PB decision Project Description Applicant proposes to remove some vegetation –small trees on a portion of an existing 1.11 acre vacant parcel for display outside of retail items associated with existing businesses on adjoining lots such as wood carvings and outdoor furniture (no parking). Project includes site grading to place topsoil and to seed to install a lawn area. Pursuant to Chapter 179-3-040 of the Zoning Ordinance, new commercial display area shall be subject to Planning Board review and approval. Staff Comments  Location-The project site is the north parcel of 1652 State Route 9 (Real Property has indicated the address as 1652 and the applicant has indicated 1648.)  Arrangement- The project site contains assorted vegetation and a portion of the vegetation close to the road is to be removed to allow for outside sales.  Site Design- The existing parcel is 1.11 acres and a 15,300 sq ft area is to be cleared and 11,000 prepared for display area. The area may need additional topsoil and seed to establish a lawn area. The applicant proposes no building, no connection to utilities and all access to the site from the adjoining lot for pedestrians only. The applicant has indicate the site will most likely sell outdoor items –adk chairs, wood carvings, lawn ornaments or similar merchandise. The items for display will be setback 25 ft from the property line per the code requirement.  Building – There is no building proposed. All sales transactions will be handled by the cashier at the adjacent building.  Signage-No signage is proposed  Site conditions-The site current contains small woody vegetation.  Traffic- The area will have not have parking. All access to the site is from the adjoining parcel where parking is allowed on the existing hard surface. The site is only accessible for pedestrian traffic.  Grading and drainage plan and Sediment and erosion control – The applicant proposes to remove vegetation for an area of 4,500 sq ft, then place topsoil, seed and straw as needed. There is no hard surfacing proposed. The applicant may place woodchips down if needed.  Landscape plan –the applicant has indicate to utilize the area as a lawn area no additional vegetation to be added. The backdrop of the area will remain vegetative small woody shrub/tree plantings that currently existing on site.  Site lighting plan – no lighting on the site is proposed, the applicant has indicated there is lighting on the adjacent building.  Site details- The applicant is proposing to use the area for outdoor sales at this time. The applicant owns adjoining property with buildings that during americade operates a transient merchant market – the applicant as indicated this property is not part of the transient merchant market for the 2019 season and is aware a new application would need to be applied to use the property for transient merchant market.  Utility details – The site will not be connected to any utilities –ie water, sewer, electric  Waivers-Planning staff has reviewed the applicants request for waivers that include items g. site lighting, h. signage, j. stormwater, k. topography, l. landscaping, n traffic, o. commercial alterations/ construction details, p floor plans, q. soil logs, r. construction/demolition disposal s. snow removal.  The waivers requested–Staff finds it reasonable to request a waiver as these items are typically associated with commercial building projects.  Pursuant to Section 179-9-050 the Planning Board may grant waivers on its own initiative or at the written request of an applicant. The Board is to review the waivers and to determine if they are to be granted.
