Section 1. Intent; Authority — The Town Board recognizes the potential
economic benefit of pedestrian-oriented mixed-use development and wishes to encourage
such development within the Town. The Board also seeks to clarify the definition of
"story." This Local Law is adopted pursuant to New York Municipal Home Rule Law.
Section 2. Amendment of Zoning Law — Chapter 179 of the Queensbury Town
Code, entitled "Zoning" and known as the "Town of Queensbury Zoning Law" is hereby
amended as follows:
A. Paragraph C. of Section 179-2-010, entitled "Definitions and word usage"
is amended as follows:
(1) The following new definition of"Story" is added:
(If additional space is needed, attach pages the same size as this sheet, and number each.)

STORY -- That part of a structure contained between the level of one finished
floor and the ceiling above it; or, if the top story, that part of a structure contained
between the level of the highest finished floor and the ceiling above it.
B. Article 3, entitled "Zoning Districts" is amended as follows:
(1) Section 179-3-040, entitled "Establishment of zoning districts,"
Subsection (B) entitled, "Commercial districts", Subsection (5) entitled "Main
Street", is amended as follows:
(b) Dimensional requirements. All uses in this district must comply with the
requirements of Table 1 of this chapter and as follows (Note that all are minimum
requirements except floor area ratio, building height and size which are maximum
restrictions.):

C. Section 179-7-020, entitled "Purpose and goals; administration" subsection (C)(2)
is amended as follows:
(2) The term "shall" is interpreted as mandatory. Mandatory design elements
may not be waived or altered by the Planning Board.
D. Section 179-7-070, entitled "Main Street (MS)", Subsection (F) entitled
"Architectural Design"is amended as follows:
(1) Building height/proportion.
(a) Buildings shall be a minimum height of 25 feet and a maximum
height of 50 feet on Main Street. Buildings shall have a minimum
of two stories, and a maximum of three stories. Buildings within
150 feet of West Main Street and adjacent to plazas shall have the
same building height requirement.
(b) The first story height should be a minimum of 12 feet measured
floor to floor.
(c) Upper stories shall consist of useable space designed and suitable
for occupancy by uses noted in Table 3 of this Chapter.
E. Table 1, entitled "Table of Area Requirements" is amended as follows:

provision of this Local Law shall not invalidate any other clause, sentence, paragraph or
part thereof.
Section 4. Repealer— All Local Laws or Ordinances or parts of Local Laws or
Ordinances in conflict with any part of this Local Law are hereby repealed. In particular,
this Local Law is specifically intended to supersede the amended provisions of the current
Town of Queensbury Zoning Law.
Section 5. Effective Date — This Local Law shall take effect upon filing in the
office of the New York State Secretary of State or as otherwise provided by law.

F. Table 3, entitled "Summary of Allowed Uses in Commercial Districts" is
amended as follows:
(1) "Bank" is added as an Allowed Use with Site Plan Review (SP) in the
Main Street(MS)Zoning District.
(2) "Fast-food establishment" is added as a Special Use Permit Required
(SUP) use in the Main Street (MS) Zoning District.
(3) "Microbrewery" is added as an Allowed Use with Site Plan Review (SP)
in the Main Street(MS) Zoning District.
(4) "Movie Theater" is added as an Allowed Use with Site Plan Review (SP)
in the Main Street(MS) Zoning District.
(5) "Parking Lot" is added as an Allowed Use with Site Plan Review (SP) in
the Main Street (MS)Zoning District.
(6) "Parking Structure" is added as an Allowed Use with Site Plan Review
(SP) in the Main Street(MS)Zoning District.
(7) "Produce Stand" is added as an Allowed Use with Site Plan Review (SP)
in the Main Street(MS) Zoning District.
(8) "Tavern" is added as a Special Use Permit Required (SUP) use in the
Main Street(MS)Zoning District.

guess should not be removed. Is it the intent of the Town to remove § 5-6A? It would
seem that is subsection also should not be removed,but please advise if it should be.

WHEREAS, the Town Board wishes to consider adoption of Local Law No.: 7 of 2013 to
amend Queensbury Town Code Chapter 179, entitled "Zoning," to amend language and
requirements related to the Main Street Zoning District(the "proposal"), and
WHEREAS, before the Town Board may amend, supplement, change, or modify its Zoning
Law and Map, it must hold a public hearing in accordance with the provisions of Town Law §265,
the Municipal Home Rule Law and the Town of Queensbury Zoning Laws, and
WHEREAS, on or about December 12t', 2013 the Warren County Planning Department
considered the proposal and determined that there would be no County impact, and
WHEREAS, before the Town Board may amend, supplement, change, or modify its Zoning
Law and Map, it must hold a public hearing in accordance with the provisions of Town Law §265,
the Municipal Home Rule Law and the Town of Queensbury Zoning Laws, and
WHEREAS, the Town Board duly conducted a public hearing, heard all interested parties
and closed the public hearing concerning the proposal on Monday, December 161h, 2013, and
WHEREAS, as SEQRA Lead Agency, the Town Board has reviewed a Full Environmental
Assessment Form to analyze potential environmental impacts of the proposal, and
WHEREAS, the Town Board has considered the conditions and circumstances of the area
affected by the proposal, and
WHEREAS, the Town Board wishes to consider adoption of Local Law No.: 7 of 2013 as
presented at this meeting, hereinafter referred to as the "legislation,"
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby determines that the proposed
legislation will not have any significant adverse environmental impact and a SEQRA Negative
Declaration is made, and the Town Clerk and/or Zoning Administrator are authorized and directed
to file and publish a SEQRA Negative Declaration - Notice of Determination of Non-Significance
with respect to the legislation, and

notification that you could not file Local Laws 6 and 7 because you did not have a Local Law 5
on file. We sent Local Law 5 on December 3, 2013 certified mail. However, we neglected to
notice that we did not receive the green card back from you. I am under the assumption that it got
lost in the mail. Therefore, I am enclosing all three Local Laws to be filed in your office.

Hi Rose,
Per our conversation it sounds like you are looking for maps to be printed and distributed once these applications are
approved? If that's the case,what I have done in the past is print seven full Town zoning maps once a resolution is
approved. I can do the same here, but since the Main Street zoning boundary is not changing, I am wondering if I can
give you one set of zoning maps (7 copies)to go along with both resolutions?
Let me know if I am making sense of if you need me to clarify.
