restricted prohibiting the construction of any additional buildings on the land in question (classified D1) , [5] $29 .20 per acre for parcels which have been designated as a wetland under the Environmental Conservation Law, (classified D2) . (2) For non-residential properties i) $2 .28 per thousand dollars of assessed valuation, plus 11) $291.84 per acre for vacant commercial properties, (classified E) or $291 .84 per acre for commercial properties (classified F) , plus iii) $3.22 per thousand gallons of yearly water consumption as indicated by the water meter (2) readings for the one year period ending prior to the November 1st quarterly billing period and immediately preceding the calendar year for which sewer rents are assessed or for non-residential properties that are not equipped with functioning water meters, the following schedule of charges shall apply: (a) All properties except restaurants, taverns, bars or similar uses with one restroom - $159 . 00, annually. (b) All properties except restaurants, taverns, bars or similar uses with two or more restrooms - $318 . 00, annually. (c) Properties with restaurants, taverns, bars or similar uses - $477 . 00, annually. ( 3) All acreage shall be computed as listed and found upon the assessment roll of the Town of Queensbury and if not so listed, as computed by the Town Assessor' s Office of the Town of Queensbury. Section 2 . Chapter 136 of the Code of the Town of Queensbury is hereby further amended to modify certain provisions set forth in Article XXIV, Section 136-145 as follows: Section 136-145 Penalty for Nonpayment. If capital construction bills are not paid by the last business day of the calendar month when rendered, a penalty of five-percent (5%) shall be added to any bill paid during the next calendar month or thereafter, plus a further penalty of one-percent ( 1%) per month shall be added to any bill paid during any month after the month the five-percent (5%) penalty is assessed until October 31 when said bills shall be turned over to Warren County for payment and assessed on taxes due the next year. If operation and maintenance bills are not paid by the last business day of the calendar month when rendered, a penalty of ten- percent ( 10%) shall be added to each billing not paid, except that there shall not be assessed a penalty on a penalty, until October 31 when said bills shall be turned over to Warren County for payment and assessed on taxes due the next year. Section 3 . The modified rates and amendments proposed in this Local Law shall be effective for sewer service and use, and rents due and owing commencing January 1, 1992 and thereafter. Sewer rents, service and use or previous years shall be in accordance with previously adopted Local Laws . Section 4. This Local Law shall take effect immediately.
